WHEREAS, the City of Miami ("City") intends to construct a dog park within an existing public park as part of Office of Capital Improvements (OCI) Project Number 40- B233515 ("Project"); and WHEREAS, the Miami -Dade County Water and Sewer Department ("WASD") provides water and sewer services for the City at the Property; and WHEREAS, for the City to obtain permitting approval from WASD for the Project, a water and sanitary sewer agreement ("Agreement") must be executed between WASD and the City; and WHEREAS, the administrative fees associated with the Agreement are Two Hundred Thirty Six and 00/100 Dollars ($236.00) and the City's water connection charges for the Project under WASD's current connection charge rate is Six Hundred Ninety -Five and 00/100 Dollars ($695.00), all to be paid from OCI project number 40- B233515, with the water connection charges to be calculated at the rates in effect at the time of actual connection to WASD's water system; and WHEREAS, the City Manager requests authorization to negotiate and execute the Agreement with WASD for the provision of water services for the Project and any other documents deemed necessary for said purpose; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to negotiate and execute an agreement with WASD, in a form acceptable to the City Attorney, for the provision of water services for the Project at the Property. Section 3. The City Manager is further authorized' to negotiate and execute all other documents including any amendments, renewals, and extensions, all in forms acceptable to the City Attorney, subject to all allocations, appropriations, prior budgetary approvals, and compliance with applicable provisions of the Code of the City of Miami, Florida, as amended ("City Code"), including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose.
