HomeMy WebLinkAboutR-25-0436City of Miami Resolution R-25-0436 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 18265 Final Action Date: 10/23/2025 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, CONFIRMING, AND APPROVING THE CITY MANAGER'S RECOMMENDATION AND WRITTEN FINDING, ATTACHED AND INCORPORATED AS EXHIBIT "A," PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"); WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING METHODS AS NOT BEING PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI ("CITY") TO ESTABLISH AN AGREEMENT FOR THE PROVISION OF A MENTORSHIP PROGRAM FOR YOUTHS ("PROGRAM") WITH BIG BROTHERS BIG SISTERS OF MIAMI, INC., A NOT -FOR -PROFIT ORGANIZATION ("BBBS MIAMI"); AUTHORIZING THE ALLOCATION AND APPROPRIATION OF FUNDS, IN A TOTAL AMOUNT NOT TO EXCEED FOUR HUNDRED THOUSAND DOLLARS ($400,000.00) FROM THE CITY'S DEPARTMENT OF HUMAN SERVICES ACCOUNT NO. 00001.450000.548000.0.0, FOR PROGRAM SERVICES COMMENCING NOVEMBER 1, 2025 THROUGH OCTOBER 31, 2026; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT WITH BBBS MIAMI AND ANY NECESSARY DOCUMENTS INCLUDING ANY AMENDMENTS, RENEWALS, AND EXTENSIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS PRIOR BUDGETARY APPROVALS, AND COMPLIANCE WITH APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING, THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE. SPONSOR(S): Commissioner Ralph "Rafael" Rosado WHEREAS, Big Brothers Big Sisters of Miami, Inc., is a United States Internal Revenue Code Section 501(c)(3) not -for -profit organization ("BBBS Miami"), that focuses on helping students succeed by enhancing and expanding mentoring programs within the City of Miami ("City"); and WHEREAS, the City Manager has made a written finding and recommendation, attached and incorporated as Exhibit "A," pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), that competitive bidding is not practicable or advantageous to the City to establish a contract with BBBS Miami for the provision of a mentorship program for youths within the City ("Program"); and City of Miami Page 1 of 3 File ID: 18265 (Revision:) Printed On: 11/24/2025 File ID: 18265 Enactment Number: R-25-0436 WHEREAS, BBBS Miami's Program will establish opportunities for youths within the City by using a comprehensive approach to mentoring, which includes one-to-one and group mentoring; and WHEREAS, the Program will be designed to meet the diverse needs of the City's youth by supporting and emphasizing five pillars for development in the areas of academic enrichment, career pathways, digital literacy, health and wellness, and music and the arts; and WHEREAS, the City wishes to fund and to enter into an agreement with BBBS Miami for the provision of Program services, in an amount not to exceed four hundred thousand dollars ($400,000.00), during the period commencing November 1, 2025 through October 31, 2026, with payments for such services to be funded from the City's Department of Human Services' Budget Account No. 00001.450000.548000.0.0; and WHEREAS, pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), the City Manager has waived competitive sealed bidding methods by making a written finding, attached and incorporated as Exhibit "A," that competitive sealed bidding is not practicable or is not advantageous to the City with reasons supporting the same; and WHEREAS, said written findings require ratification, confirmation, and approval by the City Commission by a four -fifths (4/5ths) affirmative vote after an advertised public hearing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's recommendation and written finding, attached and incorporated as Exhibit "A," that the requirements for competitive sealed bidding methods are not practicable or advantageous to the City, and waiving said requirements pursuant to Section 18-85(a) of the City Code, are ratified, confirmed, and approved. Section 3. The City Manager is authorized to allocate funds in the total amount not to exceed $400,000.00, from City's Department of Human Services Account No. 00001.450000.548000.0.0. for Program services by BBBS Miami commencing November 1, 2025, through October 31, 2026. Section 4. The City Manager is further authorizedI to negotiate and execute an agreement for Program services with BBBS Miami and further execute all other documents, including any amendments, renewals, and extensions, all in forms acceptable to the City Attorney, subject to allocations, appropriations, prior budgetary approval, and compliance with applicable provisions of the City Code, including, the City's Procurement Ordinance, Anti - deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, and in compliance with applicable regulations, as may be necessary for said purpose. 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions.
