(the "Applicant"), related to the properties located at 600 SW 8 Street, 840 SW 6 Avenue, and 601 SW 9 Street (the "Property") in the City of Miami (the "City"). The Miami - Dade County Property Appraiser's Office identifies these parcels by Tax Folio Nos. 01-0206-020-1010, 01-0206-020- 1150, and 01-0206-020-1160, respectively. See Exhibit A, Property Addresses and Folio Numbers. This letter shall serve as the required letter of intent and analysis in support of a Future Land Use Map ("FLUM") amendment for the southern portion of the Property from Medium Density Restricted Commercial to Restricted Commercial and a companion Miami 21 zoning atlas amendment from T5-L to T6-8-O (the "Application"). The Applicant's goal is to eliminate the development difficulties created by the split zoning of the Property, which results in a discordant development pattern inconsistent with recent changes occurring on SW 8 Street. Property Description. The Property is bounded on the east by SW 6 Avenue, on the north by SW 8 Street, and Mr. David Snow, Planning Director Page 2 of 8 on the south by SW 9 Street. The Property is approximately 29,000 square feet in size and with approximately 290 feet of frontage along SW 6 Avenue. The Property is vacant along SW 6 Avenue and SW 9 Street and improved with a surface parking lot where it fronts SW 8 Street. It comprises the easternmost portion of one of the many blocks in Little Havana hemmed in by the major arterial roadway that is SW 8 Street. See Figure 1. Aerial, below. The Property lies only a block away from two (2) similar recently adopted FLUM and atlas amendments on south side of SW 7 Street on blocks that front SW 8 Street to correct this split zoning incongruity — one in 2018 and more recently, in April of 2024. See Composite Exhibit B, Nearby Recent FLUM and Atlas Amendment Ordinances. These changed circumstances make the passage of these amendments necessary in order to allow for cohesive redevelopment consistent with other properties in the area. Figure 1. The requested FLUM change will permit a more congruous and contextual redevelopment that takes into consideration changed circumstances along the SW 8 Street corridor — namely the growing recognition that a split FLUM designation on these important blocks bound by Little Havana's major arterial roadways is not workable as evidenced by the abovementioned approved FLUM and atlas amendments in the same vicinity. Zoning. The Miami 21 GIS Atlas indicates that the southern portion of the Property is zoned T5-L (Urban Center Zone) and the remaining portion of the Property as T6-8-O (Urban Core Zone). See Figure 3, Zoning Map Excerpt, below. Figure 3. Zoning Map Excerpt The Property's zoning faces the same issue as its Future Land Use classification: although the Property is in common ownership and would benefit the neighborhood from being developed holistically, the Property has split zoning designations. The Applicant is seeking to improve and correct this condition with the current Application so that the Property may be redeveloped with a consistent set of development standards and uses. Miami 21's goals of emphasizing pedestrianism and walkability along important thoroughfares like SW 8 Street are best achieved by encouraging unified development of Bercow Radell Fernandez Larkin & Tapanes 1 305.377.6223 direct 1 305.377.6222 fax 1CKoshal@brzoninglaw.com Mr. David Snow, Planning Director Page 5 of 8 parcels facing these thoroughfares with neighboring properties to place those necessary elements such as driveways, FPL vaults, and mechanical equipment on to less pedestrian - oriented thoroughfares such as SW 6 Street. Accordingly, the Applicant seeks an atlas change for the southern portion of the Property, so that the entirety of the Property is zoned T6-8-O. Article 7, Section 7.1.2.8(c) of Miami 21 states that a rezoning of land will only be considered where the proposal involves an extension of an existing transect boundary, unless the rezoning involves at least 40,000 square feet of land area or 200 feet of street frontage on one street. Here, the proposed rezoning would be an extension of the abutting T6-8-O transect boundary to the north which satisfies the rezoning criteria set forth in Section 7.1.2.8(c) of Miami 21. Absent this abutting zoning condition, the Property would still qualify to apply for a rezoning as it has 290 feet of frontage on SW 6 Avenue. The request to change a portion of the Property from T5-L to T6-8-O is permitted by the successional zoning table. Thus, the Applicant's requested change is consistent with successional rezoning requirements. Analysis. As further described below and in accordance with Section 7.1.2.8(f) of Miami 21, approval of the Application will advance many of the MCNP's goals, objectives and policies. First, the application is consistent with the MCNP's "Correspondence Table — Zoning and Comprehensive Plan." See Page 27, MCNP excerpt below. Approval of the Application will catalyze redevelopment of the Property in the historically commercial area along the SW 8 Street corridor by creating a uniform and predictable set of development parameters. The Applicant is submitting the Application to help activate this major thoroughfare and enhance the physical character and appearance of Little Havana's built environment. The Application will facilitate redevelopment of the Property with a commercial use that will be neighborhood -serving and bring employment opportunities within walking distance of existing residential uses, in proximity to existing public facilities and transit options. At this point in time, the split land use and zoning create inconsistent regulations applicable to the Property which are a bar to its cohesive redevelopment. If not rezoned, the Property would be difficult to develop in a unified manner and could cause it to continue to be dormant and underutilized. Any redevelopment will adhere to the design standards of Miami 21 that encourage walkability. Policy LU-1.3.15.- The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other. Approval of the Application will continue to encourage a development pattern of fostering commercial uses not only on SW 8 Street, but also along its intersections with adjacent north -south avenues such as SW 6 Avenue, consistent with prior recent approvals. This will offer a wider amount and type of employment opportunities for nearby residents, located in close proximity to the City's urban core. The proposed rezoning and FLUM change will be consistent with the recent abovementioned FLUM and zoning atlas amendments to the west and contribute to the continued improvement of the surrounding area. Objective LU-1.6.: Regulate the development or redevelopment of real property within the city to insure consistency with the goals, objectives and policies of the Comprehensive Plan. Approval of this application will allow the redevelopment of the Property in a manner that advances many of the goals, objectives and policies of the MCNP as outlined here, as well as the minimum rezoning requirements provided in Miami 21. Goal TR-1: Maintain an effective and cost-efficient circulation network that provides transportation for all persons while reducing the dependency on automobiles and overall roadway congestion. Although located near Brickell, Downtown, and other areas well -served by public transportation, residents of these areas (and more suburban locations to the west, northwest, and southwest) still own and use automobiles. While the City's transportation goals laudably move City residents towards a built environment that can reduce, and some day eliminate the need for car ownership, many in the urban core still have at least one (1) car for their household. A car dealership offering the same brands (and accepting the same for repair) cannot be found nearby, necessitating longer vehicular trips for car purchases, service, and maintenance. This adds unnecessary strain to the City's roadways and increases congestion. The Application will permit this use to be developed in an area where it best serves residents who still choose to own at least one (1) car — central to the urban core and outlying suburban neighborhoods. Conclusion. This Application satisfies the rezoning requirements provided in Miami 21, with a successional zoning classification that responds to the existing conditions of the City, and is consistent with the goals, objectives and policies of the MCNP. Further, this Application will correct the split zoning of the Property and facilitate the redevelopment of vacant and underutilized land along a prominent City thoroughfare, that will be consistent with the surrounding urban context. To the south are multifamily residential uses on properties with a Medium Density Multifamily Residential Miami Comprehensive Neighborhood Plan ("MCNP") FLUM designation. That FLUM designation permits residential density up to 65 dwelling units per acre', and thus maintains the transition from the mixed -use blocks bounded by SW 8 Street and SW 9 Street to the dense, solely residential use to the south. At this point in time, the split land use and zoning create inconsistent regulations applicable to the Property which are a bar to its cohesive redevelopment. If not redeveloped, the Property would be difficult to develop in a unified manner and could cause it to continue to be dormant and underutilized. This encourages the ideal balanced mix of uses as it places density and intensity where it is best served: along a major, six -lane arterial2, located not far from the Brickell Metrorail Station and northernmost section of the Underline. This Application furthers this policy by having this area serve as a transition from the higher intensity and density of West Brickell to the lower density, predominantly residential areas to the Property's south. PolicyLU-1.3.7.- The Cityshall continue to use the City's Commercial Business Corridors, Opportunity Zones, and Brownfield Redevelopment Area strategies to stimulate economic revitalization and encourage employment opportunities.
