PURPOSE: This will change the zoning atlas of the property at 710 Southwest 16
Avenue, from "T5-O," Urban Center Transect Zone - Open To "T6-8-O," Urban Core
Transect Zone - Open.

AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH
ATTACHMENT(S), AMENDING THE ZONING ATLAS OF ORDINANCE
NO. 13114, THE ZONING CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED ("MIAMI 21 CODE"), BY CHANGING THE ZONING
CLASSIFICATION FROM "T5-O," URBAN CENTER TRANSECT ZONE -
OPEN, TO "T6-8-O," URBAN CORE TRANSECT ZONE — OPEN, FOR THE
PROPERTY GENERALLY LOCATED AT 710 SOUTHWEST 16 AVENUE,
MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN THE
ATTACHED AND INCORPORATED EXHIBIT "A"; MAKING FINDINGS;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the property generally located at 710 Southwest 16 Avenue, Miami, Florida,
as more particularly described in the attached and incorporated Exhibit "A," ("Property") has a
zoning classification of "T5-O," Urban Center Transect Zone — Open, on the Zoning Atlas of
Ordinance No. 13114, the Zoning Code of the City of Miami, Florida, as amended ("Miami 21
Code"); and
WHEREAS, Melissa Tapanes, Esquire, on behalf of 1603 SW 8 Street LLC ("Applicant"),
has submitted a request to change the zoning classification of the Property ("Property" may also
referred to as the "North Parcel") to "T6-8-O," Urban Core Transect Zone — Open, to unify the
zoning with the property immediately to the south, located at 1603 Southwest 8 Street ("South
Parcel"), identified by Miami -Dade County Property Appraiser by Folio No. 01-4102-012-0120;
and
WHEREAS, the Property is approximately 15,763 square feet (0.359 acres) of land,
and
WHEREAS, the Future Land Use Map ("FLUM") designation of the Property is
Restricted Commercial; and
WHEREAS, the request to change the zoning classification from "T5-O," Urban Center
Transect Zone - Open to "T6-8-O," Urban Core Transect Zone — Open, is consistent with the
existing future land uses ("FLU") of Property is Restricted Commercial; and
WHEREAS, the South Parcel is zoned "T6-8-O," Urban Core Transect Zone — Open;
and
WHEREAS, the application is consistent with the Miami 21 Code, Article 7, Section
7.1.2.8.f.1(a) in that the requested change in zoning classification of "T5-O," Urban Center
Transect Zone — Open, to "T6-8-O," Urban Core Transect Zone - Open, meets the intent of
Goal LU-1 and Policy LU-1.2.1 of the City of Miami Neighborhood Comprehensive Plan

("MCNP") as it will broaden the scope of allowable Uses and rejuvenate the neighborhood by
creating local jobs; and
WHEREAS, the request is consistent with the Miami 21 Code, Article 7, Section
7.1.2.8.f.1(b) as it aligns with the current development trends and land uses in the immediate
area; and
WHEREAS, the Planning Department recommends approval of the change in zoning
classification from "T5-O," Urban Center Transect Zone — Open, to "T6-8-O," Urban Core -
Open Transect Zone - Open; and
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting on
September 3, 2025, following an advertised public hearing, adopted Resolution No. PZAB-R-25-
046 by a vote of seven to zero (7-0), Item No. PZAB.3, recommending approval of the
amendment to the Zoning Atlas of the Miami 21 Code; and
WHEREAS, due consideration has been given as to whether the proposed change will
further the goals, objectives, and policies of the MCNP, the Miami 21 Code, and other City
regulations; and
WHEREAS, due consideration has been given to the need and justification for the
proposed change, including changing and changed conditions that make the passage of the
proposed change necessary;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission approves the amendment to the Zoning Atlas of the
Miami 21 Code by changing the zoning classification from "T5-O," Urban Center Transect Zone
— Open, to "T6-8-O," Urban Core Transect Zone — Open, for the Property generally located at
710 Southwest 16 Avenue, Miami, as more particularly described in "Exhibit A," attached and
incorporated.
Section 3. This Ordinance shall become effective ten (10) days after approval at second
reading.'

1 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein. whichever is later.
