In total, the Property consists of approximately 44,996 square feet (±1.03 acres). The aerial below shows the Property location. The property owned by MF2 is currently developed with a two story building, which formerly served as a church. This property was built on or about 1963. Under its current T5-L zoning designation, the first and second story of the building and commercial and office uses are limited to less than 25% of the building floor area total. The rezoning of this property to T5-O will permit MF2 to use the entirety of the existing building as commercial and office use. KLA is developing its property under its current City of Miami approvals as the site of its new pre-school and elementary school facility. The property owned by Lopez plans to remain the same. The proposed rezoning to T5-O will only remove the commercial and office use floor area limitations on the Property while maintaining all other requirements already imposed under the existing T5- L zoning designation. This request meets the criteria for Amendments to Section 7.1.2.8 of the Miami 21 Code. Specifically, this requests furthers Section 7.1.2.8.(a) and (f), which encourages zoning changes within the same Transect Zone to a greater intensity. LAND USE GOALS The requested change is consistent with several of the City of Miami Comprehensive Neighborhood Master Plan Goals, Objectives and Policies in particular the following Land Use Element Objectives: Goal LU-1: Maintain a land use pattern that (1) protects and enhances the quality of life in the City's neighborhoods; (2) fosters redevelopment and revitalization of blighted or declining areas; (3) promotes and facilitates economic development and the growth of job opportunities in the city; (4) fosters the growth and development of downtown as a regional center of domestic and #82116112 v2 Mr. Cesar Garcia -Pons May 20, 2021 Page 4 international commerce, culture and entertainment; (5) promotes the efficient use of land and minimizes land use conflicts while protecting and preserving residential sections within neighborhoods; (6) protects and conserves the city's significant natural and coastal resources; and (7) protects the integrity and quality of the City's existing neighborhoods by insuring public notice, input and appellant rights regarding changes in existing zoning and land use regulations. The requested rezone change promotes the redevelopment of an existing building to provide commercial and office uses without limitations. This directly promotes and facilities economic development and the growth of job opportunities by further expanding the amount of commercial and office use space that can be used. The proposed rezone will continue to promote and preserve the character of the existing neighborhood as the proposed rezoning to T5-O will only remove the commercial and office use floor area limitations on the Property while maintaining all other requirements already imposed under the existing T5-L zoning designation. This will match the uses already permitted by the abutting T4-O designation. Additionally, the rezone will not change the existing development proposed by KLA. Objective LU-1.1: Ensure that land and development regulations are consistent with fostering a high quality of life in all areas, including the timely provision of public facilities that meet or exceed the minimum level of service (LOS) standards adopted in the Capital Improvements Element (CIE) of the Miami Comprehensive Neighborhood Plan. Policy LU-1.1.3. Policy LU-1.1.7.• The City's zoning ordinance provides for protection of all areas of the city from: (1) the encroachment of incompatible land uses; (2) the adverse impacts of future land uses in adjacent areas that disrupt or degrade public health and safety, or natural or man-made amenities; (3) transportation policies that divide or fragment established neighborhoods; and (4) degradation of public open space, environment, and ecology. Strategies to further protect existing neighborhoods through the development of appropriate transition standards and buffering requirements will be incorporated into the City's land development regulations. Land development regulations and policies will allow for the development and redevelopment of well -designed mixed -use neighborhoods that provide for the full range of residential, office, live/work spaces, neighborhood retail, and community facilities in a walkable area and that are amenable to a variety of transportation modes, including pedestrianism, bicycles, automobiles and mass transit. The re -designation of the Property to T5-O will expand the commercial and office uses available on the Property specifically as it relates to the MF2 parcel. Providing commercial and office uses within a neighborhood that provides residential uses, educational facilities, and neighborhood parks will allow for well -designed neighborhoods with a full range of uses.
