WHEREAS, the City of Miami ("City") intends to construct and connect a five thousand four hundred eighty (5,480) square foot community center as part of Office of Capital Improvements ("OCI") Project Number 40-B193512 ("Project"); and WHEREAS, the Miami -Dade County Water and Sewer Department ("WASD") provides water and sewer services for the City at the Property; and WHEREAS, the City also intends to connect a fire line, replacing four thousand five hundred eleven (4,511) square feet of community center, previously connected to WASD, resulting in no additional water and sewer connection charges due to an average daily gallonage credit; and WHEREAS, for the City to obtain permitting approval from WASD for the Project, a water and sanitary sewer agreement ("Agreement") must be executed between WASD and the City; and WHEREAS, the administrative fees associated with the Agreement are One Hundred Fifty -Four Dollars ($154.00) and there are currently no water and sewer connection charges to the City for the Project, all fees and charges to be paid from OCI project number 40-B193512, with any future the water and sewer connection charges to be calculated at the rates in effect at the time of actual connection to WASD's water system; and WHEREAS, the City Manager requests authorization to negotiate and execute the Agreement with WASD for the provision of water services for the Project and any other documents deemed necessary for said purpose; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized1 to execute an agreement with WASD, in substantially the attached form, for the provision of water and sewer services for the Project at the Property. Section 3. The City Manager is further authorized to negotiate and execute all other documents including any amendments, renewals, and extensions, all in forms acceptable to the City Attorney, subject to all allocations, appropriations, prior budgetary approvals, and compliance with applicable provisions of the City Code, including, the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, all in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption.
