A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, RATIFYING,
CONFIRMING, AND APPROVING THE CITY MANAGER'S FINDINGS,
ATTACHED AND INCORPORATED AS EXHIBIT "A", THAT IT IS MOST
ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY") TO WAIVE THE
COMPETITIVE SEALED BIDDING PROCEDURE PURSUANT TO SECTION
18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED
("CITY CODE"), AND RETROACTIVELY APPROVING THE SELECTION OF
TOMKA LLC FOR THE EMERGENCY PURCHASE OF ELECTRICAL
CIRCUITS TO PREVENT HAZARD AND SECURITY ISSUES AT THE MARINE
STADIUM MARINA, LOCATED AT 3501 RICKENBACKER CAUSEWAY, MIAMI,
FLORIDA, 33149, DUE TO A WIRING SHORTING ISSUE UNDERGROUND
THAT PREVENTED THE SUPPLY OF ELECTRICITY TO THE FUEL PUMPS,
FOR AN AMOUNT OF THIRTY NINE THOUSAND SEVEN HUNDRED FIFTY
FOUR AND 00/100 DOLLARS ($39,754.00); ALLOCATING FUNDS FROM THE
DEPARTMENT OF REAL ESTATE AND ASSET MANAGEMENT'S ("DREAM")
REPAIRS AND MAINTENANCE ACCOUNT CODE FUND
34000.221001.670000.0000.00000; AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS, ALL IN FORMS
ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALL ALLOCATIONS,
APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, AND COMPLIANCE
WITH APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING, THE
CITY OF MIAMI'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT,
AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER
18 OF THE CITY CODE, AND IN COMPLIANCE WITH ALL APPLICABLE
LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED NECESSARY
FOR SAID PURPOSE.
WHEREAS, on June 12, 2025, an underground wiring short at the Marine Stadium
Marina, located at 3501 Rickenbacker Causeway, Miami, Florida, disrupted the electrical supply
to the fuel pumps and surrounding lighting racks; and
WHEREAS, the Department of Real Estate and Asset Management ("DREAM") has
identified the issue as a safety hazard and security concern due to inadequate lighting in the
area; and
WHEREAS, the lack of power to the fuel pumps has negatively impacted the City of
Miami's ("City") revenue, as these pumps are used to resell fuel for profit; and
WHEREAS, the City Manager pursuant to Section 18-90 of the Code of the City of
Miami, Florida, as amended ("City Code"), made a written finding, attached and incorporated as

Exhibit "A" ("City Manager's Findings"), that an emergency exists and approved an emergency
purchase request by DREAM of replacement electrical circuits to restore proper functionality;
and
WHEREAS, the City Commission desires to ratify, confirm, and approve, the City
Manager's Findings to protect the life, health, welfare and convenience of the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, the City Commission hereby ratifies,
approves, and confirms the City Manager's Findings, that it is most advantageous for the City to
waive the competitive sealed bidding procedures, pursuant to Section 18-90 of the City Code
and retroactively approving the selection of Tomka LLC for the emergency purchase of electrical
circuits for the Marine Stadium Marine, located at 3501 Rickenbacker Causeway, Miami,
Florida, for an amount of Thirty Nine Thousand Seven Hundred Fifty Four and 00/100 Dollars
($39,754.00).
Section 3. Funds to be allocated from DREAM Repairs and Maintenance Account Code
No. 34000.221001.670000.0000.00000.
Section 4. The City Manager is authorized' to negotiate and execute any and all
documents, all in forms acceptable to the City Attorney, subject to all allocations, appropriations,
prior budgetary approvals, and compliance with applicable provisions of the City Code,
including, the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity
Principles, all as set forth in Chapter 18 of the City Code, all in a form acceptable to the City
Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed
necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption.
APPROVED AS TO FORM AND CORRECTNESS:
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
