Miami, FL 33127. Dear Sir or Madam: Please be advised that your application for a one (1) year extension of Temporary Use of Vacant Land Permit No. PZ-23-16384 ("Permit") for the property located at 220 NW 27 St, 2600, 2612, and 2630 NW 2 Av. Miami, FL 33127. ("Property") has been reviewed and approved with the following conditions: 1. This permit is valid beginning March 4th, 2024, through September 30, 2025, pursuant to Section 62- 535(a) of the Code of the City of Miami, Florida, as amended ("Code"). After this Permit expires, Temporary uses on vacant land may be further extended beyond the three-year maximum by City commission. 2. All conditions detailed in the original TUP permit under PZ-21-11708, as well as the conditions associated with the approved TUP modification under PZ-22-13215 shall remain the conditions of this Permit. 3. Temporary Certificate of Use No. 101345 must be renewed, with all applicable renewal fees paid prior to its expiration, as required pursuant to Section 62-535(c) of the Code of the City of Miami, Florida, as amended ("Code"). 4. A copy of this Permit and all previous approvals shall be displayed in the office or some conspicuous place on the premises and shall be displayed to the general public or any police department personnel, code enforcement inspector, or other official of the City upon request during normal business hours. 5. This Permit may be modified at any time at the sole discretion of the City. 6. Any duly authorized representative of the City, may, at any reasonable time, enter, monitor, sample, test and inspect, as often as may be necessary, the Property to ensure compliance with the conditions of this Permit, as well as all other applicable federal, state, and local laws, rules, regulations, codes, and ordinances. All violations shall be subject to enforcement via Chapter 2, Article X, Code Enforcement, and any other remedies as are provided by law, jointly and severally, including but not limited to the revocation of the Permit, Certificate of Use, or Business Tax Receipt. 8. All conditions and comments detailed by the applicable departments in their review of this Permit are the following: Fire Department Where cooking occurs, all tents used must be fire/flame rated certified. Likewise with any tarps or other coverings used where cooking occurs. Fuel (gas containers) for generators must be stored apart/away from the generator and secured. As generators are used, exhaust fumes created must be directed away from personnel cooking under tents, patrons at the event and individuals surrounding the event. All electrical cords must be secured and cable ramps used where necessary. Entrances and exits must be clearly marked at all times and kept free from obstructions. 9. Upon expiration or termination of the Temporary Use Permit (TUP), the Operator/Applicant is required to restore the vacant land or unoccupied surface lot(s) to its original condition. This includes the removal of all structures, materials, and elements associated with the temporary use, ensuring that the site is left in a vacant and cleanliness condition. Applicant shall utilize the waste collection services of a franchisee authorized to perform such services by the City of Miami Commission. It shall be the responsibility of the applicant to properly dispose of all waste generated with containers to house all the garbage and have a sufficient number of scheduled collections by the authorized franchisee. Chapter 22-2; Section 2 (B) of the Miami City Code Applicant must maintain its premises free of debris and litter. Applicant to comply with the recycling requirements as per Chapter 22; Section 20 & 21 of the Miami City Code. Applicant is responsible for maintaining the right of way (curb, gutter, and swale) free of litter or trash, including and not limited to all adjacent street(s) to private premises at all times as per Chapter 22; Section 22-5 of the City of Miami Code. Miami Police Department Approved with the condition that the applicant follows all of the City's noise policies, and that all city code is adhered to. 13. A copy of this Permit shall be displayed in the office or some other conspicuous place on the premises and shall be displayed to the general public or any Police Department personnel, Code Enforcement Inspector, or other official of the City upon request during normal business hours. 14. Any signs or banners shall be under separate permit. 15. This Permit may be modified at any time at the sole discretion of the City. 16.
