Purpose of Item:
To further extend a temporary use on vacant land permit beyond the three (3) year
maximum, pursuant to Section 62-535(a) of the City of Miami Code of Ordinances, for
the property located at 220 NW 27 Street, 2600 NW 2 Avenue, 2612 NW 2 Avenue and
2630 NW 2 Avenue.
Background of Item:
Nishiki Market, LLC (the "Applicant") doing business as "Smorgasburg Miami" requests
to extend the current Temporary Use Permit on Vacant Land with the following uses:
Temporary Open -Air Retail and Food Service Establishment, for one (1) additional year
ending on October 09th, 2026.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
FURTHER EXTENDING A TEMPORARY USE ON VACANT LAND BEYOND THE
THREE-YEAR MAXIMUM, PURSUANT TO SECTION 62-535(A) OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "TEMPORARY USES ON
VACANT LAND," FOR THE PROPERTY LOCATED AT APPROXIMATELY 220
NORTHWEST 27 STREET, 2600 NORTHWEST 2 AVENUE, 2612 NORTHWEST 2
AVENUE, AND 2630 NORTHWEST 2 AVENUE, MIAMI, FLORIDA, WITH
RESPECTIVE FOLIO NOS. 01-3125-032-0030, 01-3125-032-0130, 01-3125-032-0020,
AND 01-3125-032-0010 FOR NISHIKI MARKET LLC, DOING BUSINESS AS
SMORGASBURG MIAMI.
WHEREAS, Nishiki Market LLC ("Applicant"), doing business as "Smorgasburg Miami,"
wishes to extend their current Temporary Use Permit ("TUP") on Vacant Land for an additional
one (1) year at 220 Northwest 27 Street, 2600 Northwest 2 Avenue, 2612 Northwest 2 Avenue,
and 2630 Northwest 2 Avenue, with respective Folios Nos. 01-3125-032-0030, 01-3125-032-
0130, 01-3125-032-0020, and 01-3125-032-0010 (collectively, "Property") through October 9,
2026, as more particularly described in the application, attached and incorporated as Exhibit
"A"; and
WHEREAS pursuant to Section 62-535(a) of the Code of the City of Miami, Florida, as
amended ("City Code"), temporary uses on vacant land shall have a limited duration of one (1)
year and can be extended annually administratively by the Zoning Administrator for a maximum
of three (3) years; and
WHEREAS, pursuant to Section 62-535(a) of the City Code, temporary uses on vacant
land may be further extended beyond the three-year maximum by the City Commission; and
WHEREAS, on March 1, 2022, the Office of Zoning approved the TUP under PZ-21-
11708, which was valid for a period of one (1) year from the date of issuance of the Temporary
Certificate of Use ("TCU"); and
WHEREAS, a TCU was issued on March 4, 2022 for the approved TUP at the Property
under PZ-21-11708; and
WHEREAS, the Property was approved to be temporarily used and occupied as the
"Smorgasburg Wynwood" ("Venue"), with the following approved use(s): Temporary Open -Air
retail and food service establishment; and
WHEREAS, the hours of operation under this TUP were established to be limited to
Saturdays and Sundays from 11:00 a.m. to 6:00 p.m. and Fridays from 11:00 a.m. to 8:00 p.m.;
and the maximum occupancy load of the Venue was set at 300 occupants at any given time,
including both employees and guests, with any event expected to exceed this limit being
prohibited; and
WHEREAS, a modification was approved under PZ-22-13215 solely to allow Krus
Kitchen, a vendor of the permittee, to serve beer, wine, and cocktails, with all conditions detailed
on the approved PZ-21-11708; and
WHEREAS, on March 4, 2023, the TUP on vacant land originally permitted under PZ-21-
11708, and subsequently amended under PZ-22-13215, was provided a first-time extension for
a one-year period; and
WHEREAS, on March 27, 2025, the last one-year extension of the approved TUP on the
vacant Property was approved under PZ-23-16384 until September 30, 2025; and
WHEREAS, on September 30, 2025, an extension of time was granted until October 9th,
2025, for the extension to be placed on the agenda of the City Commission; and
WHEREAS, the Venue has served as an incubator for local food vendors who may not
have the means to open a traditional brick and mortar location; through the event, these
vendors are provided with exposure and opportunities for growth that fast track them to brick
and mortar food and beverage businesses; and
WHEREAS, the Venue is a vibrant food festival that brings together 50+ up-and-coming
food businesses every weekend in the heart of Wynwood and in the three (3) years,
Smorgasburg Miami has become an iconic part of the culinary story of Miami and a touchstone
of the local community; and
WHEREAS, vacant lots often pose challenges for cities, becoming eyesores,
contributing to blight, or failing to deliver any return in terms of public benefit or economic
activity, and by activating these spaces, the Venue turns them into high -traffic, safe, and family -
friendly environments that foster civic engagement and strengthen the area's appeal as a
destination; and
WHEREAS, the Venue stimulates economic growth through job creation and the
vendors employ hundreds of people each year, from chefs and cooks to servers, managers, and
delivery drivers, that are mostly filled by local residents, ensuring that wages stay within the
community and support household stability; and
WHEREAS, tourism is another key driver and each weekend, the event attracts nearly
8,000 visitors, including a significant share of out-of-town guests who spend money not only at
the market but also at nearby businesses like cafes, bars, shops, and hotels and that spillover
effect amplifies the positive economic footprint of the Venue well beyond its own footprint in
Wynwood; and
WHEREAS, in the three (3) years of continuous weekend operations, the Venue has
operated with no concerns expressed by the public or neighboring businesses; and
WHEREAS, notwithstanding the issuance of this extension of time for the TUP pursuant
to Section 62-535(a) of the City Code, all noise must comply with Chapter 36 of the City Code;
and
WHEREAS, three (3) or more violations issued at the Property related to noise or any
other section of the City Code shall effectuate a rescission of this approval, and this extension of
time shall be deemed void;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission further extends a Temporary Use Permit on vacant land
beyond the three-year maximum, pursuant to Section 62-535(a) of the City Code, titled
"Temporary uses on vacant land," for the property located at approximately 220 Northwest 27
Street, 2600 Northwest 2 Avenue, 2612 Northwest 2 Avenue, and 2630 Northwest 2 Avenue,
Miami, Florida, with respective Folio Nos. 01-3125-032-0030, 01-3125-032-0130, 01-3125-032-
0020, and 01-3125-032-0010 for Nishiki Market, LLC, doing business as "Smorgasburg Miami,"
provided that:
1) The hours of operation under this TUP are limited to Saturdays and Sundays
from 11:00 a.m. to 6:00 p.m. and Fridays from 11:00 a.m. to 8:00 p.m.; and
2) The maximum occupancy load of the Venue is 300 occupants at any given time,
including both employees and guests, with any event expected to exceed this
limit being prohibited.
3) Fire Department: Where cooking occurs, all tents used must be fire/flame rated
certified. Likewise with any tarps or other coverings used where cooking occurs;
Fuel (gas containers) for generators must be stored apart/away from the
generator and secured. As generators are used, exhaust fumes created must be
directed away from personnel cooking under tents, patrons at the event and
individuals surrounding the event/Venue; All electrical cords must be secured
and cable ramps used where necessary; Entrances and exits must be clearly
marked at all times and kept free from obstructions.
Section 3. This Resolution shall become effective immediately upon its adoption.
