WHEREAS, currently the City of Miami ("City") suffers from a lack of affordable and
workforce housing which has led to an increase of multi -generational occupancy of residences;
and
WHEREAS, the rise in multi -generational occupancy at a residence, leads to an
increase in vehicular ownership that necessitates parking those vehicles; and
WHEREAS, the City requires parking accommodations thru its Zoning Ordinance
("Miami 21 Code") for all properties and developments but it does not make a distinction for
homestead exempt properties nor the residents of a homesteaded property; and
WHEREAS, this contemplated provision will not change any of the parking requirements,
regulations or number of parking spaces required pursuant to the Miami 21 Code — it only
facilitates a resident of a homestead exempt property to increase its parking availability under
certain circumstances; and
WHEREAS, the Planning, Zoning, and Appeals Board ("PZAB") at its meeting on July
16, 2025, following an advertised hearing, adopted Resolution No. 25-044, making a motion
recommending approval, which failed by a vote of 3-4, with a recommendation for one vehicle
only on the grass, transmitting the recommendation of this item to the City Commission; and
WHEREAS, due to the number of property owners who can avail themselves of this
relief, it is believed to be in the best interest of our community and community stakeholders that
additional parking be allowed for a homestead exempt property;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
