AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AMENDING CHAPTER 18/ARTICLE IV OF THE CODE OF THE CITY OF
MIAMI, AS AMENDED ("CITY CODE"), TITLED "FINANCE/GRANTS," MORE
SPECIFICALLY BY AMENDING SECTION18-139, TITLED "ANTI -POVERTY
INITIATIVE - ESTABLISHED," TO EXPAND THE ELIGIBLE USE OF ANTI-
POVERTY INITIATIVE ("API") FUNDS BY CITY OF MIAMI ("CITY")
DEPARTMENTS; FURTHER ENSURING THAT SAID AMENDMENT IS
INCORPORATED INTO ALL API APPLICATIONS AND FUNDING REQUEST
FORMS GOING FORWARD; CONTAINING A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE.

WHEREAS, in 2014, the City of Miami ("City") established the Anti -Poverty Initiative
("API"), wherein each District may allocate poverty initiative funds to certain organizations which
meet the mission of reducing poverty and improving the quality of life of City residents; and
WHEREAS, the API encompasses the five (5) City Districts being allocated funds
proportionate to the percentage of poverty levels in said district, based upon the five (5) year
poverty rate determined by the American Community Survey, as established annually; and
WHEREAS, pursuant to Resolution No. 19-0202, adopted on May 23, 2019, the City
Commission approved API Guidelines, funding request form, and template agreement to ensure
the proper utilization of API funding; and
WHEREAS, since 2014, the API has aided many local organizations with addressing
poverty through a strategy focusing the provision of support through the goal of having City
residents achieve self-sufficiency; and
WHEREAS, on January 12, 2023, the City Commission adopted Ordinance No. 14131,
which codified the establishment of API and the specific requirements through which the funds
may be allocated; and
WHEREAS, now the City has determined that affordable housing and park initiatives as
an eligible use of API funds is necessary to continue the long-lasting achievements of the
initiative and is in the best interest of its residents; and
WHEREAS, the API Guidelines and funding request form, attached and incorporated as
composite Exhibit "A" has been updated to reflect the additional eligible use of API funds;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 18/Article IV of the Code of the City of Miami, Florida, as amended,
is hereby amended in the following particulars:1
"CHAPTER 18
FINANCE
ARTICLE IV. GRANTS
Sec. 18-139. — Anti -poverty initiative —Established.
The Anti -Poverty Initiative ("API") is hereby established to reduce poverty within Miami
communities and funding shall be utilized to meet the needs of at-risk/poverty-stricken
residents. The API shall address poverty based on a strategy of focusing the provision of
support towards the city's residents achieving self-sufficiency.
API encompasses the five city districts being allocated funds proportionate to the percentage of
poverty levels in said district, based upon the five-year poverty rate determined by the American
Community Survey, as established annually.
(1) Funding. API Funding is to be allocated and utilized per the API Program Guidelines,
which may be amended from time -to -time, by Resolution adopted by the City
Commission.
Any disbursement of API funds in excess of $50,000.00 in any single city fiscal year
to any single entity or organization shall require approval by resolution of the City
Commission by a four -fifths affirmative vote.
(2) Eligibility of entities. The following criteria shall be utilized when determining the
eligibility of entities and organizations which may receive API funds:
Any eligible entity or organization who engages primarily in the following activities
shall be eligible to receive and expend API funds:
Educational programs for children, youth, and adults;
Crime prevention programs;
Elderly meals, transportation, recreational and health/wellness related activities;
At -risk youth or summer job programs;
Transportation services and programs;
Job development, retentions, and training programs;
Homeless services;

- Food distribution;
- Essential supplies during a state of emergency, natural disaster, economic crisis,
or pandemic;
Any programs deemed by the City to have a focus on promoting social, emotional,
and academic success of impoverished residents of the City.
(3) API funds may be allocated to a City Department for the purpose of affordable
housing or park initiatives, including the purchase of land by the City for said
initiatives, and for the aforementioned eligible activities.
Any entity or organization considered for or selected to receive API funds must complete a
funding request form, and funding agreement, and a close out report.
Any entity or organization considered for or selected to receive API funds must comply with any
and all local, state and federal laws, rules, regulations, or guidelines associated with the
programs funded, and such allocations may be revoked at the sole discretion of the City.

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately after final reading and
adoption thereof.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
