RESOLUTION NO. 3017.
A RESOLUTION AUTHORIZING THE CITY MANAGER OF THE CITY
OF MIAMI TO EXECUTE A PERMIT BY AND ON BEHALF OF THE
CITY OF MIAMI TO THE SEABOARD ALL FLORIDA RAILWAY. A
FLORIDA CORPORATION, TO CONSTRUCT, OPERATE AND MAINTAIN A
LINE OF STANDARD GAUGE RAILWAY AND OPERATE TRAINS THEREON
IN, UPON, ACROSS AND ALONG NORTHWEST TWENTY-SECOND STREET
FROM A POINT 150' MORE OR LESS EAST FROM THE EAST LINE OF
NORTHWEST TENTH AVENUE ACROSS NORTHWEST TENTH AVENUE TO A
POINT 160' MORE OR LESS EST FROM THE WEST LINE OF NORTH-
WEST TENTH AVENUE; ALSO A LINE OR LINES OF STANDARD GAUGE
RAILWAY AND OPERATE TRAINS THEREON IN, UPON, ALONG AND A-
CROSS LEE STREET FROi;i A POINT 170' MORE OR LESS EAST FROM
THE EAST LINE OF NORTHWEST ELEVENTH AVENUE ACROSS NORTHWEST
ELEVENTH AVENUE TO A POINT 60' MORE OR LESS EAST FROM THE
EAST LINE OF NORTHWEST TWELFTH AVENUE; ALSO IN, UPON AND
ACROSS NORTHWEST ELEVENTH AVENUE IN A CURVE OR AT RIGHT
ANGLES THERETO BETWEEN EEN THE SOUTH LINE OF LEE STREET AND A
POIN1T 90.13' SOUTH THEREOF, ALL UPON THE CERTAIN CONDITIONS
AND LIMITATIONS HEREINAFTER SET FORTH Ii1 THIS RESOLUTION.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI:
Section 1. That the City Manager of the City of Miami be and
he is hereby authorized and instructed to issue a permit granting
and giving, insofar as it is within the power of the city of Miami,
to the Seaboard All Florida Railway, a Florida Corporation, permis-
sion to construct, operate and maintain a line of standard gauge
railway and operate trains thereon in, upon, across and along North-
west Twenty -Second Street from a point 150' more or less East from
the East line of Northwest Tenth Avenue across Northwest Tenth Ave-
nue to a point 160' more or lass ';lest from the West line of North-
west Tenth Avenue; also a line or lines of standard gauge railway
and operate trains thereon in, upon, along and across Lee Street
from a point 170' more or less East from the East line of Northwest
Eleventh iorenue across Northwest Eleventh .v nue to a point 60'
more or less 'East from the East line of Northwest iwolfth Avenue;
also in, upo_I and across Northwest Eleventh Avenue in a curve or at
right angles

section 2.
That the bond of 0.00,000.u0 heretofore required of
t-2e Seaboard All Florida Railway, under Resolution No. 2780, passed
June 21st, 1926, and under resolution
1926, for the purpose of indemnifying and
2927, passed August 30th,

of Miami from all olaims, debts and judgments of any person, per-
sons or corporations, ocoasioned by or arising out of the granting
of said permits, or ocoasioned by ar arising out of any injury
sustained by any person or persons through the negligenoe of the
said Seaboard All Florida Railway in the oonstruotion of its said
lines of railway and the operation of its trains on the streets
described in said resolution, shall be amended so as to protect
and indemnify the Oity of Miami in the same manner under the per-
mits allowed by this resolution now being passed.
Seotion 3. That the permit authorized by this resolution
shall be null and void after two years from the date hereof in the
event said Seaboard All Florida Railway should not complete the
construction of said line or lines of standard gauge railway upon
the land hereinabove described, prior to that date.
