RESOLUTION NO. 2948.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO =BUu'tS,
FOR AND ON BEHALF OF THE CITY OF MIAMI, LEASE WITH
A. LOUIS AND GISWT•T1A LOUIS, HIS WIFE, FOR CERTAIN
PROPERTY DESCRIBED IN SAID LASE TO BE USED FOR BOOSTER
PUMP HOUSE.
BE IT RESOLVED BY THE COMMISSION OF Alb CITY OF MIAMI:
That the City Manager be, and he is hereby, authorized and
empowered to execute, for and on behalf of the City of Miami,
Florida, a lease with A. Louis and Gimella Louis, his wife, for
certain property described in suoh lease to bensed for booster
pump house looated at NM. 36th Street and 26th Avenue, said
lease being in the following form, to -wit:
THIS LEASE, Made this 3rd day of September, 1926, be-
tween A. LOUIS & WIFE, GISELLA LOUIS, of the one part,
herein called the Lessors, and THE CITY OF MIAMI, of the
other part, herein called the Lessee.
WITNESSETH: That the said lessors do hereby lease
and let unto the said lessee the following described proper-
ty, to -wit:
Seotion 22, Township 53, Range 41 East, S.E. 4 of S.W.
of SWji beginning at a point of 35 feet North and 114.1 feet
East of the S.W. corner of above described property, then
East 50 feet, thenoe North 100 feet, then West 50 feet, then
South 100 feet to point of beginning the above described
property lying and being in the City of Miami, Dade County,
Florida.
It is agreed by and between the parties th4,.t the City
of Liiami shall have the right and privilege of erecting a
Pump or Pumps, laying of Pipe and construction of Pump House,
nd the right and privilege of removing same at the expire -
ion of this lease.
TO HAVE AND TO HOLD the said premises unto the said lessee
rom the day of September, 1926, for the term of six (6)
onths, then next ensuing, for the use and occupancy aforesaid;
e said lessee yielding and paying for the same unto the s id

lessors the rent payable as follows: One hundred (3100.00)
dollars reoeipt of which is hereby acknowledged end remain-
ing sum at rate of One Hundred (3100.00) dollars per month,
payable the first of each and every month.
And the said lessee oovenante and agrees as follows:
1. That it will not, without previous lioense in writitg
or the lessors assign, underlet or part with the possession
of said premises of any part thereof.
2. That it will not do or suffer to be done in or upon
said premises any aot or thing which shall or may be a nuisance,
annoyance, inoonvenienoe or damage to the lessors or tenants,
or to the occupants of adjoining premises, or to the neighbor-
hood.
3. That it will not do or suffer any aot or thing to be
done that will increase the rate of insurance on said premises.
4. That it will permit the said lessors heirs or assigns,
or agents, to enter at all reasonable times to view the state
and condition of the said premises.
5. In the event of the non-payment of any moneys due
under the terms of this lease promptly when due, or in the e-
vent of the failure by the said lessee to perform each or any
of the covenants or agreements contained in this instrument by
the said lessee to be kept and performed, then the said lessors
may at his option, with or without notice, consider the said
lessee as a tenant at will, and may immediately, and forcibly
if ne oessar y, re-enter upon and re -possess the said premises
without any let or hindrauoe of or from the said lessee,
and the said term hereby created shall, at the option of the
said lessors, with or without notice, terminate.
6. At the expiration of this lease, whether at the end of the
full term hereby created or any soon termination thereof here-
under, the said premises are to be yielded and given up by the
said lessee in as good order and condition in all respects as
they now are, damage by fire or act of mod alone excepted.

7. All the rights and ooligations created by this
instrument shall be binding upon the heirs, exeoutore, ad-
ministrators and assigns of the parties hereto respectively.
IN WITNEESS +HEREOF, The parties hereto have hereunto
set their bands and Seale, the day and year first above
written.
