A RESOLUTION AUTHORIZING THE CITY MANAGER OF THE CITY OF MIAMI
TO EXECUTE A PERMIT BY AID OF BEHALF OF THE CITY OF MIAMI TO THE
SEABOARD Mr, FLORIDA RAILWAY, A FLORIDA CORPORATION, TO CONSTRUCT,
OPERATE AND MAINTAIN A LINE OR LINES OF STANDARD GAUGE RAILWAY AND
OPERATE PASSENGER t AND FREIGHT TRAINS THEREON, IN, UPON AND ACROSS
THAT PORTION OF GUION COURT LYING NORTH. OF THE NORTH LINE OF NORTH-
WEST TWENTY-SECOND STREET AND RUNNING IN A NORTHERLY DIRECTION 142.8'
MORE OR LESS; ALSO THAT PORTION OF NORTHWEST EIGHTH Anhui LYING
NORTH OF THE NORTH LINE OF NORTHWEST TWENTY-SECOND STREET AND RUNNING
IN A NORTHERLY NINNININNI DIRECTION 142.8' MORE OR LESS; ALSO THAT POR-
TION OF DARGAN COURT LYING NORTH OF THE NORTH LINE OF NORTHWEST 2wLb'i!-
SECOND STREET AND RUNNING IN A NORTHERLY DIRECTION 142.81 MORE OR LESS,
SAID PORTIONS OF GUION COURT AND NORTHWEST EIGHTH AVENUE AND DARGAN
COURT ALL BEING LOCATED IN THAT Sui3DIVISION OF MIAMI, DADE COUNTY,
FLORIDA, KNOWN AS BO w+PARK, ACCORDING TO AN AMENDED PLAT THEREOF
RECORDED IN PLAT BOOK 6, PAGE 171, IN THE OFFICE OF THE CLERK OF THE
CIRCUIT COURT, DADE COUNTY, FLORIDA; ALSO AUTHORIZING SAID SEABOARD
ALL FLORIDA RAILWAY TO CONSTRUCT, MAIITAIN AND OPERATE ANY PART OF
ITS DEPOT OR SHEDS CONNECTED THEREWITH IN, UPON AND ACROSS SAID COURTS

Section 1. That the City I.;ana,er of the City of Miami be and he
is hereby authorised and instructed to issue a 2errnit granting and giv-
inr , in so far as it is within the porter of the City of I.'iami, to the
seaboard. All Florida Railway,
a Florida corporation, permission to con-

or less; also that portion of Northwest Eighth Avenue lying north of
the north line of Northwest Twenty-second Street and running in a north-
erly direction 142.8', more or less; also that portion of Dargan Court

running in a northerly direction 142.61 more or 1e, said portions
of Guion Court and Northwest Eighth Avenue and Dargan Court all being
located in that subdivision of Miami, Dade County, Florida, known as
Bohemia Park, according to an amended plat thereof recorded in plat
Book 6, page 171, in the office of the Clerk of the Circuit Court,
Dade County, FI0Athr'ilso authorizing said Seaboard. All Florida Rail-
way to construct, maintain and operate any part of its depot or sheds
connected therewith, in, upon and across said. Courts and. Avenue above
described. Also to construct, operate and maintain a line or lines
of standard gauge railway and. operate passenger and freight trains
thereon, in, upon and across that portion of Northwest Tenth Avenue
lying between the north line of Northwest Twenty-second. Street and
a point 142.81 north thereof. That the City Manager of the City of
Yiami be and he is hereby authorized and instructed to issue a permit
granting and giving, in so far as it is within the power of the City
of Miami, to the Seaboard. All Florida Railway, a Florida corporation,
permission to construct, operate and maintain a line or lines of
standard gauge railway and operate freight and passenger trains there-
on, in, upon, across and along the north 201 of Northwest Twenty-second
Street, extending from the east line of Northw
point 125' more or less, vest of the vest line
Avenue, and also upon and across the south 30'
second. Street from a point 250', more or less,

the vest line of Northwest Seventh Avenue ,nd also diagonally and/or
in a curve across that portion of rorthwest Seventh Avenue lying be-

All of said land is within the City of Miami, Dade Bounty, Florida,
and this permit is given with the express understanding that such
permit shall not cover any right or privilege that the City of Miami
is not supposed to give or grant.

Section 2. That the bond of $100,000.00 heretofore required
of the Seaboard All Florida Railway, under Resolution No. 2780 passed
June 21st, 1926, for the purpose of indemnifying and holding harmless
the City of Ifiami from all claims, debts and judgments of any person,
persons or corporations, occasioned by or arising out of the granting
of said permits, or occasioned by or arising out of any injury sus-
tained by any person or persons through the negligenoeof the said
Seaboard All Florida Railway in the oonstruction of its said lines of
railway and the operation of its trains on the streets described in
said resolution, shall be aminded so as'to proteot and indemnify the
City of Miami in the same manner under the permits allowed by this
resolution now being passed.
Seotibn 3. That the permit authorized by this resolution shall
be null and void after two years from the date hereof in the event
said Seaboard All Florida Railway should not complete the construc-
tion of said line or lines of standard gauge railway upon the land
hereinabove described, prior to that date.
