Section 4. That before granting of the permit to construct,
oierate and maintain said line of standard gauge railway in, upon and
across the streets, avenues and thoroughfares hereinbefore set forth,
and as a condition precedent thereto, the Seaboard All Florida Railway
shall enter into and file with the City Manager a good and sufficient
surety bond, to be approved by the City Attorney, in the sum of One
Hundred Thousand (0_00,000.00) Dollars, payable to the City of Miami,
a I.!.inieipal Corporation, to indemnify, save and hold harmless the said
City of Miami from all claims, debts and judgments of any person, per-
sons or corporations occasioned by or arising out of the granting of
said permit or occasioned by or arising, out of any injury sustained by
any person or persons through the negligence of the said Seaboard All
Florida Railway in the construction of its said railway or in the
operat_on of its trains on the streets included in said permit.
Section 3. That the permit authorized by this Resolution
shall be null and void after two (2) years from the date thereof in
the event the said Seaboard All Florida Railway should not complete
the construction of said line of standard gauge railway track upon the
avenues, streets and thoroughfares hereinabeve set forth prior to that
date.
