ON BEHALF OF TEE CITY OF W(AuT TO THE SEABOARD ALT, FLORIDA RAILWAY, A FLORIDA CORPORATION, TO LAY A SINGLE TRACK OF STANDARD GAUGE RAILWAY ACROSS WEST FLAGLER STREET IN AND UPON THAT CERTAIN STREET KNOWN AS FLA(3LER PLACE, FROM THE NORTH SIDE OF WEST FLAGLER STREET TO THE CENTER LINE OF THAT CERTAIN STREET KNOWN AS TAMIAMI TRAIL, WHICH STREETS ARE MORE CT.RARLY SHOWN AND SET OUT UPON THE RESPECTIVE PLATS OF THS TA- MIAMI TRAIL BUSINESS SECTION, BEING THAT SUBDiViSI0N KNOWN AS THE EAST 1/2 OF THE S OF THE SWW AND THE WEST 1/2 OF THE SW' OF THE sari OF SECTION 2, TOWNSHIP 54$OUTH, RANGE 40 EAST, AND ALSO THAT CERTAIN SUBDIVISION,KNOWN AS FLAGAMI FIRST ADDITION, A SUBDIVISION OF THE WEST 1/2 OF THE NVW* OF THE SE4 OF SECTION 2, TOWNSHIP 54 SOUTH, RANGE 40 EAST, ALL UPON CERTAIN CONDITIONS AND LIMITA- TIONS HEREINAFTER SET FORTH IN THIS RESOLUTION. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MTAMT Section 1. That the City Manager of the City of Miami be, and he is hereby, authorized to issue a permit granting and giving, insofar as it is within the power of the City of Miami., to the Sea- board all Florida Railway, a Florida corporation, permission to construct a single line of standard gauge railway track over and upon Flagler Place, and across West Flagler Street from the center line of Tamiami Trail, as more clearly shows upon the plat of the Tamiami Trail Business Section, a subdivision of the East 4 of the Srr4 of the SW4, and the West z of the SW of the SE4 of Section 2, Township 54 South, Range 40 East; thence northward on Flagler Place through Tamiami Business Section continuing northward through Flagami, a subdivision of the !lest z of the N1.6 of the SEi of Section 2, Town- ship 54 South, Range 40 East; thence continuing northward across West r'lagler Street to the north line of said Flagler Street, all of which is within the City of Miami, in Dade County, Florida, with the ex- press understanding that such permit shall not cover any right or privilege that the City of Miami is not supposed to give or grant. :section 2. That before granting of the permit to lay said single line of standard gauge railway upon the street hereinbefore set forth, and as condition precedent thereto, the ,Seaboard All 'lorida Railway- �, ,:.. OF ,2L t/ IT to and file with the City I.ianager a good and At kcrir,n�� sufficient surety bond to be•approved by the ©ity Attorney in the sum of $100,000. payable to the (pity of Miami, a muni- cipal corporation, to indemnify, save and hold harmless the said dity of Miami from all claims, debts, and judgments of any person, persons or corporation ocoasioned by or arising out of the granting of this permit for.the oonetruotion of the said railway of the deaboard All Florida Railway. Section 3. That the permit authorized by this resolu- tion shall be null and void after December 7th, 1927, in the event the said Seaboard All Florida Railway shbuld not oomplete the construction of said single line of standard gauge railway track upon the street hereinabove set forth prior to that date.
