MINUTTES OF ADJOURNED MEETING OF THE BOARD OF COMMISSIONERS (' TIE CITY OF LIiiMI, FLORIDA.
0n this 29th day of April, 1926, the Commission of the City of Miami, Florida, met at
the City Hall in said City pursuant to an adjournment taken April 26th. The meeting
was called to order at 5:00 o'olook P. M. by Chairman E. C. Rornfh, and on roll call
the following members of the Commission were present:

ABSENT: J. H. Gilman,
J. T. Wilson.
EXECUTION OF CONTRACT WITH HIGHWAY CONSTRUCTION COMPANY AUTHORIZED
The City Attorney submitted the proposed contracts between the City and the Highway
ConatruotIon Company for street paving work, said contraot being designated Contract
Pv-69 to Pv-75, inclusive, and stated that upon examination the form of contract met
with his approval. Whereupon a resolution authorizing the City Manager to execute
said contracts was introduoed by Mr. Lummus, who moved its adoption:
RESOLUTION NO. 2658.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE, FOR AND ON BEHALF OF THE CITY OF MIAMI,
THE CONTRACTS WITH THE HIGHWAY CONSTRUCTION COM-
PANY FOR STREET PAVING WORK.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI:
That the City Manager is hereby authorized and directed to execute,
for and on behalf of the City of Miami, the contracts with the Highway
Construction Company for street paving work designated Contracts Pv-69
to Pv-75, inclusive.
Upon being seconded by Mr. Leffler, the said resolution was passed and adopted by tes
following vote - AYES: Messrs. Romfh, Lummus, Leffler. NOES: None.,
PAYMENT OF AWARDS IN CONDELINAT'ION SUITS
The City Attcrney reported that awards have been made in three condemnation suits in-
stituted by the City for the opening and widening of N.E. 3rd Avenue. It appearing
necessary to pay the awards within ten days from the date of the verdict by the Jury„
and the City not having funds for the purpose at this time, a resolution authorizing
the City Manager to execute oertain Certificates of Indebtedness in favor of Third
Avenue Company, pursuant to an agreement between the City and that Company whereby
the Company is to advance a loan to the City of money necessary for opening N.E. 3rd
Avenue until such time as the City shall sell bonds for the purpose, was introduoed
by Mr. Leffler, who moved its adoption:

A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE FOR AND ON BEHALF OF THE CITY OF MIAMI
THREE (0) CERTIFICATES OF INDEBTEDINESS HEREIN-'
AFTER DESCRIBrED AND SET FORTH IN FAVOR OF THE
N.E. 3RD AVENUE COMPANY.
WHEREAS, the City Attorney has reported that in the condemnation
proceedings instituted by the City for the opening and widening of
N.E. 3rd Avenue that an award of $25,000.00 has been made in the case
of City of Miami vs. Agnew Welsh and Cora E. Welsh, his wife, an award
of ,$51,750.00 in the case of City of Miami vs. Elizabeth Cushman and
A.J. Cushman, 'aer husband and an award of 491,500.00 in the case of
City of Miami vs. Elizabeth G. Dorn, and
WHEREAS, under the agreement with the N.E. 3rd Avenue Company, the
said Company is to advance to the City of Miami the cash necessary to
pay the oondemnation awards made in the opening and widening of N. E.
3rd Avenue, which said advances are to be repaid at such time and under
suoh rates and terms and conditions as set forth in said agreement dated
April 12th, 1926,
NOW, THEREFORE, BE IT RESOLVED BY THE COId:1ISS10N OF T'!i:' CITY OF

That the City

The City of Miami, Florida, hereby acknowledges it
is indebted to Third Avenue Company, a corporation cre-
ated and existing under the laws of the State of Florida,
in the sum of Twenty-five Thousand 025,000.00) Dollars,
this day advanced in oash by said conpany to said city
in accordanoe with the terms of a contract between said
Company and said city dated April 12th, 1926, copy of
which said contract is hereto attached.
Said sum of e25,000.00 is to be used by said City for
the purposes set out in paragraphs four and fide of said
contract; and said City of Miami hereby p:emiawn and binds
itself to pay said sum of 25,00O.00 to said Third avenue
Company, with interest thereon from this date until paid,
Aril 29th, 1926.

time of payment of principal, mate and terms of
payment of interest, one all conditions under whieh
this indebtedness has arisen, and is to be dis-
charged, being fully set out in eiid contract,
which is made a part hereof.
In testimony whereof said City of ; &rni., by
proper resolution of its Commission, has caused
its name to be signed hereto by P. H. 'Thfrton its
City Manager, this 29th day of April., 1926.

State of Florida, in the sure of Fifty -ono Thousand
Seven Hundred Fifty (:;51,75O.O0) Dollars, this day
advanced in oueh by said company to said city in
accordance with the terms of a contract between said
company and said city doted April l2th, 1926, copy
of which said contract is hereto attached.
Said sum of $51,750.00 in to be used by said city
for the purposes set out in paragraphs Pour and five
of said contract; and said City of Miami hereby promi-
ses and binds itself to pay said sure of ;1;51,75O.00
to said Third Avenue Company, with interest thereon
from this date until paid, in accordance with the
terms of said contract; time of payment of principal,
rate and terms of payment of interest, and all condi-
tions under which this indebtedness has arisen, and
is to be discharged, being fully set out in said con-
tract, whioh is made a part hereof.
In testimony whereof said City of ;Miami, by proper
resolution of its Commission, has caused its name to
be signed hereto by F. H. Wharton its City Manager,
this 29th day of April, 1926.

of Florida, in the sum of Ninety-one Thousand Five
Hundred ($91,500.00) Dollars, this day advanced in
dash by said oompany to said city in accordance with
the terms of a contract between said company and
said city dated April 12th, 1926, copy of which said
oontraot is hereto attached.
Said sum of 91,500.00 is to be used by said city
for the purposes set out in paragraphs four and five
of said oontraot; and said City of liiarni hereby
promises and binds itself to pay said sure of $91,500.
to said Third Avenue Company, with interest thereon
from this date until paid, in accordance with the
terms of said contract; time of payment of principal,
rate and terms of payment of interest, and all condi-
tions under which this indebtedness ,has arisen, and
is to be discharged, being fully eat out in said con-
tract, Which is made €a part hereof.

resolution of its Commission, has caused its name to
