("AGREEMENT"), THAT CREATED AND ESTABLISHED THE HEART OF OUR PARKS ENDOWMENT FUND PURSUANT TO RESOLUTION NO. R-04-0737 ADOPTED ON NOVEMBER 18, 2004, TO ALIGN WITH CURRENT BEST PRACTICES, EXPAND ELIGIBLE USES, AND SIMPLIFY THE PROCESS TO ACCEPT PUBLIC DONATIONS AND DRAW DOWN ON FUNDS; FURTHER DIRECTING THE CITY MANAGER, OR DESIGNEE, TO PROVIDE THE CITY COMMISSION WITH A REPORT ON THE PROCESS AND STATUS OF AMENDING THE AGREEMENT AT THE SEPTEMBER 25, 2025 REGULAR CITY COMMISSION MEETING. SPONSOR(S): Commissioner Ralph "Rafael" Rosado WHEREAS, on November 18, 2004, pursuant to Resolution No. R-04-0737, the City Commission authorized the City Manager to execute an Agreement to Establish an Endowment Fund ("Agreement"), with the Miami Foundation, Inc., a Florida not for profit corporation (formerly known as the Dade Community Foundation, Inc.), to establish an endowment fund for the donation of funds for a Heart of Our Parks Endowment Fund to benefit charitable programs, activities and services for the City's parks, under the terms and conditions set forth in the Agreement ("Endowment Fund"); and WHEREAS, the City finds that the Endowment Fund as established is not serving its purpose or the public at its full potential; and WHEREAS, the City finds that it would be in the best interests of the City and its residents to update the structure of the Endowment Fund to align it with current best practices and expand allowable uses of the funds in addition to parks, such as affordable housing, services or programs for low-income individuals and families; services and programs for senior citizens; and after -school programs; and WHEREAS, the City wishes to amend the Endowment Fund's structures and requirements to simplify the process for the public to donate to the Endowment Fund and for the City to draw down on the funds for eligible uses; and WHEREAS, the City believes that it is in the best interests of the City, residents, visitors, and potential donors to establish clear funding levels and goals depending on the type of capital or physical improvements, or services the donor wishes to contribute funds towards; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 18111 (Revision:) Printed On: 9/30/2025 File ID: 18111 Enactment Number: R-25-0357 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission hereby directs the City Manager, or designee, to initiate the process of updating and amending the Agreement for the Endowment Fund to align with current best practices, expand eligible uses, and simplify the process to accept public donations and draw down on funds. Section 3. The Miami City Commission hereby further directs the City Manager, or Designee, to provide the City Commission with a report on the process and status of amending the Agreement at its September 25, 2025 Regular City Commission meeting. Section 3. This Resolution shall become effective immediately upon its adoption.
