HomeMy WebLinkAboutR-25-0344City of Miami Resolution R-25-0344 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 18005 Final Action Date: 9/11/2025 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT, BUDGET, ALLOCATE, AND APPROPRIATE FUNDS FROM FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION ("FDEP") BISCAYNE BAY WATER QUALITY IMPROVEMENT GRANT PROGRAM FOR 2024 — 2025 IN AN AMOUNT NOT TO EXCEED NINE HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($900,000.00) ("GRANT FUNDS") AS SPECIFIED IN ATTACHMENT "A," ATTACHED AND INCORPORATED, FOR GLENCOE WATER QUALITY IMPROVEMENT PROJECT ACROSS BISCAYNE BAY ("PURPOSE"); ESTABLISHING A CAPITAL FUND PROJECT 40-B233823 AND APPROPRIATING THE GRANT FUNDS FOR THE PURPOSE STATED HEREIN; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, INCLUDING BUT NOT LIMITED TO, AMENDMENTS, EXTENSIONS, RENEWALS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR THE ACCEPTANCE OF THE GRANT FUNDS, ADMINISTRATION AND IMPLEMENTATION OF AND COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, FOR SAID PURPOSE. SPONSOR(S): Commissioner Damian Pardo WHEREAS, the City of Miami ("City") submitted grant applications to Florida Department of Environmental Protection ("FDEP") for the Biscayne Bay Water Quality Improvement Grant Program and was awarded one (1) 2024 — 2025 grant award; and WHEREAS, FDEP has awarded the City the 2024-2025 grant award for an amount not to exceed Nine Hundred Thousand Dollars and Zero Cents ($900,000.00) ("Grant Funds"); and WHEREAS, the Grant Funds will help with water quality improvement activities and low- lying areas that frequently flood due to overwhelmed stormwater systems during heavy rain and storm surges in the South Florida coastal community, adjacent to Biscayne Bay; and WHEREAS, the City wishes to accept, budget, allocate, and appropriate the Grant Funds from FDEP as specified in Attachment "A," attached and incorporated by reference; and WHEREAS, the Grant Funds will support improvements to the locations specified in Attachment "A," attached and incorporated, by enhancing their resilience to future natural disasters and water quality("Purpose"); and WHEREAS, it is appropriate for the City Commission to authorize the City Manager to accept, budget, allocate, and appropriate the Grant Funds, to establish a Capital Fund Project Number, and to negotiate and execute any and all necessary documents, including but not limited to, amendments, extensions, renewals, and modifications, all in forms acceptable to the City of Miami Page 1 of 2 File ID: 18005 (Revision:) Printed On: 9/30/2025 File ID: 18005 Enactment Number: R-25-0344 City Attorney, for the acceptance, administration and implementation of, and compliance with all applicable laws, rules, and regulations, for said Purpose; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized' to accept, budget, allocate, and appropriate the Grant Funds to be utilized for the Purpose stated herein. Section 3. The Capital Fund Project Number 40-B233823 is established, and the Grant Funds are appropriated as described in Attachment "A," attached and incorporated. Section 4. The City Manager is authorized to negotiate and execute any and all necessary documents, including but not limited to, amendments, extensions, renewals, and modifications, all in forms acceptable to the City Attorney, for the acceptance of the Grant Funds, administration, implementation, and compliance with all applicable laws, rules, and regulations, for said Purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
