HomeMy WebLinkAboutAgenda Item Summary FormAGENDA ITEM SUMMARY FORM File ID: #17824 Date: 07/09/2025 Commission Meeting Date: 09/11/2025 Requesting Department: Department of Building Sponsored By: District Impacted: District 5 Type: Resolution Subject: Approve - Emergency Demolition Four Story Structure - 431 NW 3 ST Purpose of Item: The nature of this item is to authorize a resolution of the Miami City Commission, by a four -fifths (4/5ths) affirmative vote, ratifying, confirming and approving the City Manager's findings, that it is most advantageous for the City of Miami ("City") to waive the competitive sealed bidding procedure pursuant to Section 18-90 of the Code of the City of Miami, Florida as amended ("City Code") and retroactively approving the selection of Chin Diesel, Inc. for the emergency purchase of demolition services to prevent the property located at 431 NW 3 Street Miami, Florida 33128, which was damaged by a fire, from collapsing, for an approximate amount of $505,445.00; authorizing the City Manager to negotiate and execute any all documents, subject to allocations, appropriations, and budgetary approvals having been previously made, compliance with applicable provisions of the City Code, including, the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Background of Item: On June 10, 2024, a fire emerged at the Temple Court Apartment Building located at 431 NW 3rd Street, Miami, Florida 33128, which caused major damage to the infrastructure of the property. The City's Building Unsafe Structures Division ("Unsafe Structures") declared the property unsafe and uninhabitable due to the structural damage caused by the fire. It was determined that a demolition was necessary to ensure the safety of the City residents as the property would potentially collapse. Therefore, Unsafe Structures is respectfully requesting retroactive approval of this purchase for demolition purposes. FOR THE EMERGENCY PURCHASE OF DEMOLITION SERVICES TO PREVENT THE PROPERTY LOCATED AT 431 NORTHWEST 3 STREET MIAMI, FLORIDA 33128, WHICH WAS DAMAGED BY FIRE, FROM COLLAPSING, FOR AN ESTIMATED AMOUNT OF $505,445.00; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, AND COMPLIANCE WITH APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING, THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE. WHEREAS, On June 10, 2024, a fire emerged at the Temple Court Apartment Building located at 431 Northwest 3rd Street, Miami, Florida ("Property"), which caused major damage to the infrastructure of the Property; and WHEREAS, the City of Miami's Unsafe Structures Division has deemed the structure located at Property unsafe and beyond repair due to fire -damage and imminent danger of collapse posing an immediate danger to the public; and WHEREAS, the City Manager pursuant to Section 18-90 of the City Code, made a written finding, attached and incorporated as Exhibit "A" ("City Manager's Findings"), that an emergency exists and approved an emergency purchase request by the City's Unsafe Structures Division for Emergency Demolition and Removal Services of the unsafe structure at the Property; and WHEREAS, the City Commission desires to ratify, confirm, and approve, the City Manager's Findings to protect the life, health, welfare or convenience of the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, the City Commission hereby ratifies, approves, and confirms the City Manager's Findings, that it is most advantageous for the City of Miami to waive the competitive sealed bidding procedures, pursuant to Section 18-90 of the Code of the City of Miami, Florida, as amended, and retroactively approving the selection of Chin Diesel, Inc. for the emergency demolition of a four (4) story structure located at the Property that has incurred fire -damage and is in imminent danger of collapse for an estimated amount of $505,445.00. Section 3. The City Manager is authorized1 to negotiate and execute any and all documents, all in forms acceptable to the City Attorney, subject to allocations, appropriations, prior budgetary approvals, and compliance with applicable provisions of the City Code, including, the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption.
