BACKGROUND
The City of Miami ("City") is the owner of the properties located at 1755 NW 2 Court, 1544 NW 58
Terrace, 1465 NW 60 Street, and 411 NE 69 Street (collectively, "Properties"), which are currently
being developed into affordable housing.
Once the homes on the Properties are fully constructed, they will be sold, at or below cost, for
affordable homeownership housing to eligible applicants whose annual income which range from
up to one hundred twenty percent (120%) up to one hundred forty percent (140%) of area median
income as published annually by the United States Department of Housing and Urban
Development ("Qualified Applicants"), through purchase and sale agreements, quit claim deeds
containing automatic reverter provisions, and restrictive covenants running with the land, in
compliance with the requirements of the City's Miami Forever Affordable Housing Limited Ad
Valorem Bond Funds, and American Rescue Plan Act, program, (collectively "funds").
Each home's purchase price cannot be more than the maximum purchase price for new
construction as published by the United State Department of Housing and Urban Development.
The affordable housing restrictions and automatic reverter provisions contained in the conveying
instrument(s) shall require that the Properties automatically revert to the City if the Properties are
used in a manner that is inconsistent with the requirements of the Programs during the thirty (30)
year term.
Section 29-B(a) of the Charter of the City of Miami, Florida, as amended ("City Charter"), provides
for the waiver of competitive bidding and other requirements and when "conveying property to
implement housing programs or projects which are intended to benefit persons or households with
low and/or moderate, the criteria of which to be provided for the federal and/or state law or by the
city commission".
The Qualified Applicants shall be selected on a first ready, first serve basis, and by requiring proof
of the City of Miami residence as a condition of applicant eligibility, except for current City or
Miami -Dade County first responders (including police, fire, and emergency medical personnel).
RECOMENDATION
In light of the above stated, approval of a waiver of the formal requirements of competitive sealed
bidding methods as not being practicable or advatageous to the City as set forth in the City Code of
Ordinance, as amended, specifically Section 18-85 (A), and the affirmation of these written findings
and the forwarding of the same to the City Commission for ratification by a four -fifths vote is
respectfully requested.
