HomeMy WebLinkAboutR-25-0331City of Miami Resolution R-25-0331 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 18026 Final Action Date: 9/11/2025 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A ROAD JURISDICTION TRANSFER AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT"), TO ACCOMMODATE THE WIDENING OF SOUTHWEST 4 AVENUE WEST OF THE INTERSTATE 95 ("1-95") SOUTHBOUND OFF -RAMP TO SOUTHWEST 7 STREET BY THE FDOT; FURTHER AUTHORIZING THE CITY MANAGER TO TAKE ANY AND ALL ACTIONS NECESSARY TO ACCOMPLISH THE SAID TRANSFER FROM THE CITY OF MIAMI ("CITY") STREET SYSTEM TO THE FDOT'S STATE HIGHWAY SYSTEM, AS STATED HEREIN AND MORE GENERALLY DEPICTED IN EXHIBIT "A," ATTACHED AND INCORPORATED; AND DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE FDOT, DISTRICT 6. WHEREAS, the Florida Department of Transportation ("FDOT") is in the process of constructing a roadway project FPID 447808-1-52-01, along State Road 90 ("SR-90") / United States Route 41 ("US-41") / Southwest 7 Street from Beacom Boulevard to west of Southwest 2 Avenue, Miami, Florida; and WHEREAS, the transfer of a portion of the City of Miami ("City") Right -of -Way to FDOT's State Highway System is necessary to accommodate the widening of Southwest 4 Avenue west of the 1-95 southbound off -ramp to Southwest 7 Street; and WHEREAS, the City agrees with the terms and conditions in the Road Jurisdiction Transfer Agreement draft provided by FDOT depicted in Exhibit "A," attached and incorporated, and this transfer is mutually agreed upon between the City and the FDOT; WHEREAS, the City concurs with the proposed overall upgrading and enhancement of the SR-90 / US-41 / Southwest 7 Street from Beacom Boulevard to west of Southwest 2 Avenue corridor; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to negotiate and execute the Road Jurisdiction Transfer Agreement, in a form acceptable to the City Attorney, with FDOT to 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. Section 3. The City Manager is further authorized' to take any, and all actions necessary to accomplish said transfer from the City's Street System to FDOT's State Highway System. Section 4. The City Clerk is directed to transmit a copy of this Resolution to the FDOT, District 6. Section 5. This Resolution shall become effective immediately upon its adoption.
