Background of Item: The Equitable Sharing Memorandum of Understanding ("MOU") is sponsored by the Department of Homeland Security, U.S. Immigration and Customs Enforcement, Homeland Security Investigations Special Agent in Charge, Miami, Florida, for several law enforcement agencies participation in the El Dorado Task Force to include the City of Miami ("City") Police Department ("MPD"). The El Dorado Task Force is a collaboration with multiple law enforcement agencies in an effort to disrupt criminal enterprises and remove the instrumentalities and proceeds of crime through joint investigation, forfeiture, and prosecution. The City remains fully responsible for their obligations to personnel assigned to the task force for the payment of overtime earnings, withholdings, insurance coverage, and all other requirements by law or contract regardless of the reimbursable overtime charges incurred. The reimbursement of overtime costs and other expenses may be authorized from the Treasury Forfeiture Fund but is subject to the availability of funds. This MOU becomes effective for two (2) years from the date of execution with options to renew for three (3) additional years or two (2) year terms upon agreement by all parties. WHEREAS, the United States Department of Homeland Security, Immigration and Customs Enforcement, Homeland Security Investigations ("DHS") has authority to enter into agreements with state and local government to combat and prevent crimes against the United States in coordination with local law enforcement agencies pursuant to the Homeland Security Act of 2002, Pub. L. 107-298, 116 Stat. 2135, and relevant directives and delegation orders; and WHEREAS, DHS is the sponsoring agency for the Equitable Sharing Memorandum of Understanding ("MOU") and several local law enforcement agencies participating in the El Dorado Task Force ("Task Force"); and WHEREAS, the Task Force is a collaboration with multiple law enforcement agencies in an effort to disrupt criminal enterprises and seize instrumentalities and proceeds of criminal activity through joint investigations, contraband forfeiture proceedings, and prosecutions; and WHEREAS, the City of Miami's ("City") Police Department ("MPD"), as a member of the Task Force, will have an opportunity to receive distributions of any contraband forfeiture funds recovered by the Task Force; and WHEREAS, the City will continue to be fully responsible in its obligations to personnel assigned to the Task Force for payment of overtime earnings, withholdings, insurance coverage, and all other requirements by law or contract regardless of the reimbursable overtime charges incurred; and WHEREAS, the reimbursement of overtime costs and other expenses may be authorized by the U.S. Department of the Treasury from the Treasury Forfeiture Fund subject to the availability of funds and approval by the Treasury Executive Office for Asset Forfeiture (TEOAF); and WHEREAS, the Task Force MOU will be effective for a period of two (2) years from the date of execution, with options to renew for three (3) additional years or two (2) year terms upon agreement by all parties; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized1 to execute an Equitable Sharing Memorandum of Understanding between the DHS and the City, along with several local law enforcement agencies, to participate in the El Dorado Task Force in an effort to disrupt criminal enterprises and remove the instrumentalities and proceeds of crimes through joint investigation, prosecution, and contraband forfeiture proceedings pursuant to the Homeland Security Act of 2002 Section 3. The City Manager is further authorized' to designate the Chief of Police to execute any and all other necessary documents, all in forms acceptable to the City Attorney Section 4.
