PURPOSE OF ITEM:
To amend Section 55-10 of Chapter 55 of the City Code to allow building permits to be
issued for temporary events, occupancies, structures, or uses —including interim
parking —on properties that are either unplatted or platted but not subdivided in
accordance with Chapter 55.
Background Information:
Temporary Activations require a building permit and are not allowable upon unplatted
parcels or platted parcels that have not been subdivided pursuant to Chapter 55 unless
there is a Platting Exception. The platting process is arduous and many property owners
are unable to undertake the requirements of platting or re -platting due to expense or
time. As such, many property owners are being prevented from utilizing their properties
to their fullest extent with a Temporary Activation.

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING
CHAPTER 55/SECTION 55-10 OF THE CODE OF THE CITY OF MIAMI,
AS AMENDED ("CITY CODE"), TITLED "BUILDING PERMITS; ISSUANCE;
RESTRICTIONS; EXCEPTIONS," TO ALLOW FOR TEMPORARY
CONSTRUCTION AND TEMPORARY ACTIVATIONS ON UNPLATTED
OR PLATTED LAND THAT HAS NOT BEEN SUBDIVIDED PURSUANT TO
CHAPTER 55 OF THE CITY CODE; CONTAINING A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE.
WHEREAS, Chapter 55 of the Code of the City of Miami, Florida, as amended ("City
Code"), provides the subdivision regulations for the City of Miami ("City"); and
WHEREAS, Section 55-10 of the City Code sets forth the general rule that platting or re -
platting is a prerequisite to issuing a building permit unless a property meets an exception
to platting as enumerated therein ("Platting Exception"); and
WHEREAS, Chapter 62, Article XIII of the City Code allows for certain temporary events,
occupancies, structures, and uses, including interim parking ("Temporary Activations"), subject
to compliance with, among other requirements, zoning and building regulations; and
WHEREAS, Temporary Activations, which require a building permit, are not allowable
upon unplatted parcels or platted parcels that have not been subdivided pursuant to Chapter 55
unless there is a Platting Exception; and
WHEREAS, many property owners are unable to undertake the requirements necessary
for platting or re -platting due to expense or time and are being prevented from utilizing their
properties to their fullest extent with a Temporary Activation; and
WHEREAS, it is in the best interest of the City and the community to alleviate the
burden on property owners seeking to utilize their properties by creating a new platting
exception that would allow property owners to be able to seek Temporary Activations
pursuant to Chapter 62 of the City Code upon unplatted parcels or platted parcels that
have not been subdivided pursuant to Chapter 55;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 55 of the City Code is amended in the following particulars:1
1 Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be
added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted
and unchanged material.

"CHAPTER 55
SUBDIVISION REGULATIONS
Sec. 55-10. Building permits; issuance; restrictions; exceptions.
(I) A building permit and certificate of occupancy may be issued for construction of
improvements for a temporary event, occupancy, structure, or use, including interim
parking, authorized pursuant to City Code Article XIII of Chapter 62 on unplatted land or
platted land that has not been subdivided in accordance with this Chapter.

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately after final reading and
adoption thereof.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein. whichever is later.
