A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
ATTORNEY TO PREPARE A PROPOSED AMENDMENT TO THE CHARTER OF THE
CITY OF MIAMI, FLORIDA, AS AMENDED ("CHARTER"), FOR CONSIDERATION AT
THE REFERENDUM SPECIAL ELECTION TO BE HELD ON NOVEMBER 4, 2025;
PROPOSING, UPON APPROVAL OF THE ELECTORATE TO REQUIRE THAT THE
CITY COMMISSION ESTABLISH A CHARTER REVIEW COMMISSION WITHIN ONE
(1) YEAR AFTER THE CERTIFICATION OF EACH FEDERAL DECENNIAL CENSUS;
DIRECTING THE CITY ATTORNEY TO DRAFT THE CORRESPONDING BALLOT
LANGUAGE AND CHARTER TEXT; AND PROVIDING FOR AN EFFECTIVE DATE.

A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
ATTORNEY TO PREPARE A PROPOSED AMENDMENT TO THE CHARTER OF THE
CITY OF MIAMI, FLORIDA, AS AMENDED ("CHARTER"), FOR CONSIDERATION AT
THE REFERENDUM SPECIAL ELECTION TO BE HELD ON NOVEMBER 4, 2025;
PROPOSING, UPON APPROVAL OF THE ELECTORATE TO REQUIRE THAT THE
CITY COMMISSION ESTABLISH A CHARTER REVIEW COMMISSION WITHIN ONE
(1) YEAR AFTER THE CERTIFICATION OF EACH FEDERAL DECENNIAL CENSUS;
DIRECTING THE CITY ATTORNEY TO DRAFT THE CORRESPONDING BALLOT
LANGUAGE AND CHARTER TEXT; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 6.03 of the Miami -Dade County Home Rule Charter authorizes the
City Commission to submit charter amendments to the electorate; and
WHEREAS, the Charter of the City of Miami has been amended from time to time to
reflect evolving standards of good governance; and
WHEREAS, best practices recommend a structured, periodic review of a municipal
charter following each Federal Decennial Census to ensure that demographic, legal, and
technological changes are appropriately reflected; and
WHEREAS, establishing a Charter Review Commission within one (1) year after each
decennial census will promote transparency, civic engagement, and orderly consideration of
potential charter revisions; and
WHEREAS, the Commission desires to present the voters with a charter amendment at
the Referendum Special Election to be held on November 4, 2025, that would mandate such
periodic review;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Attorney is directed to prepare a proposed amendment to the
Charter for consideration at the Special Election scheduled for November 4, 2025, proposing,
upon approval of the electorate, to require the City Commission, by resolution adopted within
one (1) year after the certification of each Federal Decennial Census, to create a Charter
Review Commission that shall conduct a comprehensive review of the Charter and transmit any
recommended revisions to the City Commission, which amendment shall prescribe the Charter
Review Commission's membership composition, qualifications, powers and duties, timeframe,
and dissolution provisions.
Section 3. This Resolution shall become effective immediately upon its adoption.
