Background of Item: The Florida Department of Transportation ("Department") has jurisdiction over State Road (SR) 90 (US-41) (SE 8th Street) from South Miami Avenue to Brickell Plaza, which is located within the limits of the City. The City, pursuant to Permit #2023-C-690- 00020, required the developer to draft design plans for lighting improvements on SR-90 (SE 8th Street) just west of Brickell Plaza. The project limits, as described in the attached Exhibit 'A', will be SR-90 (US-41) (SE 8th Street) from South Miami Avenue to Brickell Plaza. The developer will install a lighting system and associated features along SR-90, inside the Department's Right -of -Way, within the project limits, in accordance with Permit Number 2023-C-690-00020 (the "Project"). The developer is required to execute a non-standard improvement (NSI) covenant with the City for the street lighting improvements included in the MMOA. It is the intent of the parties for this agreement to supplement all existing Maintenance Memorandum of Agreement and existing permits previously executed between the Department and the City. The parties to this agreement mutually recognize the need for entering into an agreement designating and setting forth the City's responsibilities with regards to the maintenance of the lighting system and all associated features (the improvements) within the project limits. WHEREAS, the Florida Department of Transportation ("Department") has jurisdiction over State Road 90 ("SR-90")/United States 41 ("US-41")/Southeast 8th Street from South Miami Avenue to Brickell Plaza, which is located within the limits of the City; and WHEREAS, the City, pursuant to Permit #2023-C-690-00020, required the developer to draft design plans for lighting improvements on SR-90 (Southeast 8th Street) west of Brickell Plaza. The project limits, as described in the attached and incorporated Exhibit -A," will be SR- 90/US-41/Southeast 8th Street from South Miami Avenue to Brickell Plaza; and WHEREAS, the developer will install a lighting system and associated features along SR-90, inside the Department's Right -of -Way, within the project limits, in accordance with Permit Number 2023-C-690-00020 ("Project"); and WHEREAS, the developer is required to execute a non-standard improvement ("NSI") covenant with the City for the street lighting improvements included in the Maintenance Memorandum of Agreement ("MMOA"); and WHEREAS, it is the intent of the parties for this MMOA to supplement all existing Maintenance Memorandum of Agreement and existing permits previously executed between the Department and the City; and WHEREAS, the parties to this agreement mutually recognize the need for entering into an agreement designating and setting forth the City's responsibilities with regards to the maintenance of the lighting system and all associated features ("improvements") within the project limits; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized1 to execute the lighting MMOA, in substantially the attached form, with the Department, to facilitate the installation and maintenance of the improvements on SR-90/US-41/Southeast 8 Street from South Miami Avenue to Brickell Plaza.
