A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO ACCEPT, ALLOCATE, AND APPROPRIATE A CULTURAL
FACILITIES GRANT FROM THE FLORIDA DEPARTMENT OF
ENVIRONMENTAL PROTECTION ("FDEP") IN A TOTAL AMOUNT NOT TO
EXCEED ONE MILLION TWO HUNDRED THOUSAND DOLLARS
($1,200,000.00) FOR IMPROVEMENTS TO ROBERTO CLEMENTE PARK AND
BASEBALL FIELD, OFFICE OF CAPITAL IMPROVEMENTS PROJECT
NUMBER 40-B203505; ALLOCATING FUNDS IN THE AMOUNT OF EIGHT
HUNDRED THOUSAND DOLLARS ($800,000.00) FOR THE CITY OF MIAMI'S
REQUIRED MATCHING FUNDS FROM LEGALLY AVAILABLE FUNDING
SOURCES; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE
AND EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, WITH FDEP FOR SAID PURPOSE; FURTHER AUTHORIZING
THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER
NECESSARY DOCUMENTS, INCLUDING AMENDMENTS, EXTENSIONS,
AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY
ATTORNEY, NECESSARY FOR THE ACCEPTANCE AND COMPLIANCE
WITH SAID GRANT..

WHEREAS, the City of Miami ("City") is planning improvements to Roberto Clemente
Park located at 101 Northwest 31st Street, Miami, Florida 33127; and
WHEREAS, the scope of work for the Roberto Clemente Park and Baseball Field
Improvements Project, Office of Capital Improvements ("OCI") Project No. 40-B203505, consists
of, but is not limited to, grading and drainage of baseball field, installation of one thousand five
hundred sixty (1560) square feet of Longitudinal Section twelve(12) inch perforated exfiltration
system at perimeter, resod and fence replacement, dugout and bull pen improvements
("Project"); and
WHEREAS, the Florida Department of Environmental Protection ("FDEP") State,
Division of Cultural Affairs ("FDCA") awarded the City a grant in Aid to Local Government
("Grant") in an amount not to exceed One Million Two Hundred Thousand Dollars
($1,200,000,00) ("Grant Funds") for the Project; and
WHEREAS, the City is required to allocate and appropriate matching funds in an amount
not to exceed Eight Hundred Thousand Dollars ($800,000.00) ("City Match") from legally
available funding sources; and
WHEREAS, the Grant Funds shall be used solely for costs associated with the Project;
and

WHEREAS, it is appropriate for the City Manager to accept the Grant Funds and to
negotiate and execute a Grant Agreement with FDEP to set forth the terms and conditions for
the use of the Grant Funds;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to accept, allocate, and appropriate the
Grant Funds from the FDEP for the Project in an amount not to exceed One Million Two
Hundred Thousand Dollars ($1,200,000.00) for improvements to Roberto Clemente Park and
Baseball Field, Office of Capital Improvements Project No. 40-B203505.
Section 3. Funds in the amount of Eight Hundred Thousand Dollars ($800,000.00) for
the City Match is hereby allocated from legally available funding sources.
Section 4. The City Manager is further authorized1 to negotiate and execute a grant
agreement, in a form acceptable to the City Attorney, with the FDEP for said purpose.
Section 5. The City Manager is further authorized to negotiate and execute any and all
other necessary documents, including amendments, extensions, and modifications, all in forms
acceptable to the City Attorney, for the acceptance and compliance with said Grant.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor2.

1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes thes Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
