Background of Item: On January 24, 2019, the City of Miami Commission approved Ordinance No.13825 that allowed the creation of a second Development Agreement, pursuant to Chapter of the 163, Florida Statutes, to govern the development of the two building sites identified as Brickell City Center ("BCC-650 SMA") and to be incorporated into the Brickell City Centre Special Area Plan ("BCC -SAP") pursuant to the third amendment to the previously -approved ("Brickell City Centre SAP"). The Miami 21 Code establishes standards and procedures for new development or redevelopment in the City, which includes cash contribution as part of the Public Benefit program. On April 28, 2023, the City of Miami ("City") received a monetary contribution from "Swire OBCC", in the total amount of One Million Dollars ($1,000,000.00), related to a public benefit condition in the Brickell City Center SAP. Two Hundred Thousand Dollars ($200,000.00) will be allocated to each city commission district to be used for affordable housing projects. The City's Administration recommends the allocation of the fund received from Swire Properties One Brickell City Center ("SWIRE OBCC"), in the total amount of One Million Dollars ($1,000,000.00), with a Two Hundred Thousand Dollars ($200,000.00) going to a development in each district, as more particularly specified in Exhibit "A," attached and incorporated, to assist with affordable housing development projects. WHEREAS, on January 24, 2019, the City of Miami ("City") Commission approved Ordinance No.13825 providing for a second Development Agreement, pursuant to Chapter of the 163, Florida Statutes, to govern the development of the two (2) building sites identified as Brickell City Center ("BCC-650 SMA") and to be incorporated into the Brickell City Centre Special Area Plan ("BCC -SAP") pursuant to the third amendment to the previously -approved ("Brickell City Centre SAP"); and WHEREAS, Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code") establishes standards and procedures for new development or redevelopment in the City, which includes a monetary contribution as part of the Public Benefit program; and WHEREAS, on April 28, 2023, the City received a monetary contribution from Swire Properties Inc., a Florida for profit corporation ("Swire"), in the total amount of One Million and 00/100 Dollars ($1,000,000.00), related to a public benefit condition in the Brickell City Center SAP; and WHEREAS, the acceptance of the monetary contribution was contemplated in accordance with a Memorandum of Understanding between the City and Swire; and WHEREAS, Two Hundred Thousand and 00/100 Dollars ($200,000.00) will be allocated to each City Commission District's share of the City's Affordable Housing Trust Fund, to be used for affordable housing projects; and WHEREAS, the City's Administration recommends the public benefits contribution funds received from Swire, in the total amount of One Million and 00/100 Dollars ($1,000,000.00), with Two Hundred Thousand and 00/100 Dollars ($200,000.00) be allocated to each City Commission District's share of the City's Affordable Housing Trust Fund, as more particularly specified in Exhibit "A," attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The allocation of the public benefits contribution received from Swire, in the total amount of One Million and 00/100 Dollars ($1,000,000.00), with Two Hundred Thousand and 00/100 Dollars ($200,000.00) allocated to each City Commission District's share of the City's Affordable Housing Trust Fund, as more particularly specified in Exhibit "A," attached and incorporated, is authorized.' Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, including amendments, extensions, and modifications, all in forms acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption.
