Purpose of Item:
A resolution with attachments, of the Miami City Commission authorizing the City
Manager to execute an agreement with Miami -Dade County's Water and Sewer
Department (WASD) in substantially the attached form allowing the City intends to
construct and connect to Miami -Dade County's Water and Sewer systems a Public Park
(with toilets) with capacity for two hundred five (205) persons, representing an average
daily gallonage of one thousand twenty-five (1,025) gallons, replacing eighteen (18)
apartments, one (1) duplex, one (1) single-family residence (3,001-5,000 square feet)
and one (1) single-family residence (less than 3,001 square feet) as part of Office of
Capital Improvements Project Number 40-B23305.
Background of Item:
The City of Miami intends to construct and connect to Miami -Dade County's Water and
Sewer systems a Public Park (with toilets) with capacity for two hundred five (205)
persons, representing an average daily gallonage of one thousand twenty-five (1,025)
gallons, replacing eighteen (18) apartments, one (1) duplex, one (1) single-family
residence (3,001-5,000 square feet) and one (1) single-family residence (less than
3,001 square feet) previously connected to the Miami -Dade County's Water and Sewer
system, representing a combined average daily gallonage credit of three thousand two
hundred fifty (3,250) gallons resulting in no average daily gallonage increase and no
additional water and sewer connection charges. At the time of actual connection water
and sewer charges shall be calculated at the rates in effect. The current connection
charge rates are one dollar and thirty-nine cents (1.39) for water and five dollars and
sixty cents ($5.60) for sewer per gallon per day but are subject to revision by the Board
of County Commissioners at any time.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH THE MIAMI-DADE WATER AND
SEWER DEPARTMENT ("WASD") TO PROVIDE WATER AND SANITARY SEWER
SERVICES AT THE NEW PARK LOCATED AT 1610 NORTHWEST 6TH STREET
FORMERLY KNOWN AS RUBEN DARIO PARK AS PART OF CAPITAL PROJECT
NO. 40-B233505; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE
AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS,
RENEWALS, AND EXTENSIONS, ALL IN FORMS ACCEPTABLE TO THE CITY
ATTORNEY, SUBJECT TO ALLOCATIONS, APPROPRIATIONS AND BUDGETARY
APPROVAL HAVING BEEN PREVIOUSLY MADE, AND IN COMPLIANCE WITH
APPLICABLE PROVISIONS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED ("CITY CODE"), INCLUDING, THE CITY OF MIAMI'S PROCUREMENT
ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES,
ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, AND IN COMPLIANCE
WITH APPLICABLE REGULATIONS, AS MAY BE NECESSARY FOR SAID
PURPOSE.
WHEREAS, the City of Miami ("City") intends to construct a Public Park with toilets as
part of City Capital Project 40-B23305 ("Project") at 1610 Northwest 6th Street, Miami, Florida
formerly known as Ruben Dario Park ("Property"); and
WHEREAS, as part of the Project, the City intends to connect to the Miami -Dade Water
and Sewer Department's ("WASD") system that provides water and sewer services for the City
at the Property; and
WHEREAS, the City will not be required to pay WASD any additional water and sewer
connection charges for the Project at the Property from Capital Project No. 40- B233505 until
the time of actual connection; and
WHEREAS, the City Manager requests authorization to negotiate and execute an
agreement, in a form acceptable to the City Attorney, with WASD for water and sanitary sewer
services for the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to negotiate and execute an agreement, in a
form acceptable to the City Attorney, with WASD for the provision of water and sanitary sewer
services for the Project at the Property.
Section 3. The City Manager is further authorized1 to negotiate and execute all other
documents, including any amendments, renewals, or extensions, all in forms acceptable to the
City Attorney, subject to allocations, appropriations and budgetary approval having been
previously made, and in compliance with applicable provisions of the City Code, including, the
City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set
forth in Chapter 18 of the City Code, and in compliance with applicable regulations, as may be
necessary for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption.
