HomeMy WebLinkAboutR-25-0274City of Miami Resolution R-25-0274 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 17762 Final Action Date: 7/24/2025 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A LEASE AGREEMENT ("LEASE"), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, BETWEEN THE CITY AND TURNBERRY AIRPORT HOLDINGS, LLC, A FLORIDA LIMITED LIABILITY COMPANY ("LANDLORD"), FOR THE USE OF APPROXIMATELY 1,260 SQUARE FEET OF A HANGAR SPACE LOCATED AT THE OPA LOCKA AIRPORT AT 14200 NORTHWEST 42ND AVENUE, OPA LOCKA, FLORIDA 33054, FOR THE PURPOSE OF STORAGE OF AIRCRAFT FOR THE MIAMI POLICE DEPARTMENT SPECIAL OPERATIONS SECTION ON A MONTH -TO -MONTH BASIS FOR A MONTHLY RENT OF SEVEN THOUSAND FIVE HUNDRED DOLLARS ($7,500), WITH A GUARANTEE DEPOSIT OF SEVEN THOUSAND FIVE HUNDRED DOLLARS ($7,500), WITH AN INCREASE BY THE GREATER OF FIVE PERCENT (5%) OR THE THEN CURRENT ANNUAL INCREASE OF THE CONSUMER PRICE INDEX, IF THE TERM EXCEEDS ONE YEAR SUBJECT TO ADDITIONAL TERMS AND CONDITIONS AS MORE SPECIFICALLY SET FORTH IN SAID LEASE; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL NECESSARY DOCUMENTS, INCLUDING AMENDMENTS, RENEWALS AND MODIFICATIONS TO SAID LEASE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY. WHEREAS, the Miami Police Department Special Operations Section is interested in leasing a hangar of approximately 1,260 square feet of privately owned property for the use of aircraft storage at the Opa Locka Airport located 14200 Northwest 42nd Avenue, Opa Locka, FL 33054 ("Premises"); and WHEREAS, the initial term is month -to -month, commencing upon full execution of the Lease by the City and Landlord; and WHEREAS, the monthly rent is equal to Seven Thousand Five Hundred Dollars ($7,500.00); and WHEREAS, a guarantee deposit of Seven Thousand Five Hundred Dollars ($7,500.00), will also be payable to Landlord; and WHEREAS, if the term exceeds one year, an increase by the greater of five percent (5%) or the then current annual increase of the Consumer Price Index, will be applied; and WHEREAS, the City of Miami ("City") and Landlord desire and intend to enter into a new Lease Agreement ("Lease") authorizing the City's use of the Premises; City of Miami Page 1 of 2 File ID: 17762 (Revision: A) Printed On: 8/12/2025 File ID: 17762 Enactment Number: R-25-0274 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized' to execute a Lease Agreement, in a form acceptable to the City Attorney, between the City and Landlord, for the use of the Premises, for the purpose of aircraft storage for a monthly rent in the amount of Seven Thousand Five Hundred Dollars ($7,500.00), a guarantee deposit of Seven Thousand Five Hundred Dollars ($7,500.00), with an increase by the greater of five percent (5%) or the then current annual increase of the Consumer Price Index, if the term exceeds one year, subject to additional terms and conditions to be more specifically set forth in said Lease Agreement. Section 3. The City Manager is further authorized' to negotiate and execute all necessary documents, including amendments, renewals and modifications to said Lease Agreement, in a form acceptable to the City Attorney, as may be necessary. Section 4. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions.
