Staff Report and Business Impact Statement
Certificate of Use Denials and Revocations
Purpose:
To amend the criteria for when to revoke or deny a Certificate of Use (CU).
Estimated Direct Economic Impact:
• There will be no additional municipal regulatory costs for businesses.
• Allowing a Certificate of Use to remain active during minor noncompliance issues, can
help small or local businesses remain operational avoiding job losses or economic
disruption.
• In economically distressed or transitioning neighborhoods, maintaining operational
uses —even if slightly out of compliance —can help stabilize commercial activity and
prevent blight.
Estimated Number of Businesses to be Impacted:
The City of Miami has approximately 2,100 40/50-year violations issued in 2025. These
properties with violations will be denied any certificate of use application submitted, due to
current legislation.
Additional Information:
In some cases, allowing alternative compliance options may incentivize property owners to
correct violations without triggering abrupt shutdowns. Revoking a CU could result in
business closures and layoffs. The city believes that the relaxation of the more recent City
Code amendments will be in the best interest of the residents and businesses in the City of
Miami, while still providing life safety protections.
