HomeMy WebLinkAboutResolutionCity of Miami Resolution Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 17922 Final Action Date: 7/24/2025 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), DIRECTING AND AUTHORIZING THE CITY MANAGER AND THE CITY CLERK TO CONDUCT A STRAW POLL OF THE PROPERTY OWNERS LOCATED WITHIN THE BOUNDARIES OF THE DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI, FLORIDA ("MIAMI DDA"), TO DETERMINE IF THE PROPERTY OWNERS WISH TO CONTINUE TO BE TAXED BY THE MIAMI DDA; AUTHORIZING AND DIRECTING THE CITY MANAGER, THE CITY CLERK, AND ALL OTHER NECESSARY CITY OFFICIALS, AFTER CONSULTATION WITH THE CITY ATTORNEY, TO UNDERTAKE ALL NECESSARY ACTIONS AND PROCEDURES TO ACCOMPLISH THE PURPOSE AND INTENT SET FORTH IN THIS RESOLUTION; PROVIDING THAT THE CITY MANAGER AND THE CITY CLERK SHALL COMMENCE THE STRAW POLL NO MORE THAN FORTY- FIVE (45) CALENDAR DAYS AFTER THE ADOPTION OF THIS RESOLUTION ("COMMENCEMENT DATE"), AND THE STRAW POLL SHALL CONCLUDE NO MORE THAN FIFTEEN (15) CALENDAR DAYS AFTER THE COMMENCEMENT DATE. SPONSOR(S): Commissioner Joe Carollo WHEREAS, the Miami City Commission pursuant to Chapter 65-1090, Laws of Florida; Section 189.056, Florida Statutes ("F.S."); and Section 14-60 of the Code of the City of Miami, Florida, as amended ("City Code"), is authorized to levy an additional ad valorem tax on the taxable value of all real and personal property in the Downtown Development District, the boundaries of which are established in Section14-27 of the City Code, attached and incorporated as Exhibit "A" ("District"), not exceeding 0.4956 mills on the dollar valuation of such property for the purpose of financing the operation of the Downtown Development Authority of the City of Miami, Florida ("Miami DDA") as affirmed in Milan Investment Group v. City of Miami, 172 So. 3d 458 (Fla. 3rd DCA 2015); and WHEREAS, the City Commission has recently received numerous complaints and concerns relating to the activities and initiatives of the Miami DDA and the impact the Miami DDA has in the District; and WHEREAS, it is in the best interest of the property owners located within the District to conduct a straw poll to provide property owners with an opportunity to advise the City Commission whether the property owners should continue to be taxed by the Miami DDA; and WHEREAS, the City Manager and City Clerk are to expeditiously conduct the straw poll of the property owners located within the District; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 17922 (Revision:) Printed On: 8/12/2025 File ID: 17922 Enactment Number: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager and City Clerk are authorized' and directed to conduct a straw poll of the property owners located within the boundaries of the Miami DDA, to determine if the property owners wish to continue to be taxed by the Miami DDA. Section 3. The City Manager and the City Clerk, and all other necessary City officials, after consultation with the City Attorney, are authorized and directed to undertake all necessary actions and procedures to take such actions as contemplated by this Resolution. Section 4. The City Manager and the City Clerk shall commence the straw poll no more than forty-five (45) calendar days after the adoption of this Resolution ("Commencement Date"), and the straw poll shall conclude no more than fifteen (15) calendar days after the Commencement Date. Section 5. This Resolution shall become effective upon the date of its adoption.
