A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD,
RECOMMENDING TO THE MIAMI CITY COMMISSION APPROVAL OF AN
ORDINANCE AMENDING ORDINANCE NO. 13114, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED ("MIAMI 21 CODE"), SPECIFICALLY
BY AMENDING APPENDIX J, SECTION 3.4, TITLED "GENERAL TO ZONES/
WYNWOOD PUBLIC BENEFITS PROGRAM" TO ALLOW PROPERTIES WITHIN
WYNWOOD NRD-1 "T5-L" URBAN CENTER — LIMITED ZONING TRANSECT TO
OBTAIN BONUS HEIGHT; AND APPENDIX J, SECTION 4, TITLED "STANDARDS
AND TABLES", TABLE 2 TO CLARIFY PARKING CALCULATIONS AND TABLE 3
RELATED TO PARKING AND LOADING; APPENDIX J, SECTION 5, TITLED
"SPECIFIC TO ZONES" TO CLARIFY ART REQUIREMENTS ON NEW BUILDINGS
AND FACADE ALTERATIONS LOCATED WITHIN A "T5" URBAN CENTER
TRANSECT ZONE OR "T6" URBAN CORE TRANSECT ZONE AND TO UPDATE
NRD-1 STANDARDS RELATED TO LOT COVERAGE, BALCONY
ENCROACHMENTS, MINIMUM BUILDING HEIGHT, AND FLOORPLATE
DIMENSIONS TO INCLUDE LODGING USES; AND APPENDIX J, SECTION 6,
TITLED "LANDSCAPE REQUIREMENTS" TO UPDATE THE LANDSCAPE
REQUIREMENTS FOR LANDSCAPE AREAS IN PARKING LOTS; AND APPENDIX J,
SECTION 8, TITLED "STREETSCAPE MASTER PLAN" TO PROVIDE ADDITIONAL
NRD-1 SETBACK REQUIREMENTS FOR NRD-1 CORRIDORS AND WYNWOOD
THROUGHFARES; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No.
13114, the Zoning Ordinance of the City of Miami, Florida, which has been amended from
time to time ("Miami 21 Code"); and
WHEREAS, on September 24, 2015, Ordinance No. 13561, amended the Miami 21
Code to include Appendix J: Wynwood Neighborhood Revitalization District ("Wynwood NRD-
1"), which has been amended under Ordinance Nos.13642, 13805, 13960, 14134, and 14243 to
support the continued evolution of the Wynwood neighborhood; and
WHEREAS, the Miami 21 Code has been amended under Ordinances 14250, 14236,
14235, and 14234, and 14302 to amend both By -Right and Waiver processes to simplify the
review, permitting, and public hearing procedures leading to increased consistency and
predictability; and
WHEREAS, this Ordinance amends the Miami 21 Code, Appendix J: Wynwood Norte
NRD-1 to update the development standards for consistency with city-wide Miami 21 Code
regulations; and

WHEREAS, an amendment is necessary to allow properties within the NRD-1 having a
T5-L Transect Zone designation to be built to five (5) stories By -Right and eight (8) stories
including Bonuses; and
WHEREAS, a clarification to the NRD-1 art requirements on new Buildings and facade
alterations is required to update and clarify the minimum requirements for art on Building
Facades to assist the neighborhood to retain and support this critical characteristic while
allowing for design flexibility; and
WHEREAS, an amendment is necessary to clarify the NRD-1 parking calculation
methodology without significantly altering the existing requirements; and
WHEREAS, this amendment is also necessary to clarify the landscape and screening
requirements associated with off-street parking, particularly addressing any newly constructed
wall or fence fronting the public Right -of -Way when certain design criteria is met and the
requirement of a Wynwood Design Review Committee (WDRC) recommendation to the
Planning Director; and
WHEREAS, to support the continued evolution of the Wynwood Neighborhood, the
amendments provide additional NRD-1 Setback requirements for NRD-1 Corridors and
Wynwood Throughfares; and
WHEREAS, the Wynwood Business Improvement District (BID) recommended that the
Miami 21 Code be amended for such purposes as stated herein in relation to the Wynwood
NRD-1; and
WHEREAS, consideration has been given to the relationship of this
proposed amendment to the goals, objectives and policies of the Miami
Comprehensive Neighborhood Plan ("MCNP"), with appropriate consideration as
to whether the proposed change will further the goals, objectives and policies of
the MCNP; the Miami 21 Code; and other City regulations; and
WHEREAS, consideration has been given to the need and justification for
the proposed change, including changed or changing conditions that make the
passage of the proposed change necessary; and
WHEREAS, after careful consideration of this matter, it is advisable and in
the best interest of the general welfare of the City and its inhabitants to amend the
Miami 21 Code as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING
AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted and incorporated as if fully set forth in this Section.
Section 2. The Planning, Zoning and Appeals Board hereby recommends to the
City Commission that Ordinance No. 13114, the Zoning Ordinance of the City of Miami,

Florida, as amended, be amended by making modifications to Appendix J: Wynwood
Neighborhood Revitalization District (NRD-1), Section 3 — General to Zones in the
following particulars:1

NRD-1, in the amount and in the manner set forth herein.

through the Wynwood TDR Program.

a. Mechanical equipment on a roof shall be visually concealed from
ground -level and lateral views by parapets or screens of the minimum
height necessary, but said parapets and screens shall not exceed ten
(10 feet) in height for T6-8.
b. Ornamental Building features, decorative elements, or similar
Structures on a roof may extend up to twelve (12) feet in height for T6-
8.
c. Trellises and fabric shade structures on a roof may extend up to
fourteen (14) feet in height.
d. Stair and elevator enclosures, on a roof for T6-8 may extend up to
eighteen (18) feet in height.
e. Cooling towers and other non -Habitable Rooms on a roof may extend
up to eighteen (18) feet and shall have a minimum setback of ten (10)
feet from the Building Facades.
f. There shall be no height limitation for ornamental elements, stair and
elevator enclosures, mechanical equipment, or cooling towers on a roof
for a T6-12 Transect Zone or above.
g. Non -Habitable void space on a roof accommodating the depth of
swimming pools; landscaping; decks; Extensive, Semi -Intensive, and
Intensive Green Roof systems; transfer beams and other structural
elements; and/or mechanical systems may extend up to six (6) feet in
height. For the purposes of this subsection only, other permitted roof
elements may extend above the vertical extent of the void space for the
additional height specified. Non -Habitable void space may cover one
hundred percent (100%) of the roof and shall not be counted as Public
Benefit Floor Area.
h. Habitable Spaces above the top Story shall comply with the following
requirements:
1. may extend up to fourteen (14) feet in height and shall have a
minimum setback of ten (10) feet from Building Facades;
2. may be used as amenity or Commercial Uses identified within
Section 4, Table 1 Building Function: Uses and shall provide
associated outdoor roof programming;
3. shall not be used as Residential Units, Lodging Units, or Office
space; and

4. shall be treated as Public Benefit Floor Area for the first twenty
percent (20%) and 1.5 times Public Benefit Floor Area for the

may:
1. cover up to twenty percent (20%) of the roof area; and
2. cover an additional 20% of the roof area, not to exceed a total of
forty percent (40%), subject to providing and maintaining at least
one (1) of the following:
a. An Intensive Green Roof of an equivalent size of the
additional area is provided and maintained; and/or
b. Art treatment exceeding the minimum standards in
Section 5.1.e is provided and maintained,
compliance with the following requirements:
i. a tangible creation of an Artist;
ii. compatible with Wynwood's
character;
iii. located above the ground floor and
public thoroughfares; and
approved by the Planning Director

walkway connection is located within the Third Layer, no greater than fifteen (15)
feet in width, set back from the Facade a minimum of twenty (20) feet, walkway
connections shall not be enclosed on the sides or, if enclosed, shall be one
hundred percent (100%) glazed with clear glass, except for necessary structural
elements. Projects providing walkway connections shall be required to comply with

6.2 LANDSCAPE AREAS IN PARKING LOTS
All required or provided surface off-street Parking facilities and Parking lots shall be
landscaped in accordance with the following standards, which supersede Section 9.8
of this Code:
a. In order to maximize the distribution of shade, trees shall be planted throughout
the interior of the Parking Lot at a minimum density of one (1) tree per eighty
(80) square feet of landscaped area, exclusive of Parking lot buffers.
b. For each row of parking there shall be landscaped areas with trees within the
first ninety (90) linear feet, and one (1) landscaped area provided with a tree for
each additional ninety (90) linear feet. When a minimum six (6) foot clear
landscape area is provided between two (2) rows of parking, the landscape
areas with trees every ninety (90) linear feet is not required. This six (6) foot
wide landscape area shall be planted with trees no greater than thirty (30) feet
on -center.
c. For each row of parallel parking there shall be a minimum of two (2) landscape
areas with trees within the first seventy-five (75) linear feet, and one (1)
landscape area with a tree for each additional seventy-five (75) linear feet. The
landscape areas shall be equally spaced wherever possible.
d. All required trees shall be of an approved shade tree variety which shall attain a
minimum mature crown spread greater than fifteen (15) feet.

Wynwood is transitioning from an industrial district into an active, diverse, mixed -use
neighborhood. The current character of the neighborhood is demarcated, traversed,
and connected by atypical block compositions and narrow rights -of -way attributed to
the industrial past. The neighborhood' s predominately zoned fifty -foot ( 50') rights -of -
way combined with a high percentage of nonconforming parcels makes it a challenge
to balance feasible development and an adequate pedestrian environment.

The NRD-1 Streetscape Master Plan creates a series of rights -of -way, establishes
appropriate Setback areas and ideal sidewalk conditions to promote pedestrian activity
for the future of Wynwood. Right -of -Way Street Types have been established by the
City's Planning Department and Resilience and Public Works Department and applied
to Wynwood's Thoroughfare network based on right-of-way width and conditions as
identified in Illustration 8.3: Guidelines to specific street types. The NRD-1 Streetscape
Master Plan also serves as a set of Design Guidelines establishing a blueprint for a "
living street" consisting of street trees and other streetscape enhancements.
