THE STATE OR' PLOIIDA, ITS SUCCESSORS AND ASSIGNS, REREINA?TRR CALLED THE GRANTEE, THE RIGHT, TRIVILLGR AND FRANCHISE TO CONSTRUCT, OPERATE AND MAIN TAIN A STRRNT RAILWAY ON AND OVER TRE STREETS, AVENUES AND HIGHWAYS 0? THE CITY OF MIAMI, FLORID A, AND REGU- LATING THE CONSTRUCT/OD, OPERATION AND L AINTRNANC E TaER'S - O '. BE IT ORDAINED BY THE COMMISSION OF THE CITY 0P MIAMI: SECTION 1. That the CORAL GABLES RAPID TRANSIT CORPORATION, a corporation organized and existing under the laws of the State of Plorida, its successors and assigns, hereinafter called the Grantee, is hereby granted the right, privilege and franchise to construct, equip, operate and maintain a single traok railway of a standard gauge over and along certain streets, avenues and high- ; ways of the City of Miami in the State of Florida, which said streets, avenues and highways are as follows: Beginning at Flagler Street and Miami Avenue, run South on Miami Avenue to Southwest Thirteenth Street; thence West on Southwest Thirteenth Street to South Fifteenth Road; thence crossing South Fifteenth Road diagonally and in.a Westerly direction to Southwest Third Avenue; thence on Southwest Third Avenue to Southwest 22nd Street (Also known as Coral Way); thence West on Southwest 22nd Street or Coral Way to the City Limits of the City of Miami, Dade County, Florida. SECTION 2. That the motive power used in propelling cars over the lines of railway covered by this franchise, within the city limits, and any future extension of the privilege and use of streets hereunder within said city limits, shall be other than animal power; ecoept, however, horses and mules may be used in the construction and building of any portion of said railway, 8:4cTIUId 3, That said railway Dal . oonsist of a single treolc of standard gauge to be oonstruoted alolig the center lino of the street, avenue or highway, exoept where authority to place the Week 'along the garb line of any street is expreaaly granted to mad Grouter! by the City Oenmiaaion of the City of Miami. S OTtON 46 tf electric power ie used in the propelling of oars in such form as to necessitate trolley wires and otrrant transmission servioe: (a) That there shall be provided trolley wires and a5.1 ne- cessary end convenient fixtures and appurtenances needful in the oonstruo tion end operation of such a line of railway by the Gran- tee, and the said Grantee shall have the right to construct, for the purpose of transmitting power for the propulsion of its care, overhead trolley systems, suspended on posts placed along the curb line of said streets, avenues and highways; the same to be sub- ject, however, to all restrictions, limitations and regulations hereinafter contained, and such further reasonable regulations and restrictions as may be imposed by the City Commission of the City of Miami from time to time; providing, that the method of bond- ing of the eleotrio lines carrying return current shall be so safe- guarded that it will not corrode, destroy or impair the life of the lines or contaminate the water of any existing water supply. (b) That all wires suspended from trolley posts shall not be less than eighteen (18) feet above the surface of any street, ave- nue or highway, and there shall be provided as far as practicable guard wires as may be necessary and proper to prevent broken leads, carrying oables or wires from falling to the streets. (o) The trolley posts shall be made of wood,conorete or me- ta]. painIe4,,. and shall be so placed as to cause the lease possi- ble interference with the property rights - tangible or intangible - of the property owners along such streets occupied by the Grantee herein; and whenever a sidewalk or curbing is out into, torn up or removed, the some shall be rep.aoed by the Grantee herein, and such replacing shall be done in a skillful aire, workmanlike manner, so ae to fitneetly and oloacly in and around the base of said trol- ley poets. SECT/ON 6. That ail work shall be carried. on by capable en- gineore and workmen employed by the Grantee, suohwork shall be done according tothe laws and rules of the Director of public ser- vice of the City of Miami and that the Director of publio Service of the/said City shall furnish all necessary grade stakes, traps, profiles and all other information necessary to enable the said Gran- tee to conform to the established profiles for the streets and ave- nues and crossings and gutterings. The Grantee shall pay to the said City for its engineering work the sum of $15.00 per day for each engineer and $6.00 per day for each assistant thereto for each day they are aotually employed by the Grantee. SECTION 7. The City reserves the right to cross said lines with its water, gas mains, drains and sewer pipes et all times, with as little interference as possible, with the operation of said lines. SECTION 8. In the construction of said railway system, where grades are established and the streets reduoed to grade, the sur- face of said Grantee's tracks shall conform to said grades. SECTION 9. It is further provided that whenever the lines of the said Grantee's traoks traverse any -street upon whioh the pave- ment bad been ooneruoted, it shall, be the duty of the said Grantee to reatore the said pavement, where injured or destroyed, taken up or removed, to its previous condition as nearly as may be possible. Full stops shall oleo be made at all such street or avenue e `crossings where the Grantee deeignatea their points for reoeiving and discharging passengers. SECTXO7t 11. All oars shall be run with snob frequenoy as to maintain a reasonable schedule, and at all tides and places at a reasonable rate of speed and the motorman or operators of said cars shall at all times use ordinary due oare and caution in the opera- tion of same. SECTION lg. The entire system of tracks, trolleys, rails, cars and equipment shall be new, modern. first class and suitable in de- sign for the service for which it is intended. The rails to be used laftheimmeemow in the oonstruo tion of said railway shall be of such size, weight and design and shall be first approved of by the City Commission of the City of Miami. All oars shall be equipped with suitable air brakes, fenders and lights, and said oars and machinery for operat- ing the setae shall at all times be provided with good and proper ap- pliances for protecting the lives and persons of passengers on said road, and of the traveling public on and across the streets over whiob the said roads may be operated. SECTION 13. The ob�ar a for transporting passengers to be ex- acted by the said Grantee herein shall not exceed ten cents for each passenger for one cori.nuous one-way passage over the Grantee's lines within the present oity limits of the City of Miami, Dade County, Florida. SECTION 14. The oars of said railway shall at all times be en- titled to the track, and the drivers of all 'vehicles on the track or by the aide thereof shall turn all vebioles out on the proper signal of the approach of any oar; provided, however, that fire engine and other apparatus of the City of Miami shell et all times on the aound- ing of the alarm of fire, have the right of way when possible, over end e1ong the said track of the paid street railway, and the cars of the said street railway shell be stopped after the sounding of the .d. ti tiro AM and upon the gpproeab nt tho fire engine, boss carts end other tiro apparatus; such stoppage shall be made when such apparatus is within a distance of threw hundred feat of suoh oars, which shall remain standing until the same shall have passed. 6t0T1OI 16. The Grantee herein shall prom all tastes andsri, general and special, that may from time to time be lawfully levied and assessed by the City of Miami. SECTION 16. The Grantee herein shell enter into a oontinu- vas bond in the sum of Twenty.thousan8 Do1larejg Q,,pOO.00) pay- able to the City of Miami, plorida, with some approved surety com- pany' as surety, to indemnify and save harmless the Cityof Miami from all claims and judgments for injury to person or property oo- N. ' oasioned by or arising out of the oonstruotion or operation of the street railway hereby authorized. SECTION 19. The Grantee and assigns agree that if the right, is hereafter granted to any company or corporation to use any of the streets of the City for street railway purposes, other than the streets herein named, the Grantee will allow such company or cor- poration to arose the tracks at the expense of the Company desiring to cross. SECTION 18. Policemen of the City of Miami as well as the mem- bers of the fire department of the City of Miami are given the right to ride free of charge upon the oars of said Grantee when discharg- ing their offi offal duty. SECTION 19. The Grantee h erein is hereby given the right and authority to make an assignment of this right, privilege and author- ity and the rights hereunder . a000rding to the terms and conditions as set forth in the City Charter of the City of Miami. SEQTIOU 20, The said Grantee shall, within thirty days after the retifioation of said ordinanoe by the voters of Miami, Florida, deposit with the City Clerk a written aooeptanoe of the terms and conditions of, this ordinance, and also deposit with the City .Clerk euffi.oient money to pay for the publication of Me ordinenoe and the holding of a special election for the ratification or rejection of this frenohiee by the voters of the City of Miami es provided by laws Ama the seta Grantee shall also file with the proper office cm of the City of Miami within the said thirty Jaye period a good and sufficient bend payable to the City of Miami, Florida, with a surety company authorized by the laws of the State of Florida to got as surety on bonds, as surety, to be approved by the City Com- mission, in the cum of Twenty Thousand Dollars ($20,000,00) the oond itione of which shall be as follows: (a) That the Grantee shall, after the execution and filing of Said bond, commence the construction of said railway within thirty days from the date of formal notification by the City Commission of • the City of Miami of the ratifioation of said ordinance by the voters of the City at earl special election. SECTION 21. Subjeot to the conditions and understandings here- in expressed, it is understood that the life of this franohise shall be thirty (30) years from the date of acceptance of sane by the Grantee hereunder, but the right is reserved by the City of Miami, Florida, to purobase the street railway which may be constructed and operated by the Grantee at termination of this franchise, at a valua- tion to be fixed by arbitration as provided by law in Seotion 1844, Revised General Statutes of Florida, 1920. SECTION 22. It is the understanding that upon the issuing of this franchise the Grantee shall do all within its power to complete the street railway as desoribed herein, and according to the time limit specified in Section 20. SECTION 23. This ordinance shall take affect as soon as it shall have been duly approved and adopted es required by law and accepted as required herein.
