ORDINANCE NO. 332.
AN. ORDINANCE TO PRESERVE THE PUBLIC HEALTH BY REGULATING
TIE PRODUCTION AND DISTRIBUTION OP. MILK AND CREAM O?F1 E
FOR SALE IN THE CITY OF MIAMI; DADE COUNTY, FLORIDA) AND
PROVIDING PENALTIES FOR THE VIOLATION T1#EREOP .
BD TT ORDAINED BY THE COMMISSION OP Ta8 CITY OP MIAMI:
SECTION I:
1: It shall be unlawful for any person, firm or corpora-
tion to sell, offer for sale, or otherwise dispose of, or have in
hie possession for the purpose of selling or giving away to any per-
son or persons in the City of Miami, County of Dade, State of Flori-
da, any milk or oream whioh has not been pasteurized as is herein-
after required.

2: Milk and oream must •be pasteurized when offered for
sale by a wholesale distributing plant or milk depot and milk or
oream must be pasteurized when the laboratory findings of the Divi-
sion of Health of the City of Miami and the State Board of Health
of Florida shall show that during the twelve months previous to the
adoption of this ordinance, such a milk supply has averaged ove46
100,000 bacterial oolonies per cubic centimeter and in any other in-
stances when the Direotor.of Publio Welfare shall deem suob pasteur-
ization neoeseary for the protection of Publio Health.
3: Milk aid cream shall be deemed pasteurized within the
meaning of this ordinance if the same shall have been heated to a
temperature of not lees than one hundred alld forty-two degrees (142°)
Fahrenheit and bald at that temperature for a period of not lees than
thirty (30) minutes. The obief of the Division of Health or hie
aaeietants eball be empowered to inspect the process of pasteurisation,
asap the premises, apparatus and conditions under which same ie done
at all. times. The pasteurisation of milk or cream otherwise than
according to the methods and process approved by the Chief of pivieion
of Health shall not be deemed a compliance with theprovialone of this
ordinance. All pasteurizing temperatures shall be controlled by the
elm
an of recording thermometers of a type approved by the
Health.
3NOTXO _Iit ADULTERATED AMODNTAMINATED M!L
No milk that is adulterated or contaminated shall be,
in the Oity of Miami. The term "adulterated or contaminated
as used in this ordinanoe shall mean'
1: Milk that has a freezing point above minus
0.66 degrees Centigrade or below minus 0654 degrees
Centigrade.
8: Retail milk from dairies not equipped with
and not having in use complete faoilities for wash-
ing and. gleaning allbo ttles, pans and other utensils
and steam or boiling water for sterilizing the same,
and adequate facilities.
3: If pasteurized and. offered for sale, milk
that before heating contained over 1,000,000 banter-*
is per cc.
4: The offering for sale of repastuerized mi

6: Milk shipped by rail to Miami, that is not
pasteurized and olarified before offering for sale iw-
6: Milk or milk prdduots for sale at whole
or retail that does not have printed on the both

7 Remade or reconstructed milk which does not
bear the words "remade" or "reconstructed" milk on
the bottles, oap or container. The terms "enriched",
"special", eto., shall not be used in the sale of re-
oonstruoted or remade milk.
8: "Remade" or "reconstructed" milk when menu-
faotured from any product other than distilled water,
a good. grade of powdered milk or skim and wholesome
sweet butter.
9: Milk for restaurants, hotels, confectioner-
ies, drug -stores,, milk stations, or any plane where
milk is usually sold for consumption on the premises,
that is not sold or served in the original container.
10; Remade milk sold in any of the places afore-
said that have not prominently displayed ague where-
on appear in condensed Gotbio type, six inches high,
the words "Remade milk sold here".
11: The sale of "filled" milk, or shim milk to
* ivh a ve etab1e fat has been added is prohibited
except in the case of milk to which a chocolate syrup
of good quality has been added.
12: Milk labeled contrary to the provisions of
tbie ordinance on cape or tees, or of a aompoeition
different from that indioated on the bottle oap or von,

SECTION.,
Sa The layrout and plans for all near dairy barns, milk
depots and milk stations and for the remodeling of old ones dial
be approved by the Chief of Division of Health before ooantruotion
is begun. New dairy barns shall afford only oonorete mangers or
feeding troughs and all stanohions shall be of metal construction
kept well painted at all times.
2: Every dairy shall be provided with a sanitary system
of sewerage or exoreta disposal, either a eanitary privy or septic
tank of such design as is approved by the Division of Health.
3: All dairy utensils, apparatus and maohinery must be
thoroughly cleaned and sterilised before being put in use. All
metal dairy utensils shall be in first olass condition and the seams
shall be filled flush with solder. Before use, all utensils shall
be rinsed in lukewarm or °old water, they shall then be washed in
hot water, containing alkaline wash powder, after which they shall
be sted.ized either with live steam or steam under pressure, exoept
in the oase of approved containers, after oans and pails are scald-
ed they shall be inverted with covers off on a can rack in a place
protected from flies and dust, to drain and dry. Strainer cloths
shall always be boiled before use and dried quickly.
4: Milk shall be bottled in a manner sad with apparatus
approved by the Division of Health. Milk bottles shall be Dapped
by machine with well parafined, non -absorbent naps that are put up
and kept in sterile, dust proof tubes. The use of caps that are
put up in loose bags, barrels or other containers is prohibited.
5: Milk bottles: It is forbidden to use milk bottles as
reoeptaoles for any ()tier substance than milk and it is declared to
be unlawful to return milk bottles Wan unwashed or dirty condition,
or for a dairyman to accept such .returns for removal. Milk depota
must wash and sterilise all Dana before returning them for further
use to producers.
6: It eb411 be unlawful to bottle milk in any place exoept
at a dairy or milk depot and in a room especially prepared and reaerv-
ea for that pnrpoaa only.

ititilk shall not be delivered from any building or
dairy farm wherein or Whereon a case of communicable disease is
under treatment or quarantine exoept the milk shall be pasteur-
ised or delivered in a manner deemed safe by the Division of Health
of the Department of public Welfare.
et Every case of:oommunicable disease 000urring on a
dairy farm or in the family of any person handling milk shall be
immediately reported to the Division of health. Infractions of
this rule shall automatically revoke the lioense of the offending
dairy.
3: Every person employed in the production of and handl-
ing of milk except after the same shall have been bottled, shall
submit to a physical examination every three months,exoept in the
instanoe of newly employed attendants who shall submit to such ex-
amination not later thou seventy-two (72) hours from the beginning
of suoh employment.
4: Such medical examination shall be conducted by a oom-
petent physioian under the direction of the Chief of the Division
of Health; a fee of fifty cents ($.50) shall be paid to the medical
examiher for eaoh such examination, when the said examination is
conducted in theoffioe of the examining physician; and the fee of
one dollar ($1.00) for eaoh person examined shall be paid when it
becomes necessary to make medical examination upon the dairy pre-
mises.
SECTION V: Milk Supply by Common Carrier.
1: It shall be unlawful for any common carrier, its
agents or employees to convey or haul into the City of Miami, any
milk, skim milk or Dream, umleee in cane having attached thereto a
metal seal, placed tbereon by the shipper of eaid product.
2; Eyery person wishing to abip swept milk into the City
of Miami over a common carrier eball make application to the pivi-
lion of Health for an inspection of hie dairy or milk depot and eball
eaclo•e with paid application a certified check drawn in the favor
of the Director of Finance of the Qity of Ui.aai, to gayer all •spen-

see attending said inspection whereupon the Division of
Health shall within five (6) &aye onto the inspeotion
oalled for to be made, and. upon finding the hard is in sound
condition, ae shown by a tuberoulin test made by an soaredit•
ed. Veterinarian within one year and that the dairy or milk
depot in other respects eonforms to the requirements of this
ordinance, shall issue a permit to the applicant to ship milk
into the City of Miami upon securing a license from the City
Director of Pinatioe to ship milk over a oommon carrier into
the City of Miami, subject to the provisions of this ordinanoo
and stab other regulations as may be imposed by the City Com-
mission.
SECTION VI:
1; That any person or member of any firm or cor-
poration violating any of the provisions of this ordinance
shall, upon conviction, by punished by a fine of not more
than $100.00, or by imprisonment for not more than thirty
(30) days, or by both such fine and imprisonment in the dis-
cretion of the court, for the first offence; and for each
subsequent offense and conviction thereof, shall be punished
by a fine of not less than 0100.00 nor more than $500.00, or
by imprisonment for not more than sixty (60) days, or by both
such fins and imprisonment in the discretion of the Court.
2; This ordinance is hereby deolared by the Com-
mission to be an emergenoy measure on the ground of urgent
public need for the preservatic.n of health and safety and
shall be 3.nfull force and effect immediately upon ite passage.
