P. a.i., pareudaat to an ?Adjournment taken; November 30th, 1925. The meeting was celled to order by Chairman E. C. _'tomfh, who presided during the meeting. The following members of the Commiesrion were present: E. C. Romfh, J. H. Gilman, J. E. Lummus, J. I. Wilson, C. D. Leffler. EXTENSION AND WIDENING OF N. E. 3RD AVENUE Mr. Hugh Anderson and others came before the Oommieston andsubmitt'ed the followipg communization in referenoe to the extension and widening oY N. E. 3rd Avenue, whio,h, was read,and ordered filed: November 3O, 1925 TO THE HONORABLE CITY COI,MMISSIONERS of the CITY OF I.tIAIvII , FLORIDA Gentlemen.: On behalf of myself and associates I refer you to a oertain map presented to you at your meeting held on November 19, 1925, and also a certain map attaohed hereto as Schedule B, which maps outline u pro- jected extension and widening of Northeast Third Avenue in the City of Miami, northerly from Northeast 13th Street to the Southerly line of the so-called Charles Deering Estate property, and thence through said property northerly as shown on said Schedule B. The map first above referred to shows, colored in blue, property owned by my associates and necessary for such projeete;l widened and esetend- ed Third Avenue up to the southerly line of said Deering Estate; It shows, colored in pink, property owned by the City of Miami, whether now used for street purposes or otherwise; and shows uncolored, but with boundary lines marked, property which is also necessary for such projected extended and widened Third evenue and which must be donated, purchased or condemned. At- tached hereto as Schedule A is a descriptive list of individual lots Shown on said map, all or a substantial part of which must bee cquirel as afore- said by donation, purchase or condemnation, and with respect to c.00h parcel there is set forth e price at which my associates believe the respective parcels or necessary portions can be acquired by purchase or condemnation by the City. LIy associates are convinced, however, thet purchase or con- demnation by the City may result in decreased prices. T and my associates confirm the offer already mode to you et the meeting held on .Toverrber 19, 1925 and above mentioned, as follows: if you will order the extension and widening of said Northeast Third ;?venue sub- stantially es shown by the map already presented to you and first above re- ferred to, and order the condemnation of lots and or property required for such projected extension and widening and not already owned by the Cityor dedicated or conveyed to it as hereinafter mentioned; then we on our part will: (a) convey to the City of :Miami the property colored blue on the map first above referred. to; (b) use our best efforts to secure dedication by the owners of any necessary property not already owned by the City and shown on said map; (o) secure the donation, conveyance or dedication from the owners of all property lying within the projected o•ctandod and widen- ed Third Avenue and constituting a part of said Charles Deering :;,state property or the property of Miami Shores; and (d) use our be:~tsfforts to secure donation, conveyance or dedication of any other property lying with- in said projected extended and widened Third Avenue es shown on the reap hereto attached as Schedule B. In this connection we wish further to state that already a verbal agreement has been entered into for the necessary dedication or conveyance of said property constituting the part of the so - celled 'rancis S. Whitten or N.3.T. Roney property lying just north of the said Deerinrr Estate property. My associates further agree that if the City of „iemi issues bonds for the purpose of raising funds to pay condonuaution ;.awards for prop- erty ooudor„ned for the purpose of such projected widened and extended Third Avenue between Northeast 13th Street and the southerly line of staid Charles Deering Estate property or to pay the purchase price of any such property purchased without condemnation, then my associate ° paid erteke tb secure pur- chasers for such bonds up to a prinoipal annunt equal to such cost of prop- erty condemned or purchased at a price and on a basis to ;yield 4.75 percent per annum, provided the authorization,legality and termsof such bonds are approved by counsel for my associates or counsel satisfactory to them. Cne Street to the aertb bank of the Miami River and from the south bank of ti)e lAami '31.7er to Briokell Avenue; and WHEREAS the City Planning Board of the City of Mom' 1-1;" op - proved of such projected widened and extended N.2. 7,re :venue and N.E. 15th Street and S.E. 2nd Avenue, (a) the Director of Public Service of the CAte/ of Miami, Flori- da, is hereby direoted to determine the oeect locrAion of said pro- jected extended and widened N.E. rd Avenue, N.2. 15th etroct and S.E. 2nd Avenue substantially in accordance with plan:3 end ezeps discussed at this meeting and furnish to the City ,_ttornee of the City en exact legal description of the orooerte (indieideal percols) affected thereby and of such part of each parcel es ts eeceosery for such projected widening and extension; (b) that the City Attorney of the City, upon reeelviee Ruch legal descriptions be and he is hereby authorized and instruoted to prepare, all in accordance with law, resolutions for the condemnation of suoh property affected or necessary as shall not r)t then tiLe be owned by the City of Miami or with respeot to which there :'hall not then be an agreement by the owners to donate, dedicbte or convey to the City said necessary parts for the purpose of said proected ex- tended and widened N.E. 3rd Avenue, N.E. 15th Street end e.E. 2nd Avenue. FURTHER RESOLVED that the action hereinabove taken contemplates the donation, dedication or conveyance to the City of Miami of a right- of-way through the so-called Charles Deering Estate and idiami ShoreS so that said N.:. 7;rd Avenue will extend as a 100 ftbot street norther- ly from the southerly line of said Charles Deering Estate property into Federal Highway. Upon motion by Mr. Lunrnus, seconded by. :Ir. 0-ilrian, said resolution was passed:and. adopted by the following vote - AYES: Messrs. Romfh, Gilman, Lummus, Wilson. NOES: None. ADJOURNMENT There being no further business to come before the Commission at :this motion duly made and seconded, the meeting was adjo .ned.
