On this 30th day of November, 1925, the Commission of the City of Miami, Florlde, met in regular session at the City Hall in said City. The meeting was called to order at 3:00 o'clock P. M. by Cheirman E. O. Romfh and on roll call the following members were present: E. C. RoMfh, J. H. Gilman, J. E. Lummus, 3. T. Wilson, C. D. Leffler. LICENSE TAX -REAL ESTAT:': BROKERS. The City Manager submitted a oommunioation addressed tohim from Mr. C. L. Huddler ston, Director of Finance, in reference to license tax of real estate brokers. Said communication is in full as follows:, Miami, Florida, ' November 30, 1925. Mr. F. H. Wharton City Manager Miami, Florida Dear Sir: • Referring to Resolution No. 2165 adopted by the City Commissioners at meeting September 29th, entitled "A Resolution requiring Real•Estate Brokers and Real Estate Salesman applying for City license to first ex- hibit their State and County Lioense." Tne intention of the Miami Reulty Board in asking,the doption of this resolution was to prevent the issuenoe of City licenses to any but those who have qualified through the State regulations and to impose the responsibility of enforcement by arrest and prosecution of those not so qualified, upon the City. The enforcement of the provisions of the resolution would result ill the wholesale arrest and prosecution of all real estate operators in the City conducting business without a license, which we estimate at this time would include about 80/0 of the members of the Realty Board of Miami, such organizations as Coral gables, Shoreland Comeany, Hollywood and .% Water Company, Florida Cities Finance Corporation, Atlantic Shores, Miz- ner Development Co., G. Frank Croissant Organization, W. F. Morang Compeny, and numerous other companies and individuals, all of whom are reliable and willing and anxious to qualify to operate in the City by paying for and taking out the necessary licenses. Over ten thousand real estate licenses were issued out of this office last year. Prior to the adoption of this resolution,4,200 real estate licenses applicable to the current year had been issued and paid for; subsequent to that time up to and including the present time, 171 licenses have been issued to operators who have qualified through the County and 1,700 applications have been filed and fees eaid awaiting ac- tion by the County. Estimating there are 5,000 licenses yet to be collected and allow- ing 100 per month as the maximum number of the County can handle, as com- pared with 85 per month actually handled during the past two months, it will require at least four years to clear our slate of the unpaid 1925- 1926 licenses; and our failure to collect the additional 5,000 licenses will result in a loss to from "50,000.00 to 375,000.00 to the City. The intent of the State Law is plainly to limit the issuance of these licenses in a manner that is not only unjust but to much en extent that its enforcement is not practical as it would be physically and fin- ancially impossible to handle the business of Miami alone, if the law was strictly enforced and the business restricted to the licensed bro- kers who oould qualify under the law. In connection with the foregoing will you kindly bring this matter to the attention of the Commissioners, asking that they rescind the resolution referred to. Respectfully yours, (Signed) C. L. The following resolution from the Public Affairs Committee of the Civitan Club was received, read and ordered filed: RESOLUTION WHEREAS, the question of adequate Lire protection for Ii.�mi's waterfront, and especially for Miami's city docks and shipping facili- ties is a matter of public concern, and WHEREAS, the Public Welfare Committee of tho C ivitz,ii Club of Miami, after a careful investigation, is of the opinion that there is no adequate fire protection for this portion or tho City' ~ prop-, erty, and that the commerce in and to the ,:art of i,yi,:mi is jeopar- dized by such conditions, THEREFORE, BE I'T RESOLVED that said Committee rc spectfully re- oommends that this report be adopted and presented to the City Com- missioners of the City of Miami, Florida, as a resolution on behalf of the Civitan Club of Miami, requesting the City Commissioners to immediately purchase a fire and tug boat as additional protection to Miami's city harbor.
