On this 29th day of September, 1925, the Commission of the City of Miami, Florida, met at theOity Hall in said City pursuant to an adjournment taken September 28tb, 1925. The meeting was celled to order at 5:00 o'olook P. I. by Chairman E. C. Romfh and on rolloall the following members were present: E. C. Romfb, J. E. Lummus, J. 1. Wilson, J. H. Gilman. ABSENT: C. D. Leffler. REAL ESTATE BROKERS' LICENSES REGULATION IN ISSUANCE OF SAME The proposed ordinanoe submitted by the Miami Realty Board for the licensing, regu- lating and registering of Real Estate Brokers and Salesmen was disoussed and it was the sense of the Commission that inasmuoh as the Real Estate Broker's Law passed by the Legislature would aommplish the things desired by the proposed ordinance there was no need for additional regulation by the City exoept to require Brokers and Salesmen applying for oity lioense te'firet obtain and exhibit their State and. County lioeneee. Thereupon the following resolution was introduced by Mr. Wilson,who moved" its adoption: RESOLUTION NO. 2165. A RESOLUTION REQUIRING REAL ESTATE BROKERS AND REAL ESTATE SALESMEN APPLYING FOR CITY LICENSE TO FIRST OB- TAIN AND EXHIBIT THEIR STATE AND COUNTY LICENSES. BE IT RESOLVED BY THE COMMISSION OF THE OITY OF MIAMI: That before any City License is issued to any Real Estate Broker or Real Estate Salesman under the provisions of Ordinanoe No. 471 of the City of Miami, adopted September 28th, 1925, mob Real Estate Bro- ker or Real Estate Salesman is hereby required to first obtain and ex- hibit to the Direotor of Finanoe of said City his State and County Li- oense issued in a000rdanoe with the provisions of an act of the State Legislature, approved May Z6, 1925, and entitled: "AN ACT Providing for the Lioensing, Regulating and Register- ing of and Defining the Terms "Real Estate Brokers" and "Real Estate Salesmen", Empowering the County Judges to Grant, Sus- pend or Revoke Licenses and Presoribing the Prooedure; Creat- ing the Real Estate Brokers Registration Board, Providing for Appointment of its Members, its Powers and Duties, Providing for ite Expenses to be Paid Out of the "Real Estate Brokers Registration Fund" Herein Created, Presoribing Certain Offen- ses and the Penalties for Violating the Provisions Thereof". Upon being seoonded by Mr. Lummus, the said resolution was adopted by the following vote - AYES: Messrs. Romfh, Lummus, Wilson, Gilman. NOES; None. APPROPRIATING $4,000.00 FOR CERTAIN CHANGES IN SEWER CONSTRUCTION The City Manager submitted the following request from the Direotor of Public Servioe for an appropriation of $4,000.00 to oorer the estimated oost of alteration of storm and sanitary sewers at the foot of NW 2nd Street an NW North River Drive: September 16, 1925. Mr. F. H. Wharton, City Manager, Miami, Fla. Dear Sir: Will you kindly have resolution passed by the Commis- sion, authorizing an appropriation of $4,000.00 to oover the estimated cost of alteration of etorm and sanitary sew ere at the foot of NW 2nd Street and NW N. River Drive. It is necessary to remove these sewers from private property, and while ordinarily the oharge would be to the City's share of storm sewers, I understand from the Finanoe Department that praotioally no funds are vailable in this a000unt. Whereupon the following resolution apprepriating 4,000.00 from the General Fund Surplus to pay the coat of the work was introduced by Mr. Wilson who moved its ad- option: RESOLUTION NO. 2166. A RESOLUTION Ai'J 0PRIATING THE SUM OF *4,000.00 FROM THE GEN- ERAL FUND SURPLUS FOR PAYMENT OF COST OF SEWER WORK AS SET FORTH HEREIN. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI: That the sum of $4,000.00 be, and the same is hereby, appropriated from the General Fund Surplus for the purpose of paying the cost of al- teration of storm and sanitary sewers at the foot of NW 2nd Street and NW N. River Drive, as reoommended by the Director of Public Service. Upon being seconded by Mr. Lummus the resolution was adopted by the following vote - AYES: Messrs. Romfh, Lummus, Wilson, Gilman. NOES: None. CANCELLATION OF CERTAIN SEWER IMPROVEMENTS DISTRICTS 140 TO 144 Also submitted by the City Manager was the following communication from, the Direo- tor of Public Servioe recommending the oanoellation of oertain Sewer Districts: September 26, 1925. File Sr. 54. Mx. F. H. Wharton, City Manager, Miami, Fla. Dear Sir: The Sewer Division asks that Resolution be passed oanoelling Sew. er Districts 140 to 144, inclusive, for the reason that this projeot will be re -designed in a larger and more comprehensive system. Will you please, therefore, have this resolution pasaed,thua oan- oelling pending liens on the property affected. A RESOLUTION REPEALING ALL RESOLUTIONS ADOPTED AND PROCEDURE TAKEN IN SEWER IMPROVEMENTS 140 TO 144, IN- CLUSIVE, AND CANCELLING PENDING LIENS AGAINST •PROPER- TY LIABLE FOR ASSESSMENT OF THE COST OF THE WORK. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI: 1: That all resolutions adopted and procedure taken in Sewer Im- provements Sr-140 to Sr-144, both inclusive, be, and the same are here- by, oanoelled and repealed. 2: That all pendings liens against property abutting said imprcre- ments and liable for assessment of the cost of the said improvements be, and the same are hereby, oanoelled. Upon being seconded by Mr. Wilson, the resolution was adopted by the following vote AYES: Messrs. Romfh, Lummus, Wilson,Gilman. NOES: None. CANCELLATION OF SEWER IMPROVEMENTS DISTRICT 146 A communication from the Direotor of Publio Servioe requesting the oanoellation of Sewer Improvement No. 146 was submitted by the City Manager and is as follows: September 24, 1925. File Sr. 56. Mr. F. H. Wharton, City Manager, Miami, Fla. Dear Sir: The Sewer Division asks that Sewer District 146, incorporated in Contraot Sr. 56, be oanoelled, es it is desired to extend ari in- crease the pipe sizes in this particular district, which it is pro- posed to do in another oontraot. Will you please therefore arrange to have proper resolution passed eliminating District 146 from Contract No. Sr. 56, so that no pending liens may be planed on property in this district. This letter is in connection with letter to you of September 21st advising that we had asked Mr. Ross to hold up the confirmatory resolution on thisuntil the next meeting of the Commission. . Septeember .29.,._ 1926. This will leave Districts 147 to 152, inclusive, in Con- traot No. Sr. 56, as we are eliminating only District 146. With referenoe to my letter of September 21 st, enclosing oopy of letter from Engineer Bow, of the Division of Sewers, regarding the holding up of confirmatory Resolution on Sewer Contraot Sr. 57, Districts 153 to 154, inolusive: I am requested by rEngr. Bow of the Division of Sewers to have these Distriota oanoelled, pending design of a larger and more oom- prehensive trunk line. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI: That the resolutions heretofore adopted by the Commission order- ing Sewer Improvements 153 and 154 be, and the same are hereby, oan- oelled and repealed. September 29th, 1925. 1 1 1 I AUTHORIZING PAYMENT OF BILLS INCURRED IN ANNEXATION ELECTION Certain bills inourred in the annexation eleotion were submitted and upon examina- tion the said bills meeting with the approval of the Commission a resolution ap- proving same and authorizing payment was introduced by Mr. Lummus who moved its ad- option: RESOLUTION NO. 2170. A RESOLUTION APPROVING CERTAIN BILLS INCURRED IN THE HOLDING OF THE ANNEXATION ELECTION SEPTEMBER 2ND, 1925, AND AUTHORIZING PAYIJIENT OF SAME. BE IT RESOLVED BY THE COMMISSION OF THE OITY OF MIAMI: That the statement of expenses incurred in the holding of the annexation eleotion September 2nd, 1925, as submitted by R. B. Bur - dine, be,and the same is hereby, approved and. ordered paid from the appropriation of necessary funds from the General Fund Surplus au- thorized by Resolution No.2145, adopted September 14, 1925. Upon being seconded by Mr. Wilson, the resolution was adopted by the following vote - AYES: Messrs. Romfh, Lummus, Wilson, Gilman. NOES: Nona. CONFIRMATION OF CERTAIN IMPROVEIMENT RESOLUTIONS DISTRICTS 147 TO 152, INC. The Commission having received and considered, after due legal notice, all objec- tions of interested persons to the confirmation of the resolutions ordering Sewer Improvements 146 to 152, both inolusive, suoh objeotions having been considered at a meeting of the Commission on September 21st, 1925; and sewer improvement 146 having been cancelled by the Commission, the resolutions ordering sewer improvements 147 to 152, both inclusive, were confirmed. The resolution confirming the resolution ordering Sewer Improvement 147 was in troduoed by Mr. Lummus, who moved its adoption: RESOLUTION Pi0. 2171. A RESOLUTION CONFIRMING THE RESOLUTION ORDERING SANITARY SEWER IMPROVEMENT 147. WHEREAS, the City Commission at a meeting held at 3:00 o'clock P. M., September 21st, 1925, after legal notice, heard all objeo- tions presented by interested persons to the oonfixmation of the re- solution ordering Sanitary Sewerlmprovement 147, and the plans, spe- oifioations and estimate of oost thereof, and no objeotion was sus- tained, NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI: That Resolution No. 2092, adopted August 17th, 1925, ordering Sanitary Sewer Improvement 147, be, and the same is hereby, confirmed. Upon being seconded by Mr. Wilson, the resolution was adopted by the following vote - AYES: Messrs. Romfh, Lummus, Wilson, Gilman. NOES: None. The resolution confirming the resolution ordering Sanitary Sewer Improvement 148 was introduoed by Mr. Lummus, who moved its adoption: RESOLUTION NO. 2172. A RESOLUTION CONFIRMIING THE RESOLUTION ORDERING SANITARY SEWER IMPROVEMENT 148. WHEREAS, the City Commission at a meeting held at 3:00 o'olook P. REGULATING AWNING BUSINESSES SECOND READING OF ORDINANCE An ordinanoe entitled: AN ORDINANCE REGULATING ANY PERSON, FIRM OR COR- PORATION ENGAGED IN THE BUSINESS ap HANGING, RE- PAIRING, REMODELING OR TAKING DOWN AWNINGS IN THE CITY OF MIAMI, PROVIDING FOR A LICENSE AND BOND THEREOF AND PROVIDING FOR A PENALTY FOR THE VIOLA- TION OF SAID ORDINANCE adopted on its first reading September 28, 1925, was taken up for final reading and4 passage, and an motion of Mr. Lummus, seconded by Mr. Wilson,the said ordinanoe waa given its second and final reading in full and paseed and adopted on its second an& final reading in full by the following vote - AYES: Messrs. Romfh, Lumps, Wilson, Gilman. NOES: None. The said ordinanoe is numbered and designeed Ordinance No. 478 and is shown in full in ordinanoe Book 1. w 1 L 1 5 September 29th, 1925. ACCEPTING DEDICATION 0? STREETS IN NEW 6UHDTVISION A plat of a subdivision to be known as "Rex Park" was submitted bearing the ap- proval of the Department of Public Service, and the said plat showin certain de- dications of portions of the land subdivided to the use of the public, suoh dedi- cations were aooepted by the following entitled ordinance: AN ORDINANCE ACCEPTING THE DEDICATION OF THE STREETS, AVENUES AIdDHIGHWAYS IN THE SUBDIVISION TO BE KNOWN AS "REX PARE" which was introduced byMr. Wilson. On motion of Mx. Wilson, seconded by Mr. Gil- man, it was resolved that the charter requirement that all ordinances be read on two separate 000asions, unless dispensed with by a four -fifths vote of the Commis- sion, be dispensed with and the said ordinance given both readings at this meeting. The vote thereon was as follows: AYES: Messrs. Romfh, Lummus, Wilson, Gilman. NOES: None. Thereupon, upon motion of Mr. Lummus, seconded by Mr. Gilman,the said ordinanoe was given its first reading by title only and passed on its first reading by the following vote: AYES: Messrs. Romfh, Lummus, Wilson, Gilman. NOES: None. Upon motion of Mr. Lummus, seconded by Mx.Gilman, the said ordinance was given its second and final reading in full and passed and adopted on its second and final reading in full by the following vote: AYES: Messrs. Romfh, Tames, 'Wilson, Gilman. NOES: None. The said ordinance is designated Ordinance No. 479 and is shown in full in Ordinance Book 1. ADJOURNMENT There being no further business to oomo before the Commission et this meeting, on motion duly made and seconded, the meeting was adjourned until 3:00 o'olook P.
