MINUTES OP REGULAR MEEXING OF THE BOABD OF COMMISSIONERS OF THE CITY OF MIAM/, FLORIDA.
On this 31et day of August, 1925, the Commission of the City of Miami, Florida, met
in regular session at the City Hall in said City. The meeting was oalled to order at
3:00 o'clock P. M. by Chairman B. O. Romfb and on roll oall the following members of the
Commission were present:

ORDERING OERTAXN LOCAL IMPROVEMENTS DISTR/OTS H-269 TO H-272, /NOLUSIVE
The Commission ordered the improvement of certain streets by the following resolu-
tions:
A resolution ordering Improvement H-269 was introduced by Lir. Wilson who moved
its adoption and which is as follows:

A RESOLUTION ORDERING LOCAL IMPROVEMENT H - 269.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI:
That a local improvement desoribed and designated as follows shall
be made under Seotion 56, City Charter:
Improvement 11-269 as follows:
N. E. 1st Avenue, from N.B. 36th Street to N.B. 38th Street.
Grading between ourbs;
Construoting a concrete ourb 6 inches wide and 14 inches deep and
- a oonorete gutter 18 inches wide and 'a inches deep on both sides of the
street, exoept that where suitable ourb and gutter to proper line and
grade are already in plane the oonstruotion of a now curb and gutter will
be omitted and credit will be given;
Laying a pavement of:
Kentucky Rook Asphalt l inches thick upon a foundation of local
pit rook not less than 9L-- inches thick, all being 44 feet wide and ex-
tending from curb to curb. Providing necessary drainage inlets, catch -
basins and manholes for sewers. The property against which special as-
sessments for the cost thereof shell be made is hereby designated Dist.H-269.
Upon being seconded by Ur. Leffler the resolution was adopted by the following vote:

Laying a pavement of 011 macadam upon a foundation of local pit
rook not less than 6 inches thiok, all being 29 feet wide and extend-

only, except that where suitable ourb and gutter to proper line and
grade are already in plaoe the construction of a new curb and gutter will

not less then 6 inches thick on the south side of the center line of the

PLAN OF PENINSULAR TERMINAL CO WHICH PLAN CALLS FOR CREATING AN
ISLAND SOUTH OF THE PRESENT SHIP CHANNEL AND WHICH ISLAND WILL DO
GREAT DAMAGE TO THE ATTRACTIVENESS OF BISCAYNE BAY TO SAY NOTHING
OF THE DAMAGE WHICH WILL BE DONE BY BUILDING A VIADUCT THROUGH
OUR SHIP DAEIN PERIOD THIS PLAN IS UNFAIR TO THE TAXPAYERS AND
CITIZENS OF MIAMI PERIOD I ALSO WISH TO PROTEST AGAINST THE TERMS

A RESOLUTION AUTHORIZING CHANGE IN SPECIFICATIONS
FOR PAVING SW 12TH AVENUE, PROM SW 8TH STREET TO SW
13TH STREET.
BE IT RESOLVED BY THE COmMISSION OF THE CITY OF MIAMI:
That the skeoifioations for paving SW 12th Avenue, from SW 8th
Street to SW 13th Street be, and the same are hereby, authorized chang-
ed to provide for 8 inoh pit rook base with 3 inch sheet asphalt in-
stead of 5 inoh pit rook base with 2 inch asphalt as originally speci-
fied.
Upon being seconded by 14r. Leffler, the resolution was adopted by the following vote:
AYES: Llessrs.Romfh, Leffler, Lummus, Wilson. NOES: None.
UNDERPASSES AT NW 2nd, 3rd AND 4th STREETS UNDER F. E. C. RY. TRACKS
The Acting City Manager submitted the following communication recommending the pass-
age of a resolution requesting the underpassing at the F. E. C. By. traoks at NW 2nd,
3rd and 4th Streets:
August 27, 1925.
City Commission.
Gentlemen:
If agreeable, I would ask that the resolution be passed request-
ing the underpassing of the F.E.C.Ry. at NW 2nd, 3rd and 4th Streets.
These underpasses to allow a total head -room for vehicular traffic of
ten and one-half feet. Our estimate for the total expenditure for
these three underpasses amounts to $900,000.00. Just what portion of
this expense should be borne by the City and what di ould be borne by
the Railroad, I am not able to say. Other work of this kind seems to
vary in accordance with locality.

The matter was disoussed and it was the sense of the Commission that the underpasses
should be started just as soon as possible in order to relieve traffic congestion
which oannot be relieved in any other way and it was also the sense of the Commission
that a fair arrangement for paying the oost of the underpasses would be for the Com-
pany to stand one-half of the expense and the City one-half. Whereupon the follow-
ing resolution was introduoed by Mr. Lummus who moved its adoption:
R OLUTION NO. 2119.
A RESOLUTION REQUESTING THE UNDERPASSING OP ZEE FLORIDA
BAST COAST RAILWAY AT CERTAIN STREETS IN THE CITY OF MIAMI.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI:
That the Florida East Coast Railway Company is hereby requested to
allow the underpassing of their tracks at N. W. 2nd, N. W. 3rd and N. W.
4th Streets in the City of Miami, Florida.
Upon being seoonded by Mr. Leffler, the resolution was adopted by the following vote:
AYES: Messrs. Romfh, Leffler, Lummus, Wilson. NOES: None.
AUTHORIZING CHARGE FOR ENGINEERING SERVICES FOR FURNISHING LINES, GRADES, ETC.
The Acting City Manager reported that the Public Service Department had been requir-
ing persons making applioation for oity engineers to establish lines and grades for
sidewalks constructed by property owners to make a deposit of $5.00 and that when the
improvement was completed the deposit was returned, but that a large number of the de-
posits were never called for and that the Service Department had aocummulated quite a
sum of money from the uncalled for deposits. The Acting City Manager recommended
that the Service Department be authorized to make a oharge of 05.00 for engineering
services in establishing lines and grades and do away with the deposit feature. This
met with the approval of the Commission and the following resolution was introduoed
by Mr. Lummus who moved its adoption:

The Aoting City Manager submitted a communication calling attention to the offer of Mr.
Charles Torrey Simpson to furnish the City with plants, seeds and cuttings for use in
Otty Parks to whioh was attached the offer of Mr. Simpson. The oommunioations are as

dressed to Superintendent of Parks, J. G. Curtis. The letter
speaks for itself. I thought you might want to make acceptance
of his generous offer as a Commission.

My dear Mr. Curtis: -
Agreeable to my promise I am writing you in regard to the mat-
ter of presenting seeds, outtings and plants for the use of the pu-
blic garden on the Lliami Water front. I have one of the largest
collections of subtropioal and tropical plants in the State oontain-
ing many very rare things. Of any or all of these where they oan be
spared I am grilling to give from time to time as they are needed not
only for this park but to be used as you wish in any part of the Ci-
ty.
Dade County is my home, to it I owe all my loyalty, for Miami
I have. the greatest patriotism, here I have proapered beyond what I
ever hoped. We have sold our home "The Sentinels" to a syndioate
of Miamians who give us the privelege of living on the plaoe during
my lifetime and to control and manage it as we have done in the past.
Before long I shall have money more than sufficient for all my modest
needs and I would like to purchase and donate to this park rare and
valuable plants from time to time to be used in its decoration or for
beautifying the city as you shall think best. T had rather spend a
part of my income in this way than to pay tax on it.
For example in looking over Reasoner's catalog I find many
things that are not :crown on this side of the state or very rarely and
I could a little later have a set of these plants sent to you. I am
very anxious to see a much greater diver3ity of beautiful things
planted here than we generally have. The miserable show of the co-
conut, Chinese hibiscus and Acalypba together with an 000asional ol-
eander and Croton is a disgrace to our fair city an6 country and the
• sooner this condition is remedied the better.
You thought that it might be possible to have a small part of
the new park to be used for such plants as I can furnish from time
to time and if this could be done of course I would be greatly pleas-
ed but it is not a really important matter. It will really make lit-
tle difference in 25 years whether the Old Man Simpson furnished the
plants or some ono else so that the city gets them and the public gets
the benefit of them.
I have a considerable number of rooted plants now whioh I start-
ed for a friend but he sold his place and didnt need them so you will
be welcome to them if you oan use them. You are at liberty to place
this proposition or suggestion before the City Commissioners if you
think it worth while. I will just say that I stand ready to do what
I have outlined without any string whatever.

That the generous offer of Mr. Charles Torrey Simpson to furnish the
City with seeds, cuttings and plants for the use of the City in the public
parks and gardens is hereby aooepted by the Commission and the Commission
hereby expresses its thanks for same.

ACCEPTING DEDICATION OF STREETS AND PARKS
IN NEW SUBDIVISPON
The Director of Public Service submitted a plat a resubdivision of Lots 18, 19, 44
and 45 of Block 3 of First Amended Plat of Winter Gardens and stated that the same
had been examined and met with the requirements of the Department of Public Service.

was introduced by Mr. Leffler and on his motion, seconded by Mr. Wilson, it was
resolved that the °barter requirement that all ordinances be read on two, separate
days, unless diepensed with by e four -fifths vote of the Commiesion, be dispensed
with and the said ordinanoe be given both readings at this meeting. The vote
thereon was as follows: AYES: Messrs. Romfh, Leffler, Lummus, nlson. NOES:
None. Thereupon upon motion of LIr. Leffler, seconded by Mr. Wilson the ordi-
nanoe was given its first reading by title only and passed on its first reading
by the following vote: AYES: Messrs. Romfh.Leffler,Lummue,Wilson. NOES: None.
On motion of Mr. Leffler, seconded by Mx. Lummus, the said ordinance was eiven
its second end final reading in full and passed and adopted on its second and
final reading by the following vote: AYES: Messrs. Romfh, Leffler, Lummus, Wil-
son. NOES: None. The said ordinanoe is numbered 452 and is shown in full in
Ordinance Book 1.
INVITATION TO AM. SOCIETY FOR MUNICIPAL IMPROVEMENTS ENDORSED BY COMMISSION
The Aoting City Manager submitted the following communication in reference to in-
vitation extended to the American Society for Municipal Improvements:

Gentlemen:
The Chamber of Csmmeroe advise that they have a letter from
the American Society for Munioipal Improvements to the effect that
the Association would be pleased to hold a Convention in Miami at
some near future time.
The Chamber has asked that I personally extend an invitation
to the Society, and that I have this invitation endorsed by the Ci-
ty °omission.

dorsing my invitation?

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI:
That the invitation of Aoting City Manager Ernest Cotton to the Am-
erioan Society for Munioipal Improvements to hold a Convention in Miami
at some near future time be, an the same is hereby, endorsed by the Com-
mission of the City of Miami.

PURCHASE OF SEWER PUMPS AUTHORIZED WOODS TRASH PUMPS
The Acting Oity Manager submitted the following oommunioation in reference to pur-
chase of pumps for sewer installation:

City Commission.
Gentlemen:
I attaoh hereto letter from D. L. Wilson, Division Engineer of
Sewers, regarding pumps for sewer installation on NW 7th Avenue and
32nd Street, NW 7th Avenue and 23rd Street, NW 13th Avenue and 6th
Street, and NW 6th Avenue and 17th Street. Our estimate on these
different Sewer Distriote oarried with them the oost of pumping units,
and the pumping units we wish to install are manufactured by one oon-
oern only, this being the Woods Trash Pump, as manufactured by Fair-
banks -Morse Company. It is impossible to get bids from other manu-
facturers on this samesquipment, and I would recommend that the City
purchase the Woods Trash Pump as proposal attaohed.

BIDS FOR PAVING, SIDEWALKS AND SEWERS
RECEIVED
This being the date set and advertised for the reoeption of bids for street paving
under Highway Improvements 264 to 268, both inolusive, sidewalk paving under Side-
walk Improvements 58 to 62, both inclusive, and sanitary and storm sewers under
Sewer Improvements123 to 127, inclusive, 128, 129 to 133, inclusive, 134 to 137, in-
olusive, 140 to 144, inclusive, and 145, at 3:00 o'olook P. U. the bids received
were, on motion duly made and seconded, ordered opened and read. And :It appearing
necessary to tabulate the bids received to determine the lowest and beat bidders for
the work, on motion of Mr. Lummus, seconded by I:Ir. Wilson, the bids were referred to
the Acting City Manager for the purpose of tabulating same and with instructions to

LEAVE OF ABSENCE FOR COMMISSIONER LEFFLER
FROM THREE REGULAR MEETINGS
Commissioner C. D. Leffler asked permission for leave of absence to carer three re-
gular meetings of the Commission and on motion of Mr. Lummus, seconded by Mr. Wil-
son, it was resolved that Commissioner C. D. Leffler be excused from attendance of
three regular meetings of the City Commission beginning with the next regular meet-
ing on September 7th. 0n roll oall the vote thereon was as follows: AYES: Messrs.
Romfh, Leffler, Lummus, Wilson. :TOES: None.
PREPAR#TION OF BALLOT BOXES FOR SPECIAL ELECTION FOR EtTENSION ENSIGN OF MIAMI CITY LIMITS•
The Commission proceeded to prepare the ballot boxes to be used in the forthcoming
special election to be held on September 2nd, 1925, for the purpose of voting on the
proposed extension of the L2iami City Limits by the annexation of certain adjacent
territory, by piaoing in the ballot box or boxes for eaoh Precinct twioe as many of-
ficial ballots, caused by them to be printed, as there are registered qualified vo-
ters in eech preoinot eligible to vote in the election; and the said ballot boxes
were plainly marked and labeled with the name of the election and the preoinot for
which it is intended. After securely locking said ballot boxes, sealing up the key-
holes thereof and all other openings, the Commission did send the keys thereof in a
sealed envelope to the inspectors of said election together with the said boxes.
ADJOURNMENT
There being no further business to oome before the Commission at this meeting, on
motion duly made and seconded, the meeting was adjourned.
