BLORIDA. On this 17th day of Marab, A. D. 1926. the Commission of the City of Miami, Flori- da met in regular session at the City Hall in Miami, Florida. The meeting was called to order at 9:00 o'olook A. M. by Aoting Chairman C. D. Leffler, who, on motion of Mr. Lummus, aeoonded by Mr. Wilson, was eleoted Acting Chairman in ab - senoe of Mr. B. C. Romfh by the following vote: AYES: Messrs. Lummus, Wilson, Gil- man, Leffler. NOES: None. Tbe following members of the Commission were present: C. D. Leffler, J. E. Lummus. J. I. Wilson, J. H. Gilman. ABSENT: B. C. Romfh. READING AND APgROVAL OF MINUTES OF MEETING OF MOOR 1Q Tbe Clerk reed the minutes of the meeting of Marob 7.Otb. 1926, and there being no corrections or additions to be made thereto, on motion duly made and aeoonded, the same were approved and oonfirmed as written. SITE FOR "HUT" FOR BOY SCOUT TROOP #2 RIMIEST FOR SPACE IN OITY PARK Mr. Casper Hefty and Ur. Reese Combs appeared before the Commission in roferenoe to a site for a meeting place for troop #2 of the Boy Soouts which, according to Mr. Hefty, is the oldest troop in the state and would probably have to be disbanded un- less they oould secure a plane for their meetings. Mr. Hefty stated that it bad oo- ourred to him that the City might allow them to use a spade in the oity park at 19tb Street North between NE 2nd Avenue and North Miami Avenue to erect a "but" on to be need for meeting purposes, the but to be built at the expense of the snout troop and to be so oonetruoted that it might be removed should it beoome necessary in the fu- ture. Mr. Hefty further stated that the "hut" might be arranged to provide a rust room and shelter for those using the tennis courts in the park. The matter was dia- ouseed and it was deoided, to refer name to the City Manager to get the neoessary de- tails in oonneotion with looating the "hut" in the City Park. and Messrs. Hefty and Combs were asked to submit a ekctoh of the proposed hut at a future meeting. ACCEPTING DEDICATION OF STREETS AND AVENUES IN NEW SUBDIVISIONS The Direotor of Public Servioe submitted certain plate of proposed new subdivisions whioh be had approved as complying with all the provisions of the Charter and the rules and regulations of the Department of Publio Service. And the said plate show- ing the tedioation of oertain streets and avenues to the use of the public the same were accepted by the following ordinances. On motion of Mr. Lummus, aeoonded by Mr. Gilman, it was resolved that the obar ter requirement that all ordinanoea be read on two separate days. unless dispensed with by a four -fifths vote of the Commis- sion, be dispensed with and that the ordinanoea be paaeed and adopted and given both readings at this meeting. The vote thereon was as follows: .AYES: Mesere. Leffler; Lummue, Gilman, Wilson. NOES: None. Thereupon, upon motion of Mr. Wilson, aeoond- dd by Mr. Lummus, the ordinanoe entitled: AN ORDINANCE ACCEPTING THE DEDICATION OF THE STREETS AND AVENUES IN THE SUBDIVISION KNOWN AS "LA ALLAPATTAH-AMENDED PLAT" was introduced by Mr. Wilson and given its first reading by title only and passed on its first reading by the following vote: AYES: Messrs. Leffler, Lummue, Wilson, Gilman. NOBS: None. On motion of Mr. Wilson, seconded by Mr. Gilman, the ordi- nance was given its aeoond and final reading in full and was passed and adopted on its second and final reading by the following vote: AYES: Messrs. Leffler, Lummus, Leffler, Gilman. NOES: None. The said ordinanoe is designated Ordinanoe No.365. FOR STREET IMPROVEMENTS The City Manager submitted the following oommunioation in referenoe to oertain assign- ments against the F. E. C. Ry. 0o. for street improvements: March 17, 1926. City Oommiseion. Gentlemen: The City is in receipt of a obeok from the Florida East Coast Railway Company in the amount of $22,877.08 in fill settlement, leas the aooruod interest, on the following liens: Sidewalk lien assessed Marob 6th,1923, against the El of the NE* lying West of right-of-way lees the South 521.4 feet. of Seotion 26-53-41, subdi- vision Wyndwood Park. Front feet 2146.10, amount $2061. 76. Street paving lien assessed September 2nd, 1924, against property of the Florida East Coast Railway Com- pany from 29th Street north to 36th Street north, in the amount of $20,816.33. In view of the faot that the Florida East Coast Railway Company gave 10 feet off their property from 29th Street north to 36th Street north, I would recommend in consideration of this that the check be aooepted as pay-. ment in full, and that the Direotor of Finance be author- ised to oanoel the interest oharge. A RESOLUTION ACCEPTING A CHECK IN THE AMOUNT OF 429,877.' 08 IN THE FULL PAYMENT OF THE IMPROVEMENT LIENS SET OUT IN THIS RESOLUTION AND AUTHORIZING THE CANCELLATION OF THE ACCRUED INTEREST ON SAID LIENS. WHEREAS, the City of Miami has assessed certain sidewalk and street paving liens as of Marob 6, 1923 and September 2, 1924, against the pro- perty of the Florida East Coast Railway Company from 29th Street North to 36th Street North and also against the East * of the Northeast* lying West of right-of-way less the South 621.4 feet, of Seotion 26-63-41, Sub- division Wyndwood Park in the total amount of $22,877.08, and, WHEREAS, a ten -foot strip from 29tb Street North to 36th Street North was appropriated from the property owned by the Florida East Coast Railway Company in widening North Miami Avenue and was used by the City of Miami in widening North ML.ami Avenue; NOW, THEREFORE, BE IT RESOLVED by the Commission of the City of Mi- ami: Seotion 1: That the obeok in the amount of $22,877.08 wbiob re- presents the amount of the sidewalk and street paving liens be, and the same is hereby accepted in full settlement of same. Seotion 9: That the interest on the sidewalk and Street paving liens, be and the same is hereby, waived in oonsideration of the 10-foot strip between 29tb Street and 36th Street North, owned by the Florida East Coast Railway Company, being given to the City of Miami in the wi- dening of North Miami Avenue, and the Direotor of Finance is hereby au- thorised to oanoel the aoorued interest upon said ooneideration. REWARD FOR CAPTURE AND CONVICTION OF SLAYERS OF POLICE SERGEANT L. L. NEVER The City Manager presented the following communication reporting the death sergeant L. L. Weyer of the Motorcycle Division of the Polioe Department whiob was read and ordered oopied upon the minutes of the meeting: Marob 17th, 1926. City Commission. Gentlemen: It is with Badness I report to you the tragio and un- timely death of Sergeant L. L. Weyer, Head of the Motorcycle Division of the Polioe Department. Sergeant Weyer was shot down while in the disobarge of his duties by desperadoes,, their identity not being positively known by the Polioe offi- cials and their oaptUre not yet affected. Everything possi- ble ie being done to locate the murderers and with some slight olues and euepioiene to work on there is some hope that they may be captured. Tragic incidents of this kind always bring Badness and gloom over a oommunity, but seldom do you see that sadnees and gloom so universal as in this particular case of Sergeant Weyer. He has been a most faithful publio servant, was esteemed and respected by all hio brother offi- oers and bad en unusually large number of friends and admir- ere who mourn this terrible tragedy. I would recommend that the City offer a suitable reward, say $2,00C) for the capture and evidence to convict the guilty parties. RESOLUTION NO. 1903. A RESOLUTION AUTHORIZING} THE PAYMENT OF THE SUM of TWO THOUSAND DOLLARS FOR THE CAPTURE AND SUBMISSION OF EVIDENCE TO CONVICT THE SLAYERS OF SERGEANT L. L. WEVER, OF THE MOTOR DIVISION OF THE POLICE DEPART- MENT. ADDITIONAL APPROPRIATIONS TO PUBLIC SERVICE DEPARTMENT r The following oommunioation from the City Manager in reference to additional appro- 1 priations neoesaary to be made to the Department of Public Service was submitted and I.; i read: Mr. F. H. Wharton, City Manager, Miami, Florida. Dear Sirs Maroh 16th, 1925. City Commission. Gentlemen: I am attaohing hereto a letter from the Director Of Publio Service setting forth the needs for his Departments covering the balanoe of the fiscal year. In this letter be has set out in detail the work in eaoh division, and the neoeasity of asking for additional funds to oomplete the year's activities. The total appropriations asked for in his letter amount to $60,432.51. This seems to have been a bad guess when the bud- get was made up, but in view of the inoreased amount of work now being done by these departments, and which oould not be fore- seen when the budget was prepared, these additional appropria- tions asked for seem to be reasonable. For instanoo the Divi- sion of Streets expended $44,710.30 for extra work which could not be Considered as ordinary street repairs, and whioh was not forecast when the budget was made up. Again wages had to be increased in all divisions to meet competition, and additional men bad to be employed to meet the inoreased requirements. This item alone threw all the divisions short in their "Salaries and Wages" a000unte as was provided by the budget, I have gone over these matters with the Director of Publio Servioe and will ask that you make the additional appropriations and the transfers as set forth in his request. I am attaohing hereto statement showing additional appro- priations and transfers required to run the various Divisions of the Publio Servioe and Welfare Departments until June 30th, 1925. These appropriations and trandfers are made neoeasary by reason of increased aotivitiea in all branches of our Depart" ments, and were suob that none of us were able to antioipate suffioiently by reference to previous years' budgets. i 1 1 e 1 i J ■ 1 a 1 Marob 17th, 1925. In the Division of Plumbing, we find that the fees aolleoted and the work performed show an inorease of approximately 25* over previous period of last year. This same holds true in the Divi- sion of Building Inepeotor and Eleotrioal Inspector. In the Division of Comfort Stations, the Lights, Water and Plumbing bills have been unusually heavy, owing to inoreased num- ber of visitors and users of these stations. In the Division of Streets, the budget was figured on a bas- is of general wear and tear. The unusual amount of street repairs made necessary by Utility oorporations' exoavations, was not taken into oonsideration. We find that in this Division the following work has been taken care ot, other than ordinary weer and tear: Street exoavations oharged to Utilities and remitted to the General Fund: $21,512.45 Repairing streets for sewer contraotora 6 869 40 Work at City Dook 761 50 W. Flagler St. Railway Crossing. . . . . . .721.76 Exoavationa at new Junior High School NW8th Av2,875.40 Repairing streets out by Water Company, for which we were unable to make obarge. . . . 11,969.79 TOTAL $44 710 36 In the Division of Sewer Maintenanoe, we have bad to inorease our maintenance foroes to take care of additional oatoh basins and a better cleaning of sewers in the business distriot. We have been put to oonaiderable additional expense owing to failure of hotels, reetaurante, apartment houses, etc., to install grease traps, whioh resulted in an almost oontinuous ologging of sewers. This, however, is being handled for an improvement. In the Division of Street Cleaning, we have re -arranged our handling of this whioh we believe will result in a very much im- proved service, and have employed additional and more competent men. In the Division° of Garbage 8: Trash, Incinerator and Garbage Disposal. and Soavanger Service, we have bad to inorease the pay of laborers to meet competition, and have also inoreased the aerviOe by additional trunks. In the Division of Dooks, theLighte, Water and Ioe costs have been unusually heavy owingto increased shipping aotivities. However, we have in turn oolleoted additional monies for the faoilities sup- plied and remitted increased revenues to the Finanoe Department for oredit to the General Fund. In the Division of Garage, we have had to take oars of addi- tional automobiles from the various Divisions. In preparing this budget, the oost of operating the Blaokemith Shop was not included, and in fact the appropriation was aby by the amount it took to op- erate this Shop the previous year. WELFARE DEPARTMENT: We find that we underestimated the appropriation for the Divi- sion of Health by $360.00. Owing to additional work at the, Baseball Grounds, and all City parks, this Division has exceeded our antioipations. We will have euffioient funds in our A000unt B-39-A to take care of the Slat House work. We are going ahead with Bay Front Park, NW 36th Street and Roque Courts work, which is being oharged to Park Bond Fund. As the balance in some of the above accounts are praotioally exhausted, I shall be glad if you will arrange for these appropria- tions and transfers to be taken care of as early as possible.
