MINUTES OF THE MEETING OF THE COMMISSION OF THE CITY OF MIAMI, FLORIDA. On this 13th day of January, A. D. 1925, the Commission of the City of Miami, Florida, met at the City Hall in regular session. In the abeenoe of Chairman E. C. Romfh, Mr. Lummus nominated Mr. C. D. Leffler Aoting Chairman, which was eeoonded by Mr. Gilman and oarried by the following vote: AYES: Messrs. Lum- mus, Gilman, Leffler. The meeting wee oalled to order at 9:00 o'olook and on roll oall the following members were present: J. E. Lumina, J. H. Gilman, C. D. Leffler. ABSENT: E. C. Romfh and J. I. Wilson. READING AND APPROVAL OF LMINUTES OF MEETING OF JANUAHY 6TH The Clerk mad the minutes of the meeting of January 6tb, 1925, and there being no oorreotions or additions to be made thereto, on motion duly made and seoonded, the minutes were approved and oonfirmed. CORRECTION OF ASSESSMENTS AUTHORIZED BY COMMISSION The City Manager submitted the following oommunioation from the Direotor of Pu- blio Servioe addressed to him in reference to the adjustment of oertain assess- ments for improvements: Miami, Florida, January,5, 1925. Pile 139-Sks'l. Mr. P. H. Wharton, City Manager, Miami, Florida. Dear Sir: Mr. J. C. Smith, owner of E. 60' of W. 120' of Lot 2 Blook 2 and the W 60' of Lot 2 Block 2, Nanoy Terraoe, asks for an adjust- ment in Cnrb and Gutter Assessment on Preliminary Assessment Roll oovering District H-235. This is a case where Roll was made up be- fore the work was done, and the foot that ourb was already in, was for some reason, not taken into consideration. TUBERCULAR WARD AT HOSPITAL CALL FOR BIDS AUTHORISED The City Manager submitted the following oommunioation addressed to him from Mr. E. B. Douglas, Chairman of the Hospital Board, in referenoe to the proposed oonetruo- tion of a White Tubercular Ward Building at the Jackson Memorial Hospital: Miami, Florida, January 10, 1926. Leffler objected to the construction of a atu000 building for the Tubercular Ward and after some dieoueaion it was deoided by the Commission not to au- thorize the building constructed with stucco finish but to have the building oonstruo- ted of hollow tile or oonorete blocks and a resolution authorizing the City Manager to advertise for bids for the oonstruotion of the said building was introduoed by Mr. Gil- man: Mr. F. H. Wharton,' City Manager, Miami, Fla. Dear Mr. Wharton: I am handing you herewith plans and apeoifioations for a Tu- beroular Ward for white patients. In order to economize on this building, we have planned a frame oonstruotion with etu000 finish. It is to be looated fully fifty feet from any other building. I believe, however, that we will have to have a speoial permit to allow us to construct this type of building. The estimated oost is about, 6000.00. If there is no oppo- sition on the part of the commissioners, I would be glad if you advertise for bide for the ereotion of this building as early as possible. Thanking you in advanoe for giving this matter your prompt attention. I am RESOLUTION NO. 1A05. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR BIDS FOR THE CONSTRUCTION AND ERECTION OF TUBERCULAR WARD BUILDING AT JACKSON MEMORIAL HOSPITAL. WHEREAS, the Chairman of the Hospital Board has recommended the ereo- tion of a building for the purpose of serving as Tuberoular Ward for white patients, and WHEREAS, after due ooneideration it is the sense of the Commission of the City of Miami that the building should be erected at once. THEREFORE. BE IT RESOLVED by the Commission of the City of Miami: That the City Manager be, and he is hereby authorized and directed to advertise for bids for the ereotion and aonstruotion of the Said building, said bids to be received until 9:30 o'olook A. M., Tuesday, January 27th, 1925. On motion of Mr. Gilman, seconded by Mr. Lummue, the resolution was passed and adopted by the following vote: AYES: Messrs. Leffler, Lummus, Gilman. }MAYES: None. TRANSFER OF APPROPRIATED FUNDS SAFETY DEPT. FIRE DIVISION The City Manager submitted the following request from the Chief of the Fire Department for a transfer of funds within the Fire Division of the Safety Department to Dover part of the oost of installing Rudd Automatio Heater: Miami, Florida, January 12, 1925. Mr. F. H. Wharton, City Manager, Miami, Fla. Dear Sir: I reapeotfully request that a transfer of Fifty (50) Dollars be made from 272-34 to 272-75 to oover Rudd Automatio Heater, oost of which is one hundred sixty-two (162) Dollars. At the present time we have an unimoumbered balanoe of one hun- dred twenty-five (125) Dollars sixty-seven (67) oente in account 272-75. Very reapeotfully yours, ($igned) W. R. A RESOLUTION AUTHORIZING THE TRANSFER OF OERTAIN APPRO- PRIATED FUNDS IN THE FIRE DIVISION OF THE DEPARTMENT OP PUBLIC SAFETY. BE IT RESOLVED by the Commission of the City of Miami: That the Director of Finanoe be, and he is hereby, authorized and direoted to transfer of the sum of $50.00 from A000unt 272-34 to A000unt 272-75, in the Fire Division of the Department of Public Safety. 0n motion of IIr. Lummus, seoonded by Mr. Gilman, the resolution was paased and ad- opted by the following vote: AYES: Messrs. Leffler, Lummus, Gilman. NAYES: None. REPORT OF 'JACKSON MEMORIAL HOSPITAL FOR MONTH OF DECEMBER The City Manager submitted the report of Mrs. Ainab Royoe, Superintendent of the Jaokson Memorial hospital, of the affairs of the Hospital for the month of Deoem- ber whiob was read. It was the opinion of the Commission that the reports of the Hospital should show a charge for operating expenses for the month against the re- oeipta so that the defioit for each month might be known. Thereupon the report was referred to the Director of Pinatas with instructions to prepare a form to be used for the Hospital Reports hereafter whioh will show snob information. PRELIMINARY ASSESSMENT ROLLS ORDERED PREPARED A resolution directing the City Manager to prepare Preliminary Assessment Roils for Sanitary Sewer Improvements Nos. 70, 73, 74, 76,77, 67, 72, 78 and 75, was in- tro duoed by Mr. Gilman and is as follows: • RESOLUTION NO. 1808. A RESOLUTION ORDERING THE PREPARATION AND FILING OF PRELIMINARY ASSESSMENT ROLLS FOR WORK COMPLETED UNDER CERTAIN SANITARY SEWER IMPROVEMENTS"AND DIRECTING NO- TICE FOR OBJECTIONS TO THE CONFIRMATION THEREOF. WHEREAS, the oontraot entered into for the improvement of cer- tain streets by the construction of sanitary sewers, has been pro-, perly and completely done and said work aooepted by theCommission of the City of Miami, NOW, THEREFORE, BE IT RESOLVED by the Commission of the City of Miami: 1: That the City Manager be, and he is hereby, directed to make and file with the CityClerk a preliminary assessment roll of Sanitary Sewer Improvements Nos. 67, 70, 72, 73, 74, 75, 76, 77 and 78. 2: That upon the filing of said preliminary assessment roll$, the City Clerk cause notice to be given in a newspaper published in theCity of Miami twioe weekly for two weeks, stating that at a meeting of the Commission of the City of Miami to be held on a oer- tain day and at a certain hour, not less than twelve days from the date of the first publioation, any person whose property is des- oribed in said rolls may appear and file written objection to the oonfirmation of the said rolls. W. 7TH STREET PETITION FOR FILED A petition signed by property owners and residents in thevioinity of S. W. 7th Street and the F.E.C.Railway requesting the oonetruotion of an underpass at S. W. 7th Street was reoeived at this meeting and after being read was ordered filed. #f • A' • ) Je,nuary - 13, 1925. e CANVASS 0I' RETURNS OF ELECTION ON FRANCHISE HELD JANUARY 6TH At this meeting the returns, the oertifioate of the three 1.napeotore and the clerk, the oaths of office of the said inspectors and olerk, the tally sheets and ballots, of the 8peoial Eleotion held on Tuesday, January 6tb, 1925, having been delivered to the Commission on the Speoial Eleotion held on saiddate for the following purpose: Shall Ordinance No. 281, adopted by the City Commission of Miami, Florida, on November 4th, 1924, entitled: "An Ordinance granting to Florida Power & Light Company, its euooeseors and assigns, the right, privilege or franchise for the full period of thirty years to oonetr uot, maintain, equip and operate a gas plant and works, gas holders, and all neoes- .sary or desirable appurtenances forthe.manufaoture and/or storage of gas in the City of Miami, Florida, and to oon- struot, equip, operate and maintain, in, under, upon, over. and aoroes, alleys, highways, bridges, easements, and other public plaoes in the City of Miami, Florida, and its euo008- more, gas mains and supply pipes together with all the neoes- sary or desirable appurtenances for the purpose of conveying,. dietributing, supplying and selling gas to said City and its successors, the inhabitants thereof, and to pereona and oor- porat ions beyond the limits thereof, for light, heat, power and other purposes, imposing provisions and conditions relat- ing thereto, and inoludin g an agreement by grantee to indemni- fy and hold the said city harmless against any and all liabi- lity, loss, post, damage or expense whioh may aoorue to said oity by reason of the neglect, default or misoonduot of the grantee in oonneotion with the exercise of its rights, here- under", granting a gas franchise to Florida Power & Light Company, its suo- oessore and assigns, be approved? And thereupon the City Commission did canvass the said election returns and do certi- fy that the same are in every respeot regular grid do oertify the result of the said eleotion to be as follows: That the total number of ballots cast at said election upon the said Qaestion were 675; that 615 votes were oast FOR the approval of the franchise and 60 votes were oast AGAINST the approval of the said franchise; and that NO ballots were thrown out and not oounted on a000unt of being marked on the wrong side or otherwise defaced or spoiled. On motion of ISr. Lummus, seconded by Mr. Gilman, it was resolved that the Commie- sion finds and certifies that the question hereinabove set forth was duly voted for and parried by a majority of the qualified electors of the City of Miami, Florida, as required by law at the Spsoial Eleotion held January 6th, 1925, and that the returns of the inspectors and olerk are found to be oorreot. On roll pall the vote thereon was as follows: AYES: Messrs. Leffler, Lummus, Gilman. NAYES: None. Thereupon the returns of the said inspectors and the clerk, including the ballots, tally sheets, oathsof offioe acid oertifioates of eleotion were replaoed in the ballot box and the same sealed and delivered to the City Clerk as custodian thereof. CONFIRMATION OP RESOLUTIONS AUTHORIZING IMPROVEMENTS Pursuant to legal notice that all objeotions presented by interested persons to the confirmation of the resolutions adopted Deoemb er 23, 1924, authorizing Highway Im- provements Nos. 245 to 263, inolusive, Sanitary Sewer Improvements Woa. 104 to 119, inolusive, and Nos. 121 and 122, Storm Sewer Improvements Nos. 103 and 120, Lateral Improvement No. 3, Sidewalk Improvements Nos. 55, 56 and 5/, and Pumping Station for Sanitary Sewer Distriota 110 to 119, inolusive, and the plans, speoifioations and es- timates of oost thereof, wouldebe heard, it was announced that, the Commisebn was ready to receive and 'consider the objections of any interested person thereto. There being no objections to the confirmation of the resolutions ordering said improvements or to the plans, specifications and estimates of cost thereof, the resolutions order- ing the said improvements were oonfirmed by the following resolutions of the Commis- sion: A re9o1 ution confirming the resolution ordering Highway Improrernent No. 245 was introduced by Mr. Lummus and is as follows: RESOLUTION NO. 1809. Miami: That the said resolution, plans, epeoifioations and estimate are hereby oonfirmed. 0n motion of Mr. Lummus, seconded by Mr. Gilman, the resolution was passed and adopted by the following vote: AYES: Messrs. In the matter of the new warehouse whioh was"reoently au- thorized by the City Commission, it was estimated that this ware- house, with roadway and railway oonneotions, would oost approxi- mately $75,000. It will be necessary for the Commission to appropriate the money to do this work, and I will ask that you pass a resolution making the appropriation out of whatever funds the Director of Pinanoe may determine can be best used. WHEREAS, it is urgently necessary to Construct at the City Dooks a warehouse for whioh there are no funds at this time available. and WHEREAS, it is deemed advisable And proper to borrow the neoes- sary money from such other funds at the City that the Director of P1- nanoe may determine can be best used for the purpose and to reimburse same when the money is available, NOW, THEREFORE, BE IT RESOLVED by the Commission of the City of Miami: 1: That the Direotor of Finance be, and he is hereby, authoriz- ed and directed to transfer the sun of $75,000.00 from suoh City Funds as he may determine oan be beat used for the payment of the cost of warehouse now under construction at the City Dooks.' 2: That the said sum of $75,000 so transferred be returned to the respective funds from whioh it is borrowed when the funds there- for are available.
