SECOND FIC)111C)Af" AVENUE AND THIRTY-THIRD STREET. - WHEREAS, Thos. C. P. O'Brien doodad to the Oity of Miami under date of January 31, 1922, a strip of land 10' wide off the west end of hie property at N. B. Sec- ond Avenue and Thirty-third Street for street purposes, and, WHEREAS, in consideration of the deeding of the above desoribed property to the City the City agreed to move the stone wall back to the property line and con- struct a sidewalk without cost, and WHEREAS, the sidewalk was constructed and by error was charged against the property, NOW, THEREFORE, BE IT RESOLVED by the Commission of the City of Miami: That the Director of Finance be, and he is hereby, authorized and directed to cancel that certain lien against the property of Thos. C. F. O'Brien in the sum of 4290.36 for sidewalk improvement. PASSED AND ADOPTED this 14th day of October, A. D. 1924. '77 "DOCUMENT INDEX ITEM NO. ATTEST: 71- w. Miami a 10' strip off the West end of his property, for the pur- pose of widening N. E. 2nd Avenue. In oonsideration of this deal the City agreed with Mr. O'Brien that the City would move the done wall back to his property line,and would construct the sidewalk without any cost* to him. The sidewalk was put down and by an error was charged. against the property. In order to clear the matter up I would ask that the City Commission pass a resolution cancelling this lien, amount- ing to $290.36, in compliance with the 'contract intered into with Mr. O'Brien. Pursuant to our conversation a few days ago, ~ we are writing you with reference to a sidewalk lid assessed against the "O'Brien Property" on N. E. grid Avenue and 33rd Street, dated November 15, 1923 in the sum of $290.36. This lien is erroneous, as Mr. O'Brien has a written agreement from the City of date Jan 31, 1922, recorded in Deed Book 283, at Page 326, in which the City agreed to construct this sidewalk and do other work at its own expense, in consideration for the conveyance by Mr. O'Brien to the City of Ten feet along the front of his said property, for street purposes. The agreement refers to resolution adopted at a regular meeting held on Tuesday, January 24, 1922. We will thank you to bring this matter to the attention of the Commissioners at their next meeting, and have the lien officially cancelled. Your attention to the above will be greatly appreciated.
