WELSREL8, by an agreement dated the 25th day of June, A. D. 1924, by and between Maude E. Briokell, Prank 01ark, William B. Briokell, as executors of the estate of Mary Briokell, de- oeaeed, as parties of the first part, and William B. Briolooll, Charles O. Brickell, George M. Briokell, parties of the second part, and Maude E. Briokell, Alice A. Briokell and Belle G. Briokell, parties of the third part, it is mutually agreed that the parties of the first part agree to convey to the parties of the third part thereto sixty-two and one-half (62) feet appro- ximately of the East side of Lot One, Block 103 South, and the parties thereto agree and bind. themselves by written agreement to ratify and confirm such deed by said executors, which said deed, when properly exeouted, is to be delivered to Walter L. Harris of Miami, Dade County, Florida, and WHEREAS, the parties of the third part thereto have bound themselves and agree, immediately upon the exeoution of the deed above referred to, to oause to tie executed to the City of Miami a deed ooverin.; all that portion of Lot one, Block 103 South, which said deed is to be made to the City of Miami, Flori- da, and the said city, through its duly constituted authorities, will properly maintain, provide and keep in condition a private burial ground; NOW, '2HBRFFORB, BE IT RESOLVED BY THE COMMISSION CF THE CITY OF MIAMI: 1: That the City of Miami hereby accepts the trust of improving and oaring for the family burial ground, and agrees that the work of beautifioation shall start immediately. Mary Briokell, deoessed, from the duty of. oaring ter and altinsi taining the privateburial ground, consisting of that certain strip of ground in Block 103 South as shale on that certain plat recorded in Plat Book 8 at Page 93 at the public r000rds of Dade County, Florida, in the office of the Oledc of the Oird. (suit Court in and for Dade Count', Florida, which said strip of ground haa been surveyed and platted and is to be forever held in trust as a private burial ground for Mary Brickell, deoeased, and the members of the Briokell Family. 3: That the said City of Miami 113 to bear all the expense of improving and beautifying said park and burial ground, and agrees that guff latent money be administered in the perpetual oare and upkeep of the plaoe, parcel or part of ground so de- dicated as a burial ground of the said Mary &tokell, deceased. This strip of ground bens of _a monument on Brickell Avenue, said monument beingat the:.. corner of the Riokmers property, and directly aervbo.tram the north line of Sixth Street, Southeast, runs north for. a distance of 125 feet, 8 inches thence easterly to Biscayne Bay, thenoe southeasterly along Biscayne Bay for:_% a distance of 121.9 feet to the said. Riokners line, thence -- westerly for a distance of practically 670 feet, 6 inches, to Brickell Avenue, to place of beginning; together with,: the riparian rights thereon, a better description being. unavailable at this writing. This park is given by the heirs of the late Mary Brickell for the express purpose that it be used as a city pari:, and with the express understanding that the Oity of Miami is to pass proper resolutions and ordinances to accept the trust of improving and perpetually caring for the family burial "round which adjoins this ground immediately on the north, a plat of all of which has heretofore been made and is attached hereto. The City of Miami is to boar all of the expense of i iprovinand beautifying, and the said work is to be started immediately and to the satisfaction of myself as representative of the Brickell heirs in the matter afore- said. As soon as proper resolutions have been passed accept- ing this trust, and. also acceptin,.- the plot and parcel of ground for park purposes, and upon the completion of the work, a deed will be handed to the City, that has previously been approved bar tfe City Attorney and upon the acceptance of this trust a cleecl will be delivered to me by the Brickell heirs, coverin-: the Pro?erty, to be held in trust until such work and such ordinances have been completed.
