WHEREAS, the City Manager reports that it was necessary for the Oliver Ice Company to construct certain sewers in order to take Dare o.1 the over -flow waters from their faotory before the City of Miami was in position to construct storm sewers under Storm Sewer District No. 80, and WHEREAS, the sewers constructed by the Oliver Ice Company form a part of the storm sewer system under District 80, which district was created and improved by the City of Miami subse- quent to the installation of the sewers by the Oliver Ice Com- pany, and the cost thereof assessable aga 1 nst the property bene- fited thereby, and WHEREAS, the City Charter provides that allowances may be made to property owners for improve!aents previously made by such pr operty owners to the extent that said existing improvements shall be of value and utility as a part of the improvements for which such assessment is made, and wHEREAS, it hes been determined that the value and utility of the sewers installed by tha Oliver Ioe Company amount to the sun of , 2,53?.42, NOW, THEREFORE, BE IT RESOLVED by the Commission of the City of Miami: 1: that the Director o f Finance be, and he is hereby, au- thorized and directed to p..y to the Oliver Ice Company the sum of �22, 537.42 in ullowance fer torm sewers constructed by them and subsequently included as part !f storm sewer district No. 80 'by the City. 2: That the said sun of 2, 537.42 be paid from the bond fund for the improvement of said Storrn Sewer ,District No. 80. • • it r - r oar ' i PASSED AND .iDOPTED this 24 th lost of June, A.D. 1924. : l -`/�Iiut I ATTEST:- 0 ff CLERK S C TIN G L AY O gas eerie OP CITY MANACIMPI To the City Commission Miami, Florida Gentlemen: P. Storm Sewer District No. 80 In the matter of Storm Sewer District No. 80, these plans were worked out several years ago by Mr. Murray, then City Engineer, but the city was not in a position at that time to construct these storm sewers. When the Oliver Ice Company located their factory on N. W. 14th St. and let Ave. it was absolutely necessary that a part of this storm sewer system be put in at once in order to take care of the over -flow waters from this factory. The Oliver Ice Company was forced to install a part of these storm sewers in order to take care of their over -flow of water, and to advance the cost of same until such time as the city could complete the entire district, and make out Preliminary Assessment Rolls on the benefited property. Dear Sifts The original Resolution for Storm Sewer District Mo. SO covered a 1$a sewer an I. V. Miami Court from 13th to 14th Streets, with a 15' sewer on 14th Street, from North Miami Avenue to 1. W. Miami Court. That portion of the sewer on 71,.11.14th Street, from 1. W. MlaUl Court to the jog in this street and also that portion on R. W. Miami Court from 1 th to 14thh Street was installed, in 1921, by the Oliver Ise Company, under City inspection. The plans for this District were formulated prior to 1921, but the original Resolution and actual map showing this District were not made until during the last halt of 1923, subsequent to which bids were requested and contract let for the work to the Davis Construction Company. The question that now arises is this: are we entitled to pay the Oliver Ice Company for the portion of this Storm Sewer that they installed at the same units as were bid an by the Davis Construction Company and further are we also entitled to make up our Preliminary As:esc ent Roll based on the money paid the Davis Construction Company plus an amount which we would pay, if permissible, to the ©liver Ioe Company. It would seem to me that in as much as that portion of the sewer built by the Oliver Ice Company was contained in the resolution delineate the Cork to be done, that we would have the r+ g'ot to reimburse the Oliver Ice C :r any and also include this aar,unt in the total for the whole District and base our Preliminary Aseess:ent Roll on this total cost.
