MINUTES OF THE MEETING OF Tun BOARD OF OOMMISSIONERS OF THE CITY OP MIAIMI, FLORI1*.
On this 20th day of May, A. D. 1924, the City Commission of the City of Miami,
Florida, met in regular session at the City Hall in Miami, Florida. The meeting
was called to order at 9:00 o'clock A. M. by Chairman E.O. Romfh and on roll. oall
the following members were present:
E. C. Romfh, J. E. Lu cue, J. I. Wilson, J. H. Gilman, C. D. Leffler.
ABSENT: None.

OP MEETING OF MAY 13TH
The Clerk read the minutes of the meeting of May 13th, 1924, and there being no
oorreotlone or additions to be made thereto, on motion duly made and seconded, the
minutes were approved and aooepted ae written.
REPORT OF CITY ATTORNEY IN RE: DECISION OF SUPREME COURT
The City Attorney submitted the following written report of the decision of the
Supreme Court in the case of the City vs. Miller whioh, after being read, was order-
ed filed and ()opted upon the minutes of the meeting:

Gen tlamen :
I have received notice from the Supreme Court that the va-
lidity of the "tent oity" Ordinance of the City, regarding sanitary
regulations for "tent pities" looated within the oorporate limits of
the City, has been sustained.
In this case, W. 2. Miller, was tried in the Municipal Court
on the charge of violating this Ordinance, by failing and refusing to
provide certain sanitary facilities. The validity of the Ordinance was
tested by a writ of Habeas Corpus before the Circuit Judge, who sus-
tained the validity of said 0rdinanoe and an appeal was taken from his
ruling to the Supreme Court, and the validity of same was also upheld
by the Supreme Court.

PETITION TO CLOSE STREETS S. W. SOUTH RIVE DRIVE
The following communication from property owners in the territory affected request-
ing the closing of S. W. South River, Drive at a Certain looation was received and
read and on motion duly made and seconded was ordered filed and copied upon the
minutes of the meeting and no action taken thereon:

J. E. Lummua, City Commissioners
of the City of Miami:
We, the undersigned, representing all of the property
camera in the territory affected, moat respectfully petition
your Honorable Body that a suitable resolution may be passed by
the City Co::Imissionere closing what is oalled S. W. South River
Drive, City of Miami, from a point beginning on the northern
boundary of d. VI. Second street to a point ending on the south
aide of 0. W. Fourth Street, in the City of Miami.
The maps of the city show that there ie a street at
the point named, whereas there is no such street and never has
been a street. It would be a physical impossibility to plane
this street where it is shown on the map is cause the same is in
the Miami River and would have to be filled in materially for
the purpose of having a street there. The place indicated is to-
tally unsuitable for a street and only causes great and uneeessary
confusion in the relation of property transfers in this section
and in the enjoyment of. the property owned by your petf.tioners.
As stated, the undersigned own all of the property in
the territory affected and opposite our names are set forth the
property that we own in the affected area.

0n motion of fir. Wilson, seoonded by Mr. Leffler, the said resolution was adopted by
the following vote; AYES: Messrs. Romfh, Lummue, Leffler, Wilson, Gilman. NOES*

ACCEPTING DEDICATION OF STREETS IN SUBDIVISION BY BOARD OF PUBLIC INSTRUCTION
The Direotor of Public Service submitted a plat of a subdivision of Sohcul Property
by the Board of Public Instruction and stated that upon examination the same met with
his approval and was in aocord with the rules and regulations of the Department of
Public Service and the said plat showing the dedioation of certain s treats to the use
of the public an ordinance entitled:
AN ORDINANCE ACCEPTING THE DEDICATION OF THE
STREETS SHOWN IN THE SUBDIVISION OF SCHOOL
PROPERTY BY THE BOARD OF PUBLIC INSTRUCTION
was introduced by !Or. Wilson and on Me motion seconded by Lir. Laffler,it was resolv-
ed that the Charter requirement for reading ordinances on two separate 000aeione be
dispensed with. The vote thereon was as follows: AYES: Meeere. Romfh, Lummue, Lef-
fler, Wilson, Gilman. NOES: None. Motion carried unanimously and the charter re-
quirement dispensed with. Thereupon, upon motion duly made and seconded, the said
ordinance was given its first reading and was read by title only. Motion by Mr,
Wilson, seconded try Mr. Leffler, that the ordinance be passed on its first reading by
title only. Roll called end the vote thereon was as follows: AYES: Messrs. Romfh,
Llumnus, Leffler, Wilson, Gilman. NOES: Nene. Motion unanimously carried and the
ordinance passed on its first reading by title only. 0n motion duly made and seoond-
ed the said ord inanoe was given its second and final reading and was read in full.
0n motion d' Mr. Wilson, seoonded by Lir. Gilman, the ordinance was paesed and adopted
on its second and final reading in Full by the following vote: AYES: Messrs. Romfh,
Lummus, Leffler, Wilson, Gilman. NOSS: None. The ordinance is numbered 244 and is
shown in ordinance Book 1 at page 202 as passed and adopted by the City Commission.
PREPARATION OF PRELIMINARY ASSESSMENT ROLLS ORDERED AND DIRECTION TO GIVE NOTICE
Zee following resolution directing the City Manager to make and file Preliminary Ae-
easement Rolle and directing the Clerk to cause notice to be given that the Commis-
sion will receive and consider all objeotions to the confirmation of the said Preli-
minary Assessment Rolle was introduced by Lir. Lummus:

A RESOLUTION DIRECTING 'THE 0I`TY MANAGER TO PREPARE AND
FILE WITH THE CITY CLERK CERTAIN PRELIMINARY ASSESSMENT
ROLLS AS SET FORTH IN THIS RESOLUTION AND DIRECTING THE
PUBLICATION OF NOTICES FOR OBJECTIONS TO THE CONFIRMA-
TION OF SAME.
WHEREAS, the oontracte entered into for the improvement of certain
streets under the following Improvement Districts, to -wit:
Storm Sewer Improvement District No. 80,
Sanitary Sewer Improvement Districts Nos. 83,84,85,87,88,89,90,91:
and 92,
Highway Improvements Nos. 205, 206, 207, 208, 209, 210, 211, 212,
213, 214, 215, 216, 217, 218, 219,220, 221, 222, 223, authorized by re-
solution of the Commission of the City of Miami have been duly ratified
and confirmed by the Commission of the City of Miami,
NOW, THERF'ORE, BE IT RESOLVED by the Commission of the City of Mi-
ami :
1: That the City Manager be, and he is hereby, directed to make
and file with the City Clerk a preliminary assessment roll of each of
said improvements as provided in Section 56 of the City Charter.
2: That upon the filing of said preliminary assessment rolls, the
City Clerk cause notice to be given in a newspaper published in the City
twice weekly for two weeks, stating that at a meeting of the Commission
of the City of Miami to be held on a oertain day and at a certain hour,
not less then twelve days from the date of the first publication, any
person whose property 1s desoribed in said preliminary assessment rolls,
may appear and file written objeotions to the confirmation of the said
preliminary assessment rolle.
On motion of Mr. Lummus, seoonded by Lir. Leffler, the said resolution was adopted by
the following vote: AYES: Messrs. Romfh, Lummus, Leffler, Wilson, Gilman. NOES:
None.

PREPARATION 0" BALLOT BOZOS
The Commission proceeded to prepare the ballot boxes to be used in the f orthooming
Special Election to be held on May' 21st, 1924, for the purpose of voting for or
against the proposed issue of General Improvement Bonds aggregating $950,000.00, by
placing in a ballot box of sufficient size to receive and oontain all the ballots
to be oaet at the eleotion for the proposed ieauanoe of General Improvement Bonds,
twioe as many ballots, caused to be printed by them, as there are registered qua li-
f ied eleotore eligible to vote in said eleotion. After eeourely looking the said
ballot box, sealing up the keyholes thereof, and all other openings, the Oommiseion

did send the keys thereof in a sealed envelope by the Chief of Police, who,
on motion duly.made and seconded,_ was made custodian of said ballot box and
was placed under oath to perform his commission faithfully and impartially
and without favor or prejudice, to the inspectors of said election together
