MINUTES OF THE METING OF THE BOARD OF COMMISSIONERS OF THE CITY OF MIAMI, FLORIDA. 0n this 4th day of March, A. D. 1924, the Commission of the City of Miami,.Flori- de, met in regular session at tha City Hall at Miami, Florida, at 9:00 o'olook A. M. The meeting was called to order by Chairman Romfh and on roll oall the following members were present: E. C. Romfh, J. E. Lummus, J. H. Gilman, C. D. Leffler. ABSENT: J. I. Wilson on a000unt of siokness. READING OF MINUTES OF MEETING OF FEBRUARY 26TH The Clerk read the minutes of the meeting of February 26th which were aooepted and approved as written. PRELIMINARY ASSESSMENT ROLLS SIDEWALK AND HIGHWAY IMPROVEMENTS The City Manager reported that the work under Highway Improvement No. 190 and Sidewalk Improvements No. 40, 42, 43, and 44 had been completed and thereupon the following resolution was introduced by Mr. Gilman: RESOLUTION NO. 1297. A RESOLUTION ACCEPTING THE WORK DONE UNDER CERTAIN HIGHWAY AND SIDEWALK IMPROVFMFNT DISTRICTS AND DI- RECTING THE CITY MANAGER TO PREPARE AND FILE WITH THE CLERK PRELIMINARY ASSESSMENT ROLLS ON SAID IM- PROVEMENTS AND PROVIDING FOR HEARINGS ON SAME. WHEREAS, the contract entered into for the improvement of: SIDEWALK DISTRICT NOS. 40, 42, 43 and 44 and HIGHWAY DISTRICT NO. 190, has been properly and completely done and is in conformity to the plans, profiles, details, drawings and specifications of the City Manager as adopted by the City Commission of the City of Miami for such improvements, THEREFORE, BS IT RESOLVED by the Commission of the City of Mi- ami: 1: That the said work for said improvements be, and the same is hereby, accepted by the Commission of the City of Miami. 2: That the City Manager be, and he is hereby, directed to make and file with the City Clerk preliminary assessment rolls of said improvements as provided in Section 56 of the City Charter. 3: That upon the filing of said preliminary assessment rolls the City Clerk cause notice to be given in a newspaper published in the City twice weekly for two weeks, stating that at a meeting of the Commission to be held on a certain day and at a certain hour, not less than twelve days from the date of the first publication, any person whose property is described in said preliminary assess- ment roll, may appear and file written objections to the confirma- tion of the said preliminary assessment rolls. On motion of I.Ir. Gilman, seconded by Lr. Leffler, the said resolution pas passed and adapted by the following vote: AYES: Messrs. Romfh, Lummus, Leffler, Gilman. NOES: None. Motion carried. REPORT OF CITY ATTORNEY IN CASE OF PARKING REGULATIONS BY CITY MANAGER The following communication was submitted by the City Attorney and after being read was ordered filed and copied upon the minutes of the meeting: Miami, Florida, March 3, 1924. City Commission, Miami, Florida. Gentlemen: In re: K. W. Pratt. Mr. K. W. Pratt was arrested, triad and oonvioted for the violation of the rules and regulations in reference to "For Eire" cars, said rules and regulations promulgated by the City Manager under and by City Ordinance #190 of the City of Mi ami. Under this ordinance the City Manager was given the authority to make and promulgate rules and regulations for traf- fic on the streets; to provide for parking spaces and, at any time, to discontinue the right to the use of auoh parking spaces. An appeal was taken from the Municipal Court and the validity of the ordinance was tested before Judge H. F. Atkin- son, the Circuit Judge. The firm of Evans & Mershon represent- ed Mr. Pratt and they contended that same was unreasonable, dis- criminating and delegated too much authority to the City Manager. The Circuit Judge, however, found, after argument of. oousel and briefs upon the subject, that the said ordinance was not unreasonable nor discriminative, nor was it an improper del- egation of authority to the City Manager, and upheld the vali- dity of the ordinance. IMP OF FUNDS WITHIN DEPARTMENT OF SAFETY The City Manager submitted a written request for the transfer of funds within the Department of Public+ Safety, Division of Polioe, made neoeasary by the large in-. oresse in the number of prisoners fed in the City Jail. The communication was or- dered filed and copied upon the minutes and ie au follows: Miami, Florida, March 3, 1924. Oity Commission, Miami, Fla. Gentlemen: The amount provided in the Budge of 4200.00 for (Feed- ing Prisoners" has been•exhausted, owing to the large inorease in the business handled by the Pollee Department over the pre- vious year. This increase in business in the Department and the cost of feeding prisoners is running about 60% over the same period last year. The fines and forfeitures aolleoted in the first eight months of this fiscal year have already exceeded the amount col- lected for the entire previous year. We carried in the Budge an item of 01500.00 far "Jail Repairs". We found this amount insufficient to make any mater- ial betterments to the jail, and this money will not be expended as contemplated. I will therefore ask that 01400.00 be transferred from "Jail Repairs" Code 171-13 to "Feeding Prisoners" Code 171-61. Respectfully, (Signed) F. H. A RESOLUTION AUTHORIZING THE TRANSFER OF CERTAIN FUNDS WITHIN THE DEPARTMENT OF PUBLIC SAFETY, DI- VISION OF POLICE, AS SET FORTH IN THIS RESOLUTION. WHEREAS, the City Manager requests the transfer of funds with- ing the Department of Public Safety, Division of Police, made neoes- sary by the large increase in the number of prisoners to be fed in the City Jail, and WHEREAS, the City Manager reperts that the appropriation to the account of "Jail Repairs " will not be used during the current fis- cal year as contemplated and recommends that 01200.00 be transferred from the said account of "Jail Repairs" to the Account of "Feeding Prisoners", THEREFORE, BE I'T RESOLVED by the Commission of the City of Mi- ami: That the sum of w1200.00 be, and 1s hereby, transferred from the Account "Jail Repairs" Code 171-13 to the account "Feeding Pri- soners" Code 171-51. On motion of Mr. Gilman, seconded by Mr. Leffler, the resolution was passed end adopted by the following vote: AYES: Messrs. Remfh, Lummus, Leffler, Gilman. NOES: None. Motion carried unanimously and the said resolution passed. COMPLAINT OF E. A. WADDELL AS TO LIENS REPORT OF CITY MANAGER The City Manager, as directed at the last regular meeting, submitted a written report on the complaint of Mr. R. A. Waddell having to do with oertain liens for improvements. The report of the City Manager was read and ordered filed and copied upon the minutes of the meeting. Miami, Florida, March 3, 1924. City Commission, Miami, Fla. Gentlemen: At your lest meeting, you referred to me a letter from Mr. E. A. Weddell to which was attached certified Copy from the Di- rector of Finance of sewer and pavement liens affecting property belonging to Mr. Waddell. Mr. Waddell in his letter olaims that the sewers were put down several years ago before there was any use for sewers in that part of the City and thinks that he ought not to be charged any interest on these sewer liens. I find that these sewers were put down in the early part of 1916, the sewer lien becoming effective Mar. let of that year. ' These sewers were put down at a cost to the lot owners of less than 36V a running foot which is much less than it would cost now to have this work done. I con see no legitimate reason why Mr. Wad- dell should be relieved cf the interest charges on these sewer liens. Referring to the paving of NW 20th $t. (Old Johnean St.) which was Brine the early part of 1919, will say that this paving was more or less of a temporary nature without curb and gutter, and only 16 feet in width, and the assessment for this work being only 93V per running foot to the property owners. This pavement was put down nearly five years ago and is still in fairly good con- dition. I am sure the property owners have got their money's worth, and have no rehl complaint coming. After due ooneideratian, the Commission, eating upon the reoommendation of the City Manager, was of the opinion that a cancellation of the interest charges on the liens set forth in the protest of Mr. Waddell was not justified and on motion of Mr. Leffler,seoonded by Mr. Lummus, it was resolved that the request of Mr. Waddell to cancel the interest charges on the improvement 116ns set out in hie protest be denied and that the Clerk advise LIr. Waddell of the action of the Commission. The vote thereon was as follows: AYES: Messrs. Romfh, Lum- mus, Leffler, Gilman. NOES: None. Motion carried. APPOINTMENT OF MEMBERS OF AIR BOARD FOR PERIOD OF 12 MONTHS The City Manager submitted the following oommunioation reporting the expira- tion of the appointments of the members of the Municipal Air Board: Miami, Florida, Maroh 4, 1924. City Commission, Miami, Fla. Gentlemen: The terms of office of the members of the Air Board expired on October 17th, 1923, and I herewith submit the names of the following gentlemen, whom I reoommend to be appointed as their suooeseors. B. B. Freeland, Harold Threadgill, G. A. Worley, Jr., Joe Reilly, Wallace Culbertson. These five men have all had some experienoe in fly- ing and have signified their willingness to serve on this Board. Respectfully, (Signed) P.H.WRARTON Whereupon the following resolution was offered by Mr. Lummua: RESOLUTION NO. 1299. A RESOLUTION APPOINTING FIVE MEMBERS TO SERVE ON THE MUNICIPAL AIR BOARD. WHEREAS, by Resolution No. 527, passed and adopted the 17th day of October, 1922, the Commission appointed an Air Board to serve for a period of one year from the date of said appointment, and WHEREAS, the term of said appointments have expired and it is necessary that ethers be appointed to serve en said Board, THEREFORE, BE IT RESOLVED by the Commission of the City of Miami: That B. B. Freeland, Harold Threadgill, G. A. Worley, Jr., Joe Reilly, and Wallace Culbertson, be, and they are hereby, appointed as members of the Municipal Air Board to serve for a period of 12 months from date. 0n motion of Mr. Lummus, seconded by Mr. Leffler, the resolution was passed and adopt- ed by the following vote: AYES: Messrs. Romfh, Lummus, Leffler, Gilman. NOES: None. CONFIRMING FJCF0UTI0N OP CONTRACT FOR HOSPITAL EQUIPMENT AND BUILDINGS The City Manager eubmitted for the approval of the City Commission the contract be- tween the City of Miami and George Jahn for the construction of Laundry and power Building and for the connecting of Corridors at the Miami City Hospital and after examination, the same meeting with the approval of the Commission, a resolution ratifying and confirming the execution of the said contract was offered by Mr. Lef- fler: RESOLUTION NO. 1300. A RESOLUTION RATIFYING AND CONFIRMING THE EXECUTION OF A CONTRACT BY THE CITY MANAGER, FOR AND ON BE- HALF OF THE CITY OF MIAMI, WITH GEORGE JAEN FOR CON- STRUCTIOII OF CERTAIN BUILDINGS AT THE MIAMI CITY HOS- PITAL.- WHEREAS, the City Commission, by resolution passed February 19th, 1924, authorized and directed the City Manager to enter into contract with George Jahn for the furnishing of labor and materials and for the oonstruotion and erection of Laundry and Power Building at and for the sum of 417,800.00 and connecting Corridors, acoording to alternate es- timate fg, at and for the sum of 13,466.00, and WHEREAS, the City Manager has submitted said contract duly exe- cuted by the City of Miami and tho contraotor together with bond fur- nished by said contraotor, both bond and contract having been approved as to form and execution by the City Attorney, NOW, THEREFORE, BE IT RESOLVED by the Commission of the City of Miami: 1: That the said contract between the City of Lilcmi and George Jahn for furnishing of labor and materials and the erection and con- struction of Laundry and Power Building at and for the sum of417,800. 00 and connecting Corridors, according to alternate estimate 12, at and for the sum of 013,466.00 be, and the some is hereby, ratified and confirmed by the City Commission o-f the City of Miami. 2: That the bond furnished by the said °entreat be, and the same ie hereby, approved. A petition from the property owners on N. W. Twenty-sixthStsigned by J. M. Franklin and others requesting the improvement of the said Street by the construction of pav- ing, ourb and sidewalks was reoeived and after being read was ordered oopied upon the minutes and referred to the Director of Pubiio Servioe. The said petition is as follows: Miami, Florida, February 18, 1924. Honorable Board of City Commissioners, Gentlemen: We the undersigned residents, living on North West 26th Street, do hereby petition and earnestly urge your honor- able body to have immediately paved our Street between North Miami Avenue and North West 2nd Avenue, due to the fact the streets immediately North of us are now being paved, curb and side -walk inoluded. We feel it would be unjust to ignore our petition as we have submitted two petitions in the peat three years asking for street, ourb and sidewalk, urging that you, give this matter it's due consideration. WATER FIRE LINE FROM HIALEAH WELLS PUROHASE OF PIPE AUTHORIZED The City Manager submitted oommunioation in reference to the construction of a water pipe line from the HiLoah wells to the City to which was attached communication from the Director of Public Servioe addressed to the City Manager. After being read the communications were ordered filed and oopied upon the minutes of the meeting and are as follows: Communication of City Manager; Miami, Florida M arch 4th, 1924. City Commission, Miami, Fla. Gentlemen: I am attaching hereto a letter from the D ireotor of Finance as to the comparative coat on oast iron pipe and wood stave pipe, and from the data he has accumulated and reoited in his letter, I believe the installation of the 30" Red Wood Pipe connecting the water supply at Hialeah and the distributing pipes in Miami, approximately 42,000 feet is cheaper in the long run than either the cast iron pipe or the creosoted fir. I would, therefore, recommend that the Red Wood pipe be used and that authority be given to the City Manager to or- der this pipe at once and the installation thereof. Respectfully, (Signed) F. H. Dear Sir: I wish to report the following figures obtained on relative costs and life of OAST IRON and WOOD STAVE pipe for our proposed 30" water line from Hialeah to Miami, the length of which line will be approximately 42,000 feet. Cast Iron pipe for 100' head will cppt delivered in Miami at the rate of 459.68 per ton. This pipe weighs 299# per foot, and will cost delivered in Miami, 0.71 per foot. To this should be.added: Per foot. Trenching and beck -filling cost of . 4 125 Haulage of pipe 30 Lead and Oakum 43 Laying and calking 57 or a total cost of 0.1.26 per foot, which would aggregate 4473,000.00. A continuous stave pipe for 100' head built of Creo- soted Fir with 8 pounds of creosote per oubio foot, will cos in place as follows: Per fuot. Pipe delivered and laid $ 3.34 Trenching; and baok-filling .11.25TOTAL . . I 4.59 which will aggregate 192,780.00. Continuous Stave Redwood pipe for 100' head, will oast in place, as follows: Po4.f3o7ot Pipe delivered and laid Trenching and back -filling 1.25 TOTAL. . . . . . ......... $ 5.62 whioh will aggregate $236,000.00. A 30" Cast Iron line with an initial head of 100' at pumping plant and a delivery head of 37' will deliver, when new 12,000,000 gallons of water in 24 hours. Ater six years' life it will deliver approximately 11,000,000 gallone in 24 hours, and hours. This loes in amount of water delivered being due to in - in 20 years it will deliver approximately 9,000,00 gallons in 24 oreased friction in the pipe caused by tuberoulation or scaling. Th A 30" wood stave pipe at the same initial and delivery heads will deliver practically 13,000,000 gallone of water in 24 hours when installed, and its capacity will not be decreased but, if anything, will tend to inorease. The life of oast iron pipe is rather hard to contemplate, but we will assume it to have a life of 50 to 100 years. A safe life of creosoted fir would be 15 years, while a safe life for R ed- wood would be 20 years. There are any number oi' cases where wood stave pipe built of Fir and Redwood have outlasted the life I have given, but from all data I have been able to get it would seem that we are perfectly safe in assuming the above longevity for the wood stave pipe. On this assumption and figuring interest on investment at 5%, the Cast Ifon line in 20 years will have cost in capital in- v e stme nt and interest ,a956,000,00. The line would still be good for 30 years or better, but it would have a decreased carrying oa- pacity of 3,000,000 gallons per day. The Redwood lino will have cost capital investment and interest a476,000.00, plus a renewal based on same oost as at pre- sent, a236,000.00, or ,012,000.00, which would give you at the end of 20 years a new line capable of marrying its full capaoity, or 13 miliion aallons at the heads first mentioned. The creosoted line at an initial cost of $193,000.00 based on 15 year life, would cost capital investment, renewal and depreciated. Adding, therefore, o this f igure ono -third of the interest $663,000.00 at the end oi 20 years, and would be one-third ee 4 cost of the original line would give a total cost and depreciation on this line of a725,000.00. It would seem, therefore, that the Redwood line would have an advantage in cost, and I would recommend ite purohase.
