READING OF MINUTES MEETING OF JANUARY 22ND The Clerk read the minutes of the meeting of January 22nd, 1924, and there being no corrections or additions thereto, the same were approved and aooepted as writ- ten. APPROVING CONTRACT WITH T. B. MoGAHEY FOR PAVING - PV.49 The City Manager submitted at this meeting the oontraot between the City and T. B. MaGahey for paving construction under Paving Contract No. 49, Districts 210 and 212 and upon examination the same meeting with the approval of the City Com- mission the following resolution ratifying and confirming the execution of the said contract by the City Manager for and on behalf of the City of Miami was ,in- troduoed by Mr. Lummus: RI SOLUTION N0. 1220. WHARSA , the Citty Commission, by resolution passed December 18th, 1923, authorized and direoted the City Manager to enter into contract with T. B. LlcGahey for construction of streets under Paving Contract No. 49, Districts No. 210 and 212, and WHNMEAS, the City Lpnager has submitted said contract duly exe- cuted by the City of Miami and the contractor together with bond fur- nished by said contractor, both bond and contract having been approved as to form and execution by the City Attorney, NOW, 'TEERaORb , 3L IT RESOLVED 0LVED by the Commission of the City of Miami: 1: That tr:e said contract between the City of Miami and T. B. MoGahey for construction of streets under Paving Contract No. 49, Dis- tricts no. 210 and 212, be, and the same is hereby, ratified and con- firmed by the City Commission of the City of Miami. 2: That the bond furnished by the said contractor be, and the same is hereby, approved. NOSS: Bone. Motion unanimously carried and the said resolution passed and adopted. / PURCHASE OF LaND. POWER PLriLT AND BUILDING AT HIi LAAH FOR WATER PURPOSES ;Written communication from Glenn H. Curtiss, President of Miami Studios, Inc., in reference to purchase by the City of the Studio Power plant equipment and ap- proximately seven acres of land at Hialeah was received and after being read was ordered filed and the clerk directed to copy same upon the minutes of the meeting: Hialeah, Fla. January 18, 1924. City Commissioners, Miami, Florida. Gentlemen: pursuant to the understanding at Last Monday's meeting of the Board, I hand you herewith in behalf of the Miami Studios Inc. a new proposal for the sale of the Studio's power plant equipment and approximately seven aores of land to be used in conneotion with the proposed city water works. Attached you will find a print of the property, photograph of the building and engine and an inventory of the properties to be transferred. After talking with Mr. Cotton it has been agreed that the Studio should operate the plant for a period of three months, or un- til the new generator is ready for installation. During this period the Studio Company will pay all expenses of operation and will supply Mr. Cotton's Department without charge, with the desired electrical ourrent for the pumping of the wells and the test work during that period. I personally am making an agreement with the City that if the City fails to find a suitable water supply at the Golf Course or in the neighborhood where this power plant oan be utilized for a pump» ing station, within one year from date, I will take from the City the power plant and equipment at full purchase price. A RESOLUTION AUTHORIZING AND DIRECTING T}1i OITY MANAGLR TO PURCHASE THS AAST HALF OF THE EAST HALF OF THS NORTHWEST QUARTER OF THS SOUTHWEST QUARTER OF SECTION 18,TOWNSHIP 63 SOUTH, RANGE 41 EAST, CONTAINING 7 CARES MORE OR LSSS, MEER WITH THE POWER PLANT BUILDING SITUAT4D THSRSON AND ALL TB, POWER EQUIPMENT FOR THE SUM OF 463,320.00 AND PRO- VIDING FOR THS PAYMENT THEREOF. WHSREAS, the City Commission deem it necessary to puxohase and own the property desoribed as follows; the East Half (Ai) of the East Half (Si) of the Northwest quarter (NW) of the southwest Quarter (SWi) of Section 18, Township 53 South. Range 41 Seat, containing 7 aoree more or lees, together with the power plant and building situated thereon and power plant equipment for the purplose of obtaining an adequate water supply for the City uf Miami, NOW, THEREFORE, BE IT RESCLVED that the City Manager be, and he is hereby, authorized and direoted to purohase the property deeoribed as follows; The East Half (Ei..) of the at Half (Ei) of the Northwest Quarter (We) of the southwest Quarter (SWi) of Seotion 18, Township 63 South, Range 41 East, containing 7 auras more or less, and power plant and equipment thereon for the sum of 463,320.00 upon the approval of the title and deed by the City Attorney and the furnishing of a bond by Glenn H. Curtiss guaranteeing that after fair and euffioient investigation and experimentation that should the City find the water supply now on said real estate or in the neighborhood thereof not euffi- oient and suitable, thet the said Glenn H. Curtiss is to repurchase the said property and equipment thereon at and for theebum of 463,320.00. NOee: eons. Motion carried and the said charter requirement dispensed with. Thereupon, upon motion of Mr. Lummus, seconded by mr. Gilman, the ordinance tires given ite first reading and reed by title only. Moved by Lr. Lummus and seconded by Mr. eilman that the ordinance be passed on its first reading. CONFIRMA2ION OF Re6OLUTIONS OeDERILG IMIROVE1SNT4 SANITARY -SEWERS NO. 90 AND 91 The Clerk reported that pursuant to direotions contained in resolutions adopted at the last regular meeting he had given notice in a newspaper of general circulation in the City that the Commission would on this date receive and consider the remonstranoes of all persons interested in Sanitary eewer Improvements No. 90 and 91 and submitted proofs of publication of such notice. It was announced that the Commission was ready to receive and consider any remonetranoes to the said Improvements. there being no remonstranoes or.objections thereto resolutions confirming the resolutions ordering the said improve- ments were offered. Resolution No. 1242, confirming the resolution ordering Sanitary Sewer Improvement No. 90 was introduced by Mr. Gilman and 12 as follows: DISTRICT SR. 90 RESOLUTION DO, 1222. MMBOliaIiOMMIBIEWIllll p•IIIUplI11111111 • r11 the Commission of the City of Miami, has prepared and filed with the City Olerk plans and epeoifioationa of such improvement and an estimate of the cost thereof, inoluding an estimate of the cost of the incidental expenses of said improvement, and whereas due notice by publication as required by the City Charter has been made that the Commission of the City of Miami would on the 29th day of Janura.ry, 1924, at the City Hall at 9:00 a. m. o'olook, receive and hear the remonstrances of all interested persons to the confirmation of said resolution ordering said improvement, and all remonstrances received having been heard and considered by the Commission of the City of Miami. THEREFORE, BE IT RESOLVED by the Commission of the City of Miami: That the said resolution of the Commission of the City of Miami ordering Sanitary Sewer Improvement No. Sr. 90, District 3r.90 be, and the same is hereby oonf irmed. BE IT FURTHER RESOLVED that the City Clerk cause to be published at least 3 times in the MIAMI HERALD, a newspaper of general circulation in Miami., Florida, and in THE FLORIDA TIMBS-UNION, a newspaper of general circulation throughout the State ,publi shed at Jacksonville, Florida, a notice calling for sealed bids to be received by the Commission of the City of Miami on the llth day of Maroh, 1924, at 9:30 a.m. o'clock, for the construotion of the said work. Said notice shall state the improve- ment is to be constructed, and paid for in cash, under Section 56 of the City Charter. Any bid. coveringwork to be done under more than one resolu- tion shall be in such form as to permit a separation to be wade of the cost under each resolution. Each proposal must be accompanied by a cer- tified check upon a bank or trust company of Florida, in the amount of 26 of the amount of the bid, payable to the City of Miami, to insure the execution of a contract and bond to carry out the cork in accordance with the plans and specifications. All bids will be opened and award. of con- tract made or all bids rejected. After an award has been made, the chocks of all bidders, other than the one to whom the contract has been awarded, shall be returned. In default of the entering into of Bich con- tract, the certified check required to accompany such bid shall be for- feited to the City of Miami, Florida, not as a penalty, but as liquidated damages f or the del ay or addi tional cost wh ich may be incurred by the City, by reason of arch default. AEROPLANE HANGER AT HIALEAH COMPLETION OF SAME The City Manager submitted to the Commission at this meeting communication in refer- ence to the completion of aeroplane hanger at Hialeah. The said communication of the City Manager was ordered filed and Copied upon the minutes of the meeting and is as follows: Miami, Florida, January 25th, 1924. City Commies ion , Mia mi , Fla. Gentlemen: Olen the aeroplane hanger at Hialeah was erected last year, there was not enough corrugated roofing to cover the *had, and same has remained un-completed to the present time. It will take 80 sh eets of co rrugated roof ing to complete the hangar, and we have a propositial from Mr. Earl Smith who is in charge of the glying at Hialeah, that if the Citywill purchase these 80 sheets of roofing, he will have the same piton. The cost of these 80 sheets will amount to $74.76, and as there :seems to be no place we can take care of this in the budget, I will ask for an appropriation from the General Fund of this amount so that the work can be completed. A RESOLUTION APPROPRL1TING THE SUM OF $74.76 FROM THE GENRAL FUND SURPLUS POR THE PURPOSE OF COMPLETING AEROPLANE 1A)1GEli AT RIALP,AR. WHEREAS, the City Manager reports that the aeroplane hanger ereoted by the City of Miami at Hialeah laet year is uncompleted and that it will te.k• about 80 eheets of oorragated roofing to complete the same and that the cost of said 80 sheets of roofing will be $74.76, and dHEREAS, there le no provieion in the budget for the payment at this cost and it is necessary that an appropriation be made with which to complete the said aeroplane hanger, NOW, THUREFORE, BE IT RESOLVED by the Commission of the City of Miami: 1: That the sum of $74.76 be, and tho same is hereby, appropriated from the General Fund Surplus for the purpoee herein eb ore set forth. 2: That the City Manager be, and he is hereby, authorized to take the necessary steps to complete the said aeroplane hanger at Hialeah. E. 30th TERRACE PORTION REFUNDED Britten communication from the City Manager under date of January 28th addressed to the City Commission in reference to the complaint of Mr. T. O. dilson and lir. L.K. Cone, property ownere on N. E. 30th Terrace, as to sanitary sewer assessments against their property was received and ordered filed and copied upon the minates. The said. communication of the City Manager is as follows: Miami ,Florida, January 28, 1924, City Commission, Miami, Fla. Gentle men: Mr. T. O. valson and. Mr. L. K. Cone have filed a complaint in reference to their sanitary sewer aseessment of $1.73 per lineal foot affecting their property 150 feet each on N. E. 30th Terrace. I have had, the Director of Public Service farnish me with what information they had. in reference to this matter and. I find the facts about as follows: The out fall for the original sewer in Broadmore was at the end of E. E. 30th Terrace, and. discharged into the bay from that point. Later on when 'Tr. and. Mr. Cone made a fill in front of their property, a new bulkhead line was established to the east- ward and they extended t1 sewer on out to the bay, bearing allof the co st of the sewer . Later on under Janitary District No. 45, the sewer system in Broa.d.more was changed and the out fall for this territory was di- verted to N. S. 3let and N. E. 29th Areets, leaving the sewer on N. E. 30th Ter -race only a short etub-end sewer to serve the property on this street between the original manhole and the bay. Then .anitary District No. 45 was formed, a new cast iron sewer was put in to replace the or iginal sewer and. was rut down to a lower depth. I do not see myself and the records do not show why it was necessary to take up the first sewer and replace it at a lower depth, as the original sewer was low eneugh to take care of the pro- perty it served. The assea.ment on this stub -line cast iron sewer was $1.73 per lineal foot whereas the other sewer assessments in Dist No. 45 were 65¢ per lineal foot terracotta sewers. Mr. 11.1son end Mr. Cone are willing to pay 65¢ per lineal foot for this sewer and I be- lieve it would be fair on the part of the City to settle with them on that basis. In that event it will be necessary to have a resolution authorizing the City Manager to settle on that basis and for an appro- priation of $324.00 ( 162.00 each) to re-imburee them on account of a see es ment s Reepeetfully, F. H. vIHARTON City Manager After some discussion it was the sense of the Commiesion that the settlement recommend- ed by the City Manager was a fair atijuetment of the assessments and thereupon a resolu- tion authorizing the city Manager to refund a porition of the assessments against the property as set forth in the resole.tion and making an apTropriation from the General Fund Surplus for the purpose was offered by Mr. Wilson and is as follows: RESOLUTION NO, 1226. E. 30th Terrace, the aseesement for Welch wa.s 65¢ per lineal foot, has been taken up and. replaced by a cast iron sewer at a cost of $1.73 per lineal foot, and. that T. O. Wilson and L. K. Cone, property owners on sail street, have made complaint that they are unwilling to ley the assessment of 41.73 for the new sewer, but are willing to pay 65 per lineal foot for same, which was the cost of the original sewer, and Miami: WHEREAS, the City Manager reports that he can find no record and knowe of no reason wby it was neoeeeary to replace the original sewer on said street with a oast iron sewer and recommends that the oity not charge aiinst the property of T. 0. Nilson and L. K. Gone whose property was satisfactorily served by the original sewer, the full assessment of 01.73 per lineal foot for the oast Iron sewer, but assess 65¢ per lineal foot against the said property for the sewer constructed under District Sr. 45, and WHEREAS, it is necessary that an appropriation of 0324.00 be made from the General Fund Surplus for the purpose of settling on the basis recommended by the City Manager, NOW, THEREFORE, BE IT RESOLVED by the Commission of the City of Miami: 1: That the City Manager be, and he is hereby, authorized and directed to refund to T. 0. Nilsen, the owner of the East 165 feet of Lot 10 of Block 6, Broadmoore, and to L.K.
