LEYMA1 AND FRED W. MAXWELL FOR THE CONVEYANCE OF
THE PROPERTY KNOWN AS

MAKING SAID PAYMENT; AND DIRNOTING THE OITY ANA-
GER AND DIR1OTOR 0a FINANOB, OR EITHER OF THEM, TO
MAKm A TENDER OF SAID $175,000.00 TO SAID L. T.
HIGHLEYM&N AND DEMAND A 00I1VBYANOE OF SAID EWER
PIER PROPERTY UNDER PROPER DESORIPTION AND REQUIR-
ING ANY DEED TENDERED THE OITY IN PURSUANCE OF SAID
TENDER TO BE APPROVED BY THE CITY ATTORNEY.
BE IT RESOLVED BY THE °OMMISSIOZr OF THR CITY OF MIAU1:
Section 1. That the City Attorney be, and he is hereby
authorized and directed to institute such suit in the name
of, and on behalf of the City of Miami, Florida, against the
said L. T. Highleyman, and all other persons in interest,
for the purpose of carrying cut the contract between the City
of Miami and L. T. Highleyman and Fred W. Maxwell for the con-
veyance of the property known as Sissy Pier, for the sum of
4175,000.00.
Section 2. That the sum of 0.75,000.00 be, and is here-
by appropriated from the Park Bond Fund for the purpose of
making said payment.
Section 3. That the City Manager and the Director of
Finanoe, or either of them, are hereby direoted to make a
tender of said 0175,000.00 to said L. T. Highleymand and de-
mand a conveyance of said lS1ser Pier property under proper
description and any deed tendered the City in pursuance of
said tender to be approved by the City Attorney.
