and the City I;anager, under the direction of the Commission of
the City of Miami, has prepared and filed with the City Clerk
plans and specifications of such improvement and an estis►ate
of the cost thereof, including an estimate of the cost of the
incidental expenses of said improvement, and whereas due notice
by publication as required by the City Charter has been Made
that the Commission of the City of Miami would on the
30th day of 0ctober 192 3 , at the City
Hall, at .9:00 a.m. o'clock, receive and hear the. rer:,onstranoes
of all interested peraons to the confirmation of said resolution
ordttring said improvement, and all remonstrances received having
been heard and considered by the Commission of the City of Miami.
Therefore, Be It Resolved by the Commission of the City
of Miami, Florida, that the said resolution of the Commission of
the City cf Miami ordering said Sidewalk Improvement No. 46
Dictrict Sk.46 be, and the same is hereby confirmed.
Be It Further Resolved, that the City Clerk cause to be
published at least 3 t iaiee in the 1LIAMI HERALD
a newspaper of general circulation in Miami, Florida; and in
.FLORID TIMES -UNION
a newspaper of -eneral circulation throughout the State, pub-
lished at Jacksonville _, Florida, a notice 'caliina. for
sealed bids to be received by the Coair.:ission of the City of Miami
on the
llth day of December 1923 ,, at 9 :15Q a.m.
o'clock, for the construction of thd said work, Said notice
shall state the improvement is to be constructed, and paid for
in cash, under Section 36, cf the City Charter. Any bid cover-
ina work to be done under more than one resolution shall be in
mach fors: as to permit a separation to be made of the cost under
each resolution. Each proposal ritst be accompanied by a cer-
tified: check upon a barnn or trust company of Florida, in the arr,iount
cf 2-'z`ji cf the amount of the bid, payable to the City of Miami,
to insure the execution of a contract and bond to carry out the
work in accordance with tho plans and specifications. All bids
will be opened and award of contract made or all bids rejected.
After an award has been made, the checks of all bidders, other
than the one to whom the contract has been awarded, shall be re-
turned. In default of the Merin;; into of such contract, the
certified check recuired to :.ccor..;any such bid shall be fcr-
feited to the City of Uiar.:i, Florida, . not as a penalty, but as
liquidated damaaaeo for the delay or additional cost which may
be incurred by the City, by reason of such default. No bid
will be pers:itted to be r,it'hdrawa for any reason whatever after
having. been filed with the Clerk.
