Whereas, the Comr,14aicn of the City of Miami, by reso-
lution Passed and adopted the l5th ;lay of May 19 23
ordered slrtewalk improver ent _42 , District qY _ 42
afid the City 1',anareer, under the direction of the Commission of
the City of Miami, has 1%repared and filed with the City Clerk
plans and specifications of such improvement and an estimate
of the cost there•.sf, incluline an estimate of the coat of the
incidental expenses of said imeroverdent, and whereas due notice
by publication as required by the City Charter has been wade
that the Commission of the City of Miami would on the
22nd day of May 1923 , at the City
Hall, at gran o'clock, re oeive and hear the remonstrances
of all intereste'9 )ereons to the confirmation of said resolution
ordebrin; said improvement, and all eemonetrances received having
been heard and considered by the Cot.;ra.isaion of the City of Miami.
Therefore, Be It fG-olved by the Commission of the City
of Miami, Floric'.a, that the :said resol radon of the Commission of

District 42 be, and the same is hereby confirmed.
Be It Further Resolved, that the City Clerk cause to be

lished at JacItsonv1l-1e , Florida, a notice calling for
sealed bids to be received by the Cordr..issicn of the City of Miami

shall state the imeecveraent is be constructed, and paid for
in cash, under Section 5o, cf the City Charter. Any bid cover-
ing work to be done under more than one resolution shall be in
sash form as to permit a seraration to be made of the cost under
each resolution. Each ercresal must be accoe::anied by a cer-
tified check ueoi; a bank or t.cust col. any of Florida, in the amount
cf 2z/: cf the amount of the bid, eayabie to the City of Miami,
to insure the e::ecuton of a contract and bond to carry out the
work in accordance with the plans and specifications. All bids
will be opened and award of con+Tact made or all bids rejected.
After an award has been .Tia le, the checks of all bidders, other
than the one to whom the contract has been awarded, shall be re-
turned. In default of the eiexing into of such conliact, the
certified check regi fired to accor..)any such bid shall be for-
feited to the City of t:iwi, Florida, not as a penalty, but as
liquidated damaees for the delay or additional cost which may
be incurred by tY,e Ct4y, by reason of such default. No bid
will be pe_mitted to be withdrawn for any reason whatever after
